This filing is based on a R.C.119.032 rule review of Ohio Administrative Code Chapter 4501-7. For purposes of clarification and ease of use, proposed rule changes reflect a rule reorganization that separates provisions applicable to class "D" license schools from provisions applicable to commercial driver license (CDL) schools. Currently these provisions are combined in one rule (4501-7-12) Provisions applicable to CDL schools are included in proposed new rule 4501-7-29. Provisions applicable to class "D" license schools remain in, and are proposed for, amendment in rule (4501-7-12. Proposed expansion of the rule title is to enhance description of the rule content and to reflect the rule reorganization. Rule changes are also to provide clarity, update language, and to further organize rule language.

The rule provides requirements for training agreements for class "D" license schools. In addition to organization changes, changes include an update to reflect the Department of Public Safety office name change from "Governor's Highway Safety Office" to "Ohio Traffic Safety Office" (OTSO), language to clarify that schools have the right to include language in their contracts providing that they may deny training per their discretion, and provision clarifying that the date of training agreement execution is the day the agreement is to be provided to the student, or to a parent or legal guardian if the studet is under 18.
