    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to Chapters 5104. and 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon. These rules are being proposed for amendment following the passage of Am. Sub. H.B. 153 of the 129th General Assembly which instituted cost savings measures in the publicly funded child care program.

     

    Rule 5101:2-16-30 entitled "Eligibility requirements for receipt of publicly funded

    child care benefits" contains eligibility requirements for receipt of child care benefits. It is being amended to reduce the maximum monthly gross income level allowable from 150% of the federal poverty level (FPL) to 125% FPL as shown in the appendix; to adjust      the amounts in the appendix to reflect the use of the 2011 federal poverty guidelines      in determining the amounts; to define the hourly, part-time and full-time categories         of authorization; to delete language referring to Head Start/child care partnership programs; to add policy allowing reinstatement of eligibility within sixty days of termination; and to clarify one of the definitions of family.

     

     

    Rule 5101:2-16-39 entitled "Copayment for publicly funded child care" contains the requirements for families to pay a copayment when receiving publicy funded child care benefits. It is being amended to adjust the amounts of monthly copayments in the appendix to reflect the use of the 2011 federal poverty guidelines in determining the amounts; to add a new weekly copayment table to the appendix showing weekly amounts that will be assigned as the new child care data system changes are implemented; to delete language referring to fees; and to clarify existing language.

     

    A copy of the proposed rules is available, without charge, to any person affected by the rules at the address listed below. The rules are also available on the internet at  http://www.registerofohio.state.oh.us/. A public hearing on the proposed rules will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
