PUBLIC HEARING NOTICE
OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

Pursuant to sections 3111.53, 3121.78, and 3125.25 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the rescission and adoption of the rules as identified below and of a public hearing thereon.
The following Ohio Administrative Code (OAC) rules are being proposed for rescission. Each rule has been reviewed in accordance with the five- year rule review requirements.
· Rule 5101:1-29-35, "Medical Support." This rule describes the responsibility of the Child Support Enforcement Agency (CSEA) to establish and enforce medical support orders for all IV-D cases. This rule is being proposed for rescission because most of the information is already contained in the following OAC rules: 5101:1-29-13, 5101:1-29- 35.1, 5101:1-29-35.2, 5101:1-29-35.6, 5101:1-29-36, 5101:1-31-14, and 5101:12-10-
31.2. Any other relevant information will be added in the near future to the new medical support rules that will be numbered under division 5101:12.
· Rule 5101:1-30-14, "Financial institution data match (FIDM)," describes the process by which a CSEA can withdraw funds from an obligor's financial institution account when that obligor is in default of a support order. Although the provisions of this rule remain current, this rule is being proposed for rescission and will be replaced by OAC rule 5101:12-55-10 because of the transition of child support rules from division 5101:1 to division 5101:12.
· Rule 5101:1-32-01, "Role of the CSEA administrative officer," describes the qualifications, procedures, requirements, and standards necessary for the employment of the administrative officer, pursuant to section 3111.53 of the Revised Code. It is being replaced by OAC rule 5101:12-30-25. Although the provisions of this rule remain current, this rule is being proposed for rescission and will be replaced by OAC rule 5101:12-30-25 because of the transition of child support rules from division 5101:1 to division 5101:12.
The following rules are being proposed for adoption.
· Rule 5101:12-55-10, "Financial institution data match program," describes the process by which a CSEA can withdraw funds from an obligor's financial institution account when that obligor is in default of a support order. This rule replaces rule 5101:1-30-14.
· Rule 5101:12-30-25, "Role of the CSEA administrative officer," describes the qualifications, procedures, requirements, and standards necessary for the employment of the administrative officer, pursuant to section 3111.53 of the Revised Code. The language in the rule has been revised for clarity; and no other substantive changes have been made to the rule. This rule replaces rule 5101:1-32-01.
Copies of the proposed rules are available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at http://www.registerofohio.state.oh.us/.
A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
