Notice of Public Hearing
Ohio Chemical Dependency Professionals Board
Pursuant to Section 119.03 of the Ohio Revised Code, notice is herby given that the Ohio Chemical Dependency Professionals (OCDP) Board intends to conduct a public hearing.
As a result of changes identified during the Board's five year review, nineteen rules described below are being proposed as revised rules and two are proposed to be rescinded.
The proposed revised rules are:
Revised: OAC 4758-1-02 Notice of board meetings
The revision to OAC 4758-1-02 is with regard to notification of Board meetings. In paragraph (C) the phrase "of counselors or social workers" is being struck to ensure this provision applies to a broader range of professional organizations.
Revised: OAC 4758-2-01 Definitions, abbreviations and titles
The revisions to OAC 4758-2-01 include the following adjustments to paragraph (D):
· Nursing is added to the definition of "behavioral science degree" as used by the Board.
· The reference to 40 quarter hours is being converted to the equivalent semester hours of 27.
· Philosophy and political science are being struck from the definition of "behavioral science degree" as used by the Board.
Other adjustments are as follows:
· The definitions of "CCDC I" and "CPM" are removed because they represent functions no longer provided by the Board
· The term "ICRC/AODA" is changed to "IC&RC" in order to reflect current IC&RC practice

Revised: OAC 4758-3-01 Fees
Revisions to OAC 4758-3-01 are as follows:
· The Board is establishing new renewal fees for individuals who submit renewal applications less than thirty days prior to the license or certification lapse date as required by 4758-13-01(B) and 4758-13-02(B) of the Administrative Code. The new fees will be $175.00 for a standard renewal,
$80.00 for a Senior Citizen Renewal and $125.00 if the individual holds both a Prevention and Chemical Dependency Counselor credential. The intent is to encourage individuals to submit their renewal applications thirty days or more before their lapse date.
· The Board is establishing new fees related to the IC&RC computer based tests (CBT). Each CBT exam offered by the Board will cost $150.00.
· The exam names have been changed to mirror changes adopted by IC&RC.
Revised: OAC 4758-5-01 Requirements for certification of chemical dependency counselor assistants (CDCA)
Revisions to 4758-5-01 are as follows:
· The Board is proposing to remove the requirement that an applicant be currently employed or volunteering in a chemical dependency counseling position. Removal of this provision necessitates the removal of the requirement to obtain supervisor verification.
· The Board is proposing that the current 40 hours of chemical dependency training/education be taken in specific content areas. The intent is to enhance and strengthen the chemical dependency knowledge of new entry level professionals by ensuring education and training is aligned with a CDCA's scope of practice. Specific content areas and contact hours are:
o Addiction knowledge (5 hours) o Treatment knowledge (9 hours) o Professionalism (6 hours)
o Evaluation (3 hours)
o Service coordination (4 hours)
o Documentation (3 hours)
o Counseling
▪ Individual (5 hours)
▪ Group (5 hours)
The Board will work to mitigate potential challenges individuals may have in meeting the revised training requirement by delaying the effective date of this
proposed rule by six months and by working closely with training and education providers to ensure sufficient courses and hours are available.
Revised: OAC 4758-5-03 Requirements for licensure of chemical dependency counselor II (LCDC II)
Revisions to OAC 4758-5-03 are as follows:
· The terms used to describe the required content areas of the two hundred and seventy hours are being adjusted to align with IC&RC Alcohol and Drug Counselor (ADC) domains.
· The name of the written exam is changed to the IC&RC Alcohol and Drug Counselor (ADC) written exam and the IC&RC computer based exam (CBT) is added as an exam option.
Revised: OAC 4758-5-04 Requirements for licensure of chemical dependency counselors III (LCDC III)
Revisions to OAC 4758-5-04 are as follows:
· The terms used to describe the required content areas of the two hundred and seventy hours are being adjusted to align with IC&RC Alcohol and Drug Counselor (ADC) domains.
· The name of the written exam is changed to the IC&RC Alcohol and Drug Counselor (ADC) written exam and the IC&RC computer based exam (CBT) is added as an exam option.
Revised: OAC 4758-5-05 Requirements for licensure of independent chemical dependency counselors (LICDC)
Revisions to OAC 4758-5-04 are as follows:
· The terms used to describe the required content areas of the two hundred and seventy hours are being adjusted to align with IC&RC Alcohol and Drug Counselor (ADC) Clinical Supervisor domains.
· The names of the written exams are changed to the IC&RC Alcohol and Drug Counselor (ADC) written exam and the IC&RC Clinical Supervisor (CS) exam. The ADC and CS computer based exams (CBT) are added as exam options.
Revised: OAC 4758-5-08 Requirements for certification of Ohio prevention specialists I (OCPS I)
The name of the written exam is changed in OAC 4758-5-08 to the IC&RC Prevention Specialist (PS) written exam in order to reflect current IC&RC practice. The IC&RC computer based exam (CBT) is added as an exam option.
Revised: OAC 4758-5-09 Requirements for certification of Ohio prevention specialists II (OCPS II)
The revisions to OAC 4758-5-09 are as follows:
· The name of the performance domain in paragraph (C)(5) is changed to "Professional growth and responsibility" in order to reflect the correct IC&RC performance domain name.
· The name of the written exam is changed to the IC&RC Prevention Specialist (PS) written exam and the IC&RC computer based exam (CBT) is added as an exam option.
Revised: OAC 4758-6-01 Scope of practice for chemical dependency counselor assistants (CDCA)
The revisions to OAC 4758-6-01 are as follows:
· A typographical error in the chapter reference related to registered nurses located in paragraph (B)(4) is corrected.
· Reference to a professional clinical counselor or independent social worker are removed from paragraph (B)(4) and reference to those two types of professionals is established in a separate paragraph, (B)(5), in order to make it easier for readers of the rule to locate this provision.
· The scope of practice for CDCAs is further clarified by reference to the Ohio Department of Alcohol and Drug Addiction Services (ODADAS) Treatment Program Certification Standards; specifically paragraph (K) of rule 3793:2-1- 05 and paragraph (KK) of rule 3793:2-1-08.
Revised: OAC 4758-6-04 Scope of practice for licensed chemical dependency counselors III (LCDC III)
Revisions to OAC 4758-6-04 are as follows:
· Reference to a professional clinical counselor or independent social worker are removed from paragraph (B)(4) and reference to those two types of professionals is established in a separate paragraph, (B)(5), in order to make it easier for readers of the rule to locate this provision.
· The scope of practice and supervisory authority for LCDC IIIs is further clarified by reference to the Ohio Department of Alcohol and Drug Addiction Services (ODADAS) Treatment Program Certification Standards; specifically paragraph (K) of rule 3793:2-1-05 and paragraph (OO) of rule 3793:2-1-08.
Revised: OAC 4758-6-05 Scope of practice for licensed independent chemical dependency counselors (LICDC)
The revision to OAC 4758-6-05 further clarifies the scope of practice and supervisory authority of LICDCs by reference to the Ohio Department of Alcohol and Drug Addiction Services (ODADAS) Treatment Program Certification Standards; specifically paragraph (PP) of rule 3793:2-1-08.
Revised: OAC 4758-10-01 Disciplinary action against licensees, certificate holders, or applicants
The revision to OAC 4758-10-01 removes the term CCDC I from the proposed rule because the credential level is no longer issued by the Board.
Revised: OAC 4758-13-02 Continuing education requirements for RA, OCPS I and OCPS II
The revision to OAC 4758-13-02 changes paragraph (C) regarding the Board's requirement to provide renewal applications prior to a prevention certificate holder's lapse date. This change reflects current Board practice of providing a renewal reminder ninety days prior to the lapse date.
Revised: OAC 4758-13-03 Special circumstances for the renewal of a license or certificate
The revision to OAC 4758-13-03 strikes the term CCDC I because the credential is no longer issued by the Board. Additionally, the word "that" in paragraph (B)(5) is replaced with the word "the" in order to eliminate awkward phrasing.
Revised: OAC 4758-13-04 Definitions of recognized clock hours
OAC 4758-13-04 is being revised so that the terms used to describe the knowledge and skill areas in paragraph (C)(2), Prevention areas, and paragraph (C)(3), Supervisor areas, are aligned with IC&RC recognized domains.
Revised: OAC 4758-13-07 Approval of recognized clock hours
OAC 4758-13-07 is being revised to add a provision to paragraph (B) that requires providers to maintain participant attendance records for five (5) years.
Revised: OAC 4758-14-01 Master's Accreditation
Paragraphs (C) and (C)(1) of OAC 4758-14-01 are being revised by changing the word "will" to the word "may" in order to provide the Board flexibility in determining the necessity of conducting a site visit to the applying educational institution.
Revised: OAC 4758-15-01 Reciprocity
In OAC 4758-15-01 the name and acronym of the International Certification & Reciprocity Consortium (IC&RC) is being changed in order to reflect current IC&RC practice.
The proposed rescinded rules are:
Rescind: OAC 4758-5-02 Requirements for certification of chemical dependency counselors I (CCDC I)
OAC 4758-5-02 is being rescinded because it refers to a credential level that is no longer authorized for use in the State of Ohio. Authorization to use this credential ended June 2007.
Rescind: OAC 4758-6-02 Scope of practice for certified chemical dependency counselors I (CCDC I)
OAC 4758-6-02 is being rescinded because it refers to a credential level that is no longer authorized for use in the State of Ohio. Authorization to use this credential ended June 2007.
