    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to section 5104.011 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon.

     

    Rule 5101:2-12-21 entitled Care and Nurturing of Children in Licensed Child Care Centers is being amended as a result of the Five Year Review. The changes to this rule include amendments to remove the website references for foods that are choking hazards and to instead provide this information in the new appendix.

     

    Rule 5101:2-12-22 entitled Child Guidance and Management in Licensed Child Care Centers is being amended as a result of the Five Year Review.  The changes to this rule include amendments to clarify that guidance and management measures should be taken at the time of the incident when the child can understand the correlation between the behavior and the consequence.

     

    Rule 5101:2-12-23 entitled Evening and Overnight Care in Licensed Child Care Centers is being amended as a result of the Five Year Review. The changes to this rule include language to clarify that the center must provide hygiene supplies if the parent does not supply them for the child.

     

    Rule 5101:2-12-27 entitled Training in First Aid, CPR, Management of Communicable Disease and Child Abuse Prevention in Licensed Child Care Centers is being amended as a result of the Five Year Review.  The changes to this rule include amendments to remove the requirement that the same staff person have both first aid and communicable disease training, as the classes are no longer presented in this manner. The rule has also been amended to allow ODJFS to approve certain types of online training in these subjects. This is being done so the department can assess whether the newly available online training is appropriate in these four subjects for child care staff members.

     

    Rule 5101:2-12-28 entitled In-Service Training for Licensed Child Care Centers is being amended as a result of the Five Year Review. The changes to this rule include amendments to update terms in regards to electronic training and to allow ODJFS to approve certain types of online training in first aid, CPR, communicable disease and child abuse. This is being done so the department can assess whether the newly available online training is appropriate in these four subjects for child care staff members.

     

     

     

     

     

     

     

    Rule 5101:2-12-34 entitled Medical, Dental, and General Emergency Plans for Licensed Child Care Centers is being amended as a result of the Five Year Review.  The changes to this rule include amendments to update the revision date of the JFS 01242 and JFS 01201. The rule has also been amended to require that child care centers conduct monthly weather emergency drills March through September and to post a record of the drills. The appendix to this rule is also being rescinded.

    Rule 5101:2-12-35 entitled Incident/Injury Report for Licensed Child Care Centers is being amended as a result of the Five Year Review. The changes to this rule include amendments to allow the reports to be submitted electronically and to clarify that submitting the form does not replace the need for verbal contact with the licensing specialist if there is a death of a child or a "serious incident" as defined in the rule.

    Rule 5101:2-12-36 entitled First Aid Supplies/Procedures for Licensed Child Care Centers is being amended as a result of the Five Year Review.  The changes to this rule include amendments to require the first aid kit to contain non-latex gloves instead of vinyl gloves, and to remove the requirement that the center have a system in place for regularly checking the contents of the first aid kit to assure that it is complete.

    Rule 5101:2-12-37 entitled Children's Medical and Enrollment Records for Licensed Child Care Centers is being amended as a result of the Five Year Review. The changes to this rule include amendments to add certified nurse practitioners to the list of health care providers permitted to sign off on children's medicals.

    Rule 5101:2-12-38 entitled Care of Children with Health Conditions in Licensed Child Care Centers is being amended as a result of the Five Year Review.  The changes to this rule include amendments to revise and simplify the definition of children who require a Medical/Physical Care Plan, to clarify that the written plan must be accessible to the staff person caring for the child, to clarify a staff person trained to respond to the child's needs must be present any time the child is in attendance, including on field trips and to expand the types of emergency medication that a school-age child may carry on their person. The requirements for the written Medical/Physical Care Plan have been amended to:

    1)  include the symptoms of any conditions that the staff person needs to be alert to,

    2)  include any special assistance or supplies needed in case of an emergency evacuation and

    3)  remove the need for the parents to list additional services being provided and permission for the child care staff to contact them.

A public hearing on the proposed rule(s) will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
