3770:1-9-457               Game rule number four hundred fifty-seven.

 

 

 

(A)Title and term. Ohio lottery commission game rule number four hundred fifty-seven, "The Three Stooges," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred fifty-seven.

 

(B)General design.

 

(1)Game rule number four hundred fifty-seven is a key number match game with an additional instant win feature and a "tripler" feature and is  generally known as an "instant lottery."

 

(2)Holders of valid tickets will remove the covering off the entire play area to reveal two "Winning Numbers," ten "Your Numbers" and ten corresponding prize values. If any one or more of "Your Numbers" matches one or both of the "Winning Numbers," the player wins the corresponding prize values shown below the matching "Your Numbers." If the player reveals a "WIN" symbol in any of the "Your Numbers" play spots, the player wins the corresponding prize value shown automatically. If the player reveals a "3X" symbol in any of the "Your Numbers" play spots, the player wins three times the corresponding prize value shown automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.

 

(3)As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, three dollars, six dollars, nine dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, three hundred dollars, three thousand dollars and fifteen thousand dollars. Each ticket in game rule number four hundred fifty-seven shall be imprinted in such a way that prize awards from the set listed above may be won.

 

(C)Price of tickets. The price of a ticket issued by the commission in game rule number four hundred fifty-seven shall be two dollars.

 

(D)Structure, nature and value of prize awards.

 

(1)There shall be one type of prize in game rule number four hundred fifty-seven called a "regular prize award."

 

(2)The only "prize values" which shall appear on a ticket in game rule number four hundred fifty-seven are: one dollar, two dollars, three dollars, five dollars, six dollars, nine dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, three hundred dollars, one thousand dollars, three thousand dollars, five thousand dollars and fifteen thousand

 

 

dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number four hundred fifty-seven shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.

(a) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "WIN" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "WIN" symbols are revealed for one dollar two times shall win a regular prize award of two dollars;

(b) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for two dollars once shall win a regular prize award of two dollars;

(c) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for one dollar three times shall win a regular prize award of three dollars;

(d)Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers," or a "WIN" symbol is revealed in three of the "Your Numbers" play spots, or any combination of three matched numbers or "WIN" symbols are revealed for one dollar three times shall win a regular prize award of three dollars;

(e) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "WIN" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "WIN" symbols are revealed for one dollar once and two dollars once shall win a regular prize award of three dollars;

(f)Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for three dollars once shall win a regular prize award of three dollars;

(g) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers," or a "WIN" symbol is revealed in three of the "Your Numbers" play spots, or any combination of three matched numbers or "WIN" symbols are revealed for two dollars three times shall win a regular prize award of six dollars;

(h) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by six of "Your Numbers," or a "WIN" symbol

is revealed in six of the "Your Numbers" play spots, or any combination of six matched numbers or "WIN" symbols are revealed for one dollar six times shall win a regular prize award of six dollars;

(i) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for two dollars three times shall win a regular prize award of six dollars;

(j) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" plays spots for six dollars once shall win a regular prize award of six dollars;

(k) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by nine of "Your Numbers," or a "WIN" symbol is revealed in nine of the "Your Numbers" play spots, or any combination of nine matched numbers or "WIN" symbols are revealed for one dollar nine times shall win a regular prize award of nine dollars;

(l) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" plays spots for three dollars three times shall win a regular prize award of nine dollars;

(m) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers," or a "WIN" symbol is revealed in four of the "Your Numbers" play spots, or any combination of four matched numbers or "WIN" symbols are revealed for one dollar three times and six dollars once shall win a regular prize award of nine dollars;

(n) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for nine dollars once shall win a regular prize award of nine dollars;

(o) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for five dollars three times shall win a regular prize award of fifteen dollars;

(p) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "WIN" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "WIN" symbols are revealed for five dollars once and ten dollars once shall win a regular prize award of fifteen dollars;

(q) Holder of a valid winning ticket on which one or both of the "Winning

Numbers" are matched by all ten of "Your Numbers," or a "WIN" symbol is revealed in all ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "WIN" symbols are revealed for one dollar five times and two dollars five times shall win a regular prize award of fifty dollars;

(r) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for fifteen dollars once shall win a regular prize award of fifteen dollars;

(s) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "WIN" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "WIN" symbols are revealed for two dollars once and three dollars once; and on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for five dollars three times shall win a regular prize award of twenty dollars;

(t)Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by all ten of "Your Numbers," or a "WIN" symbol is revealed in all ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "WIN" symbols are revealed for two dollars ten times shall win a regular prize award of twenty dollars;

(u) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars once shall win a regular prize award of twenty dollars;

(v) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for five dollars once; and on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for fifteen dollars three times shall win a regular prize award of fifty dollars;

(w)Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers," or a "WIN" symbol is revealed in five of the "Your Numbers" play spots, or any combination of five matched numbers or "WIN" symbols are revealed for five dollars three times, ten dollars once and twenty-five dollars once shall win a regular prize award of fifty dollars;

(x) Holder of a valid winning ticket on which one or both of the "Winning

Numbers" are matched by all ten of "Your Numbers," or a "WIN" symbol is revealed in all ten of the "Your Numbers" play spots, or any combination of ten matched numbers or "WIN" symbols are revealed for five dollars ten times shall win a regular prize award of fifty dollars;

(y) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars once shall win a regular prize award of fifty dollars;

(z) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers," or a "WIN" symbol is revealed in five of the "Your Numbers" play spots, or any combination of five matched numbers or "WIN" symbols are revealed for five dollars five times; and on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for twenty-five dollars three times shall win a regular prize award of one hundred dollars;

(aa) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers," or a "WIN" symbol is revealed in two of the "Your Numbers" play spots, or any combination of two matched numbers or "WIN" symbols are revealed for fifty dollars two times shall win a regular prize award of one hundred dollars;

(bb) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars once shall win a regular prize award of one hundred dollars;

(cc) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars three times shall win a regular prize award of three hundred dollars;

(dd) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by six of "Your Numbers," or a "WIN" symbol is revealed in six of the "Your Numbers" play spots, or any combination of six matched numbers or "WIN" symbols are revealed for fifty dollars six times shall win a regular prize award of three hundred dollars;

(ee) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for three hundred dollars once shall win a regular prize award of three hundred dollars;

(ff) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for one thousand dollars three

times shall win a regular prize award of three thousand dollars;

(gg) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for three thousand dollars once shall win a regular prize award of three thousand dollars;

(hh) Holder of a valid winning ticket on which a "3X" symbol is revealed in one of the "Your Numbers" play spots for five thousand dollars three times shall win a regular prize award of fifteen thousand dollars; and

(ii) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "WIN" symbol is revealed in one of the "Your Numbers" play spots for fifteen thousand dollars once shall win a regular prize award of fifteen thousand dollars.

(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred fifty-seven will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:

(a) Eight tickets matching numbers or revealing a "WIN" symbol for fifteen thousand dollars once to win fifteen thousand dollars;

(b) Eight tickets revealing the "3X" symbol for five thousand dollars three times to win fifteen thousand dollars;

(c) Twenty-two tickets matching numbers or revealing a "WIN" symbol for three thousand dollars once to win three thousand dollars; and

(d)Twenty-two tickets revealing the "3X" symbol for one thousand dollars three times to win three thousand dollars.

(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

(a) Twenty tickets matching numbers or revealing a "WIN" symbol for three

hundred dollars once to win three hundred dollars;

(b) Twenty tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for fifty dollars six times to win three hundred dollars;

(c) Twenty tickets revealing the "3X" symbol for one hundred dollars three times to win three hundred dollars;

(d)Twenty tickets matching numbers or revealing a "WIN" symbol for one hundred dollars once to win one hundred dollars;

(e) Forty tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for fifty dollars two times to win one hundred dollars;

(f)Forty tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for five dollars five times; and revealing the "3X" symbol for twenty-five dollars three times to win one hundred dollars;

(g) Eighty tickets matching numbers or revealing a "WIN" symbol for fifty dollars once to win fifty dollars;

(h) Eighty tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for five dollars ten times to win fifty dollars;

(i) One hundred tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for five dollars three times, ten dollars once and twenty-five dollars once to win fifty dollars;

(j) Two hundred sixty-two tickets matching numbers or revealing a "WIN" symbol for five dollars once; and revealing the "3X" symbol for fifteen dollars three times to win fifty dollars;

(k) Five hundred tickets matching numbers or revealing a "WIN" symbol for twenty dollars once to win twenty dollars;

(l) Five hundred tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for two dollars ten times to win twenty dollars;

(m) One thousand tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for two dollars once and three dollars once; and revealing the "3X" symbol for five dollars three times to  win twenty dollars;

(n) Five hundred tickets matching numbers or revealing a "WIN" symbol for

fifteen dollars once to win fifteen dollars;

(o) Five hundred tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar five times and two dollars five times to win fifteen dollars;

(p) Five hundred tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for five dollars once and ten dollars once to win fifteen dollars;

(q) Five hundred tickets revealing the "3X" symbol for five dollars three times to win fifteen dollars;

(r) Five hundred tickets matching numbers or revealing a "WIN" symbol for nine dollars once to win nine dollars;

(s) Five hundred tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar three times and six dollars once to win nine dollars;

(t)Five hundred tickets revealing the "3X" symbol for three dollars three times to win nine dollars;

(u) Five hundred tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar nine times to win nine dollars;

(v) Five hundred tickets matching numbers or revealing a "WIN" symbol for six dollars once to win six dollars;

(w)One thousand five hundred tickets revealing the "3X" symbol for two dollars three times to win six dollars;

(x) One thousand tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar six times to win six dollars;

(y) One thousand tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for two dollars three times to win six dollars;

(z) Two thousand tickets matching numbers or revealing a "WIN" symbol for three dollars once to win three dollars;

(aa) Two thousand tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar once and two dollars once to win three dollars;

(bb) Two thousand tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar three times to win three

dollars;

(cc) Four thousand tickets revealing the "3X" symbol for one dollar three times to win three dollars;

(dd) Eight thousand tickets matching numbers or revealing a "WIN" symbol for two dollars once to win two dollars; and

(ee) Fourteen thousand tickets matching numbers, or revealing "WIN" symbols, or any combination thereof, for one dollar two times to win two dollars.

(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

(G)Frequency of prize drawings.

(1) Random imprinting of prize awards on all tickets issued in game rule number four hundred fifty-seven shall be accomplished in a manner, which complies with the commission's rules and procedures.

(2) When a ticket issued in game rule number four hundred fifty-seven is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred fifty-seven in which the ticket was sold.

(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

(I)Validity of tickets.

(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred fifty-seven void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

(J) Director's conduct of game rule number four hundred fifty-seven.

(1) The director shall conduct game rule number four hundred fifty-seven in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred fifty-seven. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

(2) Names and definitions of elements of game rule number four hundred fifty-seven used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred fifty-seven and these elements may be given names or titles chosen by the commission.
