    3770:1-9-949               Game rule number nine hundred forty-nine.

     

     

     

    (A)Title and term. Ohio lottery commission game rule number nine hundred forty-nine, "Ohio 50/50," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period beginning on the date when raffle ticket sales are commenced and continuing through the date established by the director as the final sales date.

     

    (B)General design.

     

    (1)Game rule number nine hundred forty-nine is a "raffle" style lottery game of the type generally known as an integer match game.

     

    (2)Except as otherwise provided in this rule, for each wager in game rule number nine hundred forty-nine the raffle ticket shall be imprinted with one integer as generated from the computer gaming system, and recorded on the ticket at the time of purchase. The integer shall be within the parameters of zero and nine million nine hundred ninety-nine thousand nine hundred ninety nine. There are ten million integers available per draw. Each ticket for game number nine hundred forty nine shall be sold in sequential order starting from a randomly selected starting point on each drawing and ending with the last ticket sold prior to the draw deadline. The player may purchase between one and five plays per ticket. No integer will be repeated on another raffle ticket for each specific raffle draw. The director shall determine if the Multi-draw feature will be available for each raffle game offered. A raffle ticket in game rule number nine hundred forty-nine shall only be valid for the specified raffle draw in game rule number nine hundred forty-nine. A holder of a valid winning ticket for a given raffle drawing in game number nine hundred forty-nine bearing the integer or integers drawn in that drawing, shall be entitled to a prize award established by the director for that raffle draw. A raffle ticket may not be canceled once the raffle ticket is printed by the Lottery terminal, even if such raffle ticket is printed in error.

     

    (C)Price of tickets. The price of a raffle ticket issued by the commission in game rule number nine hundred forty-nine shall be one dollar per wager. For every five dollars wagered in a single ticket transaction six integers will be printed.

     

    (D)Value of prize awards. The director shall establish the number of second and third tier prizes and prize amounts to be awarded per raffle game prior to the start of such raffle game. The type of prizes shall be awarded based upon the order of the integers drawn in accordance with commission rules, regulations and procedures for each raffle game. For the ticket bearing the top prize winning integer, the top prize will be fifty percent of total net sales per sales cycle.

     

    (E)Frequency of raffle drawings. Raffle drawings in game number nine hundred forty-nine shall be held at dates and times determined by the director. The director has discretion to change the frequency of such raffle drawings.

     

     

     

    (F) Manner of raffle drawings.

    (1) Raffle drawings shall be open to the public and may be held at such places in the state that the director shall determine. The director shall inform the public as to the time and place of each raffle drawing.

    (2) Each holder of a valid ticket for a given raffle drawing in game number nine hundred forty-nine is eligible to win in that raffle drawing. If the holder of a winning raffle ticket does not have the raffle ticket fully validated and the prize is not claimed and presented for payment within one hundred eighty days after the date of the raffle drawing, in accordance with the procedures set forth in lottery rules, such unclaimed prize shall be paid into the state lottery fund and distributed in accordance with section 3770.06 of the Revised Code.

    (3) All raffle drawings in game rule number nine hundred forty-nine will be conducted in accordance with random drawing procedures approved by the director. For every raffle drawing in game rule number nine hundred forty-nine, the director will approve procedures and mechanisms for the selection of winners and the awarding of prizes in order that random selection by the on-line computer system will be achieved.

    (4) Valid prize winners are determined by the integers drawn and not the integers reported. The lottery shall not be responsible for game rule number nine hundred forty-nine integers reported in error.

    (G)Validity of tickets.

    (1) Each purchaser of raffle tickets in game rule number nine hundred forty-nine shall be responsible for verifying the information on each raffle ticket. A raffle ticket may not be canceled once printed by the Lottery terminal, even if the raffle ticket is printed in error. The lottery shall be free of any liability in connection with this paragraph.

    (2) Each raffle ticket issued in game rule number nine hundred forty-nine shall have imprinted thereon at the time of purchase a control number, bar code data, or both, supplied by the commission. No prize shall be paid by the commission for any raffle tickets without such control number or bar code data.

    (3) All winning raffle tickets in game rule number nine hundred forty-nine are subject to validation by the on-line computer system under procedures established by the director before the payment of any prize.

    (4) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a raffle ticket in game rule number nine hundred forty-nine void if it is stolen, not

    sold or deemed not sold in accordance with commission rules; if it is illegible, altered, mutilated, or counterfeit; or if the raffle ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a raffle ticket declared void, if any, is limited to refund of the retail sales price of the raffle ticket.

    (H)Director's conduct of game rule number nine hundred forty-nine.

    (1) The director shall conduct game rule number nine hundred forty-nine in a manner consistent with the Lottery Act, the rules of the commission, including without limitation this rule, and the regulations of the director.

    (2) Names and definitions of elements of game rule number nine hundred forty-nine used in this rule are considered generic terms used solely for the purpose of this rule. In actual operation, game rule number nine hundred forty-nine and these elements may be given names or titles chosen by the commission.
