    LEGAL NOTICE STATE OF OHIO

    DEPARTMENT OF JOB AND FAMILY SERVICES

     

    PURSUANT TO SECTIONS 5107.02, 5107.05, 5107.11, 5107.14, 5107.16, 5107.161, 5107.17, 5107.26, 5107.30, 5107.40,

    5107.69 AND CHAPTER 119. OF THE OHIO REVISED CODE, THE DIRECTOR OF THE DEPARTMENT OF JOB AND FAMILY SERVICES GIVES NOTICE OF THE DEPARTMENT'S INTENT TO PROPOSE AND AMEND RULES PERTAINING TO ELIGIBILITY FOR CERTAIN OHIO WORKS FIRST AND PREVENTION, RETENTION AND CONTINGENCY COMPONENTS ON A PERMANENT BASIS AND OF A PUBLIC HEARING THEREON.

     

    The following rules are being proposed for rescission and adoption:

     

    Rule 5101:1-23-50, entitled "Ohio Works First: the LEAP - Learning, Earning, And Parenting Program", is being rescinded and is being replaced by new rule 5101:1-23-50, entitled, AOhio Works First: the LEAP - Learning, Earning, And Parenting Program@. This rule sets forth the new LEAP eligibility requirements applicable to teen parents.

     

    The following rules are being proposed for amendment:

     

    Rule 5101:1-1-01, entitled "Temporary Assistance for Needy Families (TANF) Definitions" is being proposed to modify the definition of minor head of household.

     

    Rule 5101:1-1-03, entitled "OWF: Definitions of Assistance Group Composition for Work Participation Rates" is being proposed to modify language referencing the LEAP participation of teen parents in the assistance group with respect to work participation rates.

     

    Rule 5101:1-3-15, entitled "Ohio Works First (OWF): Penalties and Three Tier Sanctions", is being proposed to include two additional conditions that are subject to penalties in the OWF program.

     

    Rule 5101:1-23-10, entitled "OWF: Standard Filing Unit" is being proposed to include an additional category of individuals who are required to be in the OWF standard filing unit, but who cannot be included due to an ineligibility factor. This rule is also being modified for clarity to ensure that a legal guardian or legal custodian is not included in the standard filing unit with a child in the care of the custodian or guardian.

     

    Rule 5101:1-23-40, entitled "OWF: Payments" is being proposed to modify language regarding the beginning date of assistance for pregnant women and for teens who are required to participate in LEAP as a condition of OWF eligibility.

     

    Rule 5101:4-3-09, entitled "Food stamps:  Ohio works first (OWF) appraisal, self sufficiency contract requirements, and sanctions" is being proposed to add language regarding failure of a minor parent to attend a LEAP assessment, enroll in school, or withdraw from school.

     

    A copy of the proposed rules is available, without charge, to any person affected by them at the address listed below. These rules are available on the internet at http://www.state.oh.us/odhs/legal.htm. A public hearing on the proposed rules will be held on September 4th, 2003 at 10:00A.M. until all testimony is heard in Room 1823, Rhodes Office Tower, 30 E. Broad Street, Columbus, Ohio. Either written or verbal testimony on these rules will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than  September 4th, 2003  will be treated as testimony.
