    In accordance with ORC 119.032, DAPC has reviewed rules contained in OAC Chapter 3745-24. Our preliminary review indicates these rules continue to be necessary with revisions. However, over one-half of the content of this rule is being eliminated. Therefore, DAPC has been advised to rescind this rule and propose OAC 3745-24-03 as a new rule.

    OAC 3745-24-03 - Deadlines for submission of the emission statements.

    The rule language is being changed for the due date for emissions statements to be the same as the deadline to fil emission fee report wchich is April 15th.

    This rule is being revised to state that emission statements for calendar years 1993 through 2004 would be due by November fifteenth of the calendar year following the year covered by the emission statements. This was a necessary change that was missed originally, as the interested party language referenced calendar years 1993 through 2003 (not 2004). This change was necessary so that upon making this rule effective, owners of facilities in non-attainment areas would not be in violation for missing the filing deadline for calendar year 2004 emissions statements. The deadline for filing the emissions statement, if it stood without the aforementioned revision, would have been April fifteenth 2005 for calendar year 2004 emissions, instead of November fifteenth 2005. Therefore, beginning with reporting year 2005 (not 2004) emissions statements will be required to be submitted by April fifteenth.

    DAPC is unable to provide an accurate estimate of the cost of compliance with the proposed rule. There may actually be some cost savings associated with implementation of this rule, as DAPC proposes making the annual emission statement reporting deadline the same as the annual fee emission reporting requirement deadline, which is April 15th. By streamlining the reporting deadline and requirements, a cost savings may be realized for those facilities that have chosen to have consultants complete the report. An estimate in dollars of the cost of compliance is not possible due to the emission source complexity and prevailing rates for individuals preparing the report, which precludes developing an accurate estimate.
