    NOTICE OF PUBLIC HEARING

     

     

    Pursuant to Chapter 119. of the Revised Code, the Ohio Department of Developmental Disabilities hereby gives notice of its intent to amend rule 5123:2-9-42 of the Administrative Code and to rescind rule 5123:2-12-01 of the Administrative Code on a permanent basis on or about November 1, 2012, and to conduct a public hearing thereon.

     

    Rule 5123:2-9-42 entitled "Home and Community-Based Services Waivers - Community Inclusion Under the Self-Empowered Life Funding Waiver" defines Community Inclusion and sets forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service.

    The rule is being amended to correct a typographical error in the appendix. The service code for Community Inclusion-Personal Assistance by an independent provider is being revised from "SPA" to "SPN." The service code for Community Inclusion-Personal Assistance by an agency provider is being revised from "SPN" to "SPA."  No changes are being made to the body of the rule.

     

    Rule 5123:2-12-01 entitled "Supported Living Quality Assurance" is proposed for rescission. The rule establishes a process to ensure that individuals receiving supported living services are empowered to exercise choice and enhance the quality of their lives.  The rule has been replaced with other initiatives including:

    ·         Establishing clear expectations for county boards of developmental disabilities and providers of services to support advocacy and self-advocacy;

    ·         Redesigning county board accreditation and provider compliance review processes to support advocacy efforts and self-advocacy, to add questions related to hallmarks of good service as identified by self-advocates, and to include self- advocates to further refine the survey process;

    ·         Clarifying and reinforcing the expectations of service and support administration for continuous monitoring;

    ·         Encouraging county boards to redeploy existing resources in the current quality assurance work to provider development, provider compliance, service and support administration monitoring, and support for the Transitions Developmental Disabilities Waiver; and

    ·         Encouraging other voluntary efforts of providers, county boards, and advocates to evaluate outcomes and recognize, reward, and publicize accomplishments.

    A public hearing on the proposed rule actions will be held on September 18, 2012, beginning at 10:00 a.m., and continuing until all persons in attendance have had an opportunity to testify.  The hearing will be held in the Lobby Hearing Room of the Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio 43215.  At this hearing, the Department will accept verbal and/or written testimony on the proposed rule actions under consideration.

    Persons unable to attend the public hearing may submit written comments on the proposed rule actions.
