5101:12-55-03.4          Enforcement actions based on final and enforceable default determination.

 

 

 

(A)In accordance with section 3123.06 of the Revised Code, within fifteen days of a default determination becoming final and enforceable, the child support enforcement agency (CSEA) shall:

 

(1)If a JFS 04047, "Order/Notice to Withhold Income for Child and Spousal Support," (rev. 12/2002) was not issued upon identification of default, issue a JFS 04047 to any available income sources or seek to impose any other applicable enforcement actions as outlined in section (A) of rule 5101:12-55-03 of the Administrative Code, in accordance with division (C) of section 3123.06 of the Revised Code;

 

(2)If a JFS 04047 was issued and the final and enforceable determination of default altered the arrears amount stated in the JFS 04049, "Notice to Obligor of Default and Potential Action," (rev. 05/2005), issue a revised JFS 04047 or seek to impose any other applicable enforcement actions as outlined in paragraph (A) of rule 5101:12-55-03 of the Administrative Code, in accordance with division (C) of section 3123.06 of the Revised Code; or

 

(3)If a JFS 04047 was issued but the final and enforceable determination of default did not alter the arrears amount stated in the JFS 04049, permit the JFS 04047 to remain in effect. The CSEA may seek to impose any other applicable enforcement actions as outlined in paragraph (A) of rule 5101:12-55-03 of the Administrative Code, in accordance with division (C) of section 3123.06 of the Revised Code.
