NOTICE OF INTENTION TO AMEND AND HOLD A PUBLIC HEARING ON STATE OF OHIO WATERCRAFT RULES

 

 

The Chief of the Division of Watercraft, pursuant to Section 1547.52 of the Ohio Revised Code, hereby gives notice of his intention to amend the following rule:

 

1501:47-3-37  Unlimited horsepower at no-wake speed and to rescind the following rule:

1501:47-3-97  No wake operation on the waters of Jackson lake - pilot program

 

Administrative Rule 1501:47-3-37 is being amended to add Jackson Lake State Park to the list of water areas that allow watercraft powered by more than ten horsepower to operate at no-wake speed.  Administrative Rule 1501:47-3-97 is being rescinded because it was a temporary rule that allowed powercraft propelled by motors with more than ten horsepower to operate at no-wake speed on the waters of Jackson Lake State Park, which is set to revert to the prior ten horsepower limit on November 1st of this year. The amendment of 1501:47-3-37 will incorporate and make permanent the provisions of 1501:47-3-97.

 

A public hearing on the proposed amendment and adoption of these rules will be held at 7:00 pm on Tuesday, September 20th at the Oak Hill FD Hall located at 169 E Main St. in Oak Hill, Ohio.  At the public hearing, any person affected by the rule amendment or adoption may appear and be heard in person, or by an attorney, or both, and may present testimony, orally or in writing, and present evidence tending to show that these rules, if amended or adopted, will be unreasonable or unlawful.
