NOTICE OF PUBLIC HEARING
The Public Health Council (Council) of the Ohio Department of Health has proposed to amend rule 3701-3-02; to amend existing rule 3701-5-03; to amend rules 3701-27-06, 3701-27-07.2,
3701-27-08, 3701-27-09, 3701-27-26 3701-27-27, 3701-27-29, and 3701-27-30; and to
rescind rules 3701-27-17, 3701-27-22 and 3701-27-23 of the Ohio Administrative Code.
First, proposed amended rule 3701-3-02 adds, modifies, and deletes particular infectious diseases to the list of diseases to be reported. This action was taken under authority of Revised Code (R.C.) 3701.23. The changes being proposed are based on the recommendations from the Infectious Disease Reporting Committee.
Secondly, the amendments to rule 3701-5-03 reflect the modernization fee that was enacted in Amended Substitute H.B. 95 of the 125th General Assembly and the $1.50 fee that was enacted in the Amended Substitute H.B. 66 of 126th General Assembly to fund the Family Violence Prevention Fund.
Finally, proposed amended rules 3701-27-06, 3701-27-07.2, 3701-27-08, 3701-27-09, 3701-
27-26, 3701-27-27, 3701-27-29, and 3701-27-30; and proposed rescinded rules 3701-27-17, 3701-27-22, and 3701-27-23 of the Ohio Administrative Code reflect the recommendations of the Manufactured Home Park Rule Review Committee concerning manufactured home park rules. This action is taken under authority of R.C. 3733.02. The proposed changes are being made mostly for the purpose of clarification, removing outdated language and rephrasing some existing paragraphs. The rescission of three rules is being proposed because the language in these rules is proposed for consolidation into other rules.
In accordance with Chapter 119 of the Revised Code, the Council will conduct public hearings on these proposed actions on Thursday, September 15, 2005 beginning at 10:00 a.m. The hearings will be conducted in the 8th floor conference room, Ohio Department of Health, 246 North High Street, Columbus, Ohio.
At the hearings, persons affected by the proposed actions may appear and be heard in person, by their attorney or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful. Persons intending to testify are encouraged to pre-register by writing Kaye Norton, Office of the General Counsel, Ohio Department of Health, 246 North High Street, P.O. Box 118, Columbus, Ohio 43216-0118, or by telephoning at (614) 466-4882.
