    3770:1-9-577               Game rule number five hundred seventy-seven.

     

     

     

    (A)Title and term. Ohio lottery commission game rule number five hundred seventy-seven, "Deal or No Deal™," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number five hundred seventy-seven.

     

    (B)General design.

     

    (1)Game rule number five hundred seventy-seven is a matching symbols game, and is generally known as an "instant lottery."

     

    (2)Holders of valid tickets will remove the covering off the eighteen briefcases numbered "1" through "18" in the "Briefcases" main play area. The player must scratch each "Briefcase" to reveal either a prize symbol or a "NO DEAL" play symbol. The player then scratches the corresponding prize symbol or "NO DEAL" play symbol on the "Prize Table" to eliminate that prize symbol or "NO DEAL" play symbol from the "Prize Table." The number of "NO DEAL" play symbols eliminated on the "Prize Table" must correspond to the number of "NO DEAL" play symbols revealed in the "Briefcases." To win a prize award, the remaining unmatched symbol on the "Prize Table" must be a prize symbol. There is no prize award associated with an unmatched "NO DEAL" play symbol remaining on the "Prize Table." If the remaining unmatched prize symbol on the "Prize Table" is a "$1,000+TPD" symbol, the player wins one thousand dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") to win one hundred thousand dollars. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director.

     

    (3)As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, ten dollars, fifteen dollars, twenty dollars, thirty dollars, fifty dollars, seventy-five dollars, one hundred dollars, two hundred dollars, three hundred dollars, five hundred dollars, one thousand dollars and ten thousand dollars. Each ticket in game rule number five hundred seventy-seven shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)Price of tickets. The price of a ticket issued by the commission in game rule number five hundred seventy-seven shall be five dollars.

     

     

     

     

    (D)Structure, nature and value of prize awards.

    (1) There  shall  be  two  types  of  prizes  in  game  rule  number  five  hundred seventy-seven, a "regular prize award" and a "TPD" prize award.

    (2) The only "prize values" which shall appear on a ticket in game rule number five hundred seventy-seven are: five dollars, ten dollars, fifteen dollars, twenty dollars, thirty dollars, fifty dollars, seventy-five dollars, one hundred dollars, two hundred dollars, three hundred dollars, five hundred dollars, the "TPD" symbol corresponding to a prize value of one thousand dollars, ten thousand dollars and one hundred thousand dollars. Play symbols and prize symbols appearing on any ticket in game rule number five hundred seventy-seven shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying play symbols and prize symbols.

    (a) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is five dollars shall win a regular prize award of five dollars;

    (b) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is ten dollars shall win a regular prize award of ten dollars;

    (c) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is fifteen dollars shall win a regular prize award of fifteen dollars;

    (d)Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is twenty dollars shall win a regular prize award of twenty dollars;

    (e) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is thirty dollars shall win a regular prize award of thirty dollars;

    (f)Holder of a valid winning ticket on which the remaining  unmatched symbol on the "Prize Table" is fifty dollars shall win a regular prize award of fifty dollars;

    (g) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is seventy-five dollars shall win a regular prize award of seventy-five dollars;

    (h) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is one hundred dollars shall win a regular prize award of one hundred dollars;

    (i) Holder of a valid winning ticket on which the remaining  unmatched symbol on the "Prize Table" is two hundred dollars shall win a regular prize award of two hundred dollars;

    (j) Holder of a valid winning ticket on which the remaining  unmatched symbol on the "Prize Table" is three hundred dollars shall win a regular prize award of three hundred dollars;

    (k) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is five hundred dollars shall win a regular prize award of five hundred dollars;

    (l) Holder of a valid winning ticket on which the remaining  unmatched symbol on the "Prize Table" is the "$1,000+TPD" symbol for one thousand dollars shall win a regular prize award of one thousand dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win one hundred thousand dollars;

    (m) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is ten thousand dollars shall win a regular prize award of ten thousand dollars; and

    (n) Holder of a valid winning ticket on which the remaining unmatched symbol on the "Prize Table" is one hundred thousand dollars shall win a regular prize award of one hundred thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number five hundred seventy-seven will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per seven million six hundred thousand tickets sold in the following prize categories should be as follows

    (a) Five tickets winning one hundred thousand dollars to win one hundred thousand dollars; and

    (b) Ten tickets winning ten thousand dollars to win ten thousand dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a) One ticket winning a "$1,000+TPD" symbol to win one thousand dollars, and, upon the filing of a valid claim at an Ohio lottery commission office, automatic entry into the Top Prize Drawing to win one hundred thousand dollars;

    (b) Twenty-five tickets winning five hundred dollars to win five hundred dollars;

    (c) Forty tickets winning three hundred dollars to win three hundred dollars;

    (d)One  hundred  eight  tickets  winning  two  hundred  dollars  to  win  two hundred dollars;

    (e) Two hundred ticket winning one hundred dollars to win one hundred dollars;

    (f)Three hundred tickets winning seventy-five dollars to win seventy-five dollars;

    (g) One  thousand  five  hundred  tickets  winning  fifty  dollars  to  win  fifty dollars;

    (h) Three thousand five hundred tickets winning thirty dollars to win thirty dollars;

    (i) Four thousand tickets winning twenty dollars to win twenty dollars;

    (j) Four thousand tickets winning fifteen dollars to win fifteen dollars;

    (k) Twelve thousand tickets winning ten dollars to win ten dollars; and

    (l) Twenty thousand tickets winning five dollars to win five dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number five hundred seventy-seven shall be accomplished in a manner, which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number five hundred seventy-seven is sold or deemed sold in accordance with this rule and the covering material over any of the play symbols and prize symbols has been removed, the holder shall be deemed to have drawn the play symbols and prize symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number five hundred seventy-seven in which the ticket was sold.

    (3) The Top Prize Drawing to award one grand prize of one hundred thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing "Prize drawings" and rule 3770:1-6-01 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules, as well as procedures for entry into the Top Prize Drawings described in Section (G)(3) of this Rule. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number five hundred seventy-seven void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the

    director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number five hundred seventy-seven.

    (1) The director shall conduct game rule number five hundred seventy-seven in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number five hundred seventy-seven. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number five hundred seventy-seven used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number five hundred seventy-seven and these elements may be given names or titles chosen by the commission.
