5123:2-9-13 Home and community-based services waivers - career planning under the individual options, level one, and self-empowered life funding waivers.

    NOTICE OF PUBLIC HEARING

     

     

    Pursuant to Chapter 119. of the Revised Code and 42 CFR 447.205, the Ohio Department of Mental Retardation and Developmental Disabilities (ODMRDD) hereby gives notice of its intent to rescind the following rules under Chapters 5123:1-2 and 5123:2-9 of the Administrative Code on a permanent basis on or about October 5, 2008, and to conduct a public hearing thereon.

     

    Rule 5123:1-2-08 entitled "Payment Standards for Home and Community-Based Services (HCBS) Individual Options (IO) Waiver." The purpose of the rule is to establish the standards governing payment for HCBS waiver services provided to individuals enrolled on the Individual Options waiver. The rule is no longer necessary; as of June 30, 2008, the system transitioned to the new reimbursement method set forth in rule 5123:2-9-06.

     

    Rule 5123:1-2-11 entitled "Payment Standards for Home and Community-Based Services (HCBS) Waivers for Individuals Residing in Facilities Licensed and Operated in Accordance With Division (W) of Section 5123.18 and Section 5123.19 of the Revised Code and Enrolled on the Individual Options (IO) or Residential Facility Waiver." The purpose of the rule is to establish the standards governing payment for HCBS waiver services to individuals residing in facilities licensed and operated in accordance with division (W) of section 5123.18 and section

    5123.19 of the Revised Code and enrolled on the Individual Options or Residential Facility waiver. The rule is no longer necessary; as of June 30, 2008, the system transitioned to the new reimbursement method set forth in rule 5123:2-9-06.

     

    Rule 5123:2-9-10 entitled "HCBS Waivers - Day Habilitation." The purpose of the rule is to specify the service definition for Day Habilitation and to set forth the certification standards required under section 5123.045 of the Revised Code for providers of Day Habilitation services to individuals enrolled on HCBS waivers administered by ODMRDD. The rule is no longer necessary as the service named "Day Habilitation" ceased to exist effective January 1, 2008.

     

    Rule 5123:2-9-12 entitled "HCBS Waivers - Payment Standards for Day Habilitation." The purpose of the rule is to establish the standards governing payment for Day Habilitation services provided to individuals enrolled on HCBS waivers administered by ODMRDD. The rule is no longer necessary as the service named "Day Habilitation" ceased to exist effective January 1, 2008.

    Rule 5123:2-9-13 entitled "HCBS Waivers - Supported Employment." The purpose of the rule is to specify the service definition for Supported Employment and to set forth the certification standards required under section 5123.045 of the Revised Code for providers of Supported Employment services to individuals enrolled on HCBS waivers administered by ODMRDD. The rule is no longer necessary as the service named "Supported Employment" ceased to exist effective January 1, 2008.

    A public hearing on the proposed rules will be held on August 22, 2008, beginning at 10:00 a.m., and continuing until all persons in attendance have had an opportunity to testify. The hearing will be held in the large conference room of the ODMRDD Administrative Offices Building located at 1810 Sullivant Avenue, Columbus, Ohio 43223-1239. At this hearing, ODMRDD will accept verbal and/or written testimony on the proposed rules under consideration.

    Persons unable to attend the public hearing may submit written comments on the proposed rules. Any written comments received on or before the public hearing date will be treated as testimony and made available for public review.
