    5101:12-50-17             Seek work orders.

     

     

     

    (A)This  rule  describes  the  circumstances  under  which  a  court  or  child  support enforcement agency (CSEA) may issue an order requiring the obligor to seek work.

     

    (B)When the obligor under a court support order is unemployed, has no income, and does not have an account at any financial institution, the court may order the obligor, if able to engage in employment, to seek employment or engage in work activities under the Ohio works first (OWF) program. The CSEA with administrative responsibility may request that the court issue an order requiring an obligor to seek employment or engage in work activities under the OWF program if the CSEA determines that an obligor is unemployed, has no income, and does not have an account at any financial institution.

     

    (1)The court shall include in the order a requirement that the obligor shall notify the CSEA immediately upon obtaining employment, any income, or ownership of any asset with a value of over five hundred dollars.

     

    (2)The court shall issue the order as part of a support order or, if the support order previously has been issued, as a separate order. The court may issue the order regardless of whether the obligor is a recipient of OWF services

     

    (a) If the obligor is a recipient OWF services and has signed a self-sufficiency contract pursuant to section 5107.14 of the Revised Code, the seek work order shall contain the same work activity requirements as the signed self-sufficiency contract

     

    (b) If the obligor is the subject of a seek work order and subsequently signs a self-sufficiency contract, the court will change the seek work order to require the same work activities as the self-sufficiency contract.

     

    (C)If the obligor under an administrative order is unemployed, has no income, and does not have an account at any financial institution, the CSEA with administrative responsibility shall order the obligor, if able to engage in employment, to seek employment or engage in work activities under the OWF program.

     

    (1)The CSEA shall include in the seek work order a requirement that the obligor notify the CSEA immediately upon obtaining employment, any income, or ownership of any asset with a value of over five hundred dollars.

     

    (2)The CSEA shall issue the seek work order whether or not the obligor is a recipient of OWF services.

     

    When the obligor is a recipient of OWF services and has signed a self-sufficiency contract pursuant to section 5107.14 of the Revised Code, the seek work order shall contain the same work activity requirements as the signed self-sufficiency contract

     

     

     

    (3) If an obligor fails to comply with an administrative seek work order, the CSEA shall request that the court issue an order in accordance with paragraph (B) of this rule.
