    3770:1-9-585               Game rule number five hundred eighty-five.

     

     

     

    (A)Title and term. Ohio lottery commission game rule number five hundred eighty-five, "Holiday Surprise," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number five hundred eighty-five.

     

    (B)General design.

     

    (1)Game rule number five hundred eighty-five is an extended play game, and is generally known as an "instant lottery."

     

    (2)Holders of valid tickets will remove the covering off the "Your Lucky Spots" area to reveal twelve alpha-numeric play symbols. Each alpha-numeric play symbol corresponds to a grid location on the "Gift Grid." The player then scratches the spaces on the "Gift Grid" that correspond to the alpha-numeric play symbols revealed in the "Your Lucky Spots" area. If the player reveals three like play symbols in the "Gift Grid" that correspond to the alpha-numeric play symbols revealed in the "Your Lucky Spots" area, the player wins the prize value that corresponds to the matched play symbols in the prize "Legend." If the player reveals a "Snowflake" symbol in the "Gift Grid" that corresponds to the alpha-numeric play symbol revealed in the "Your Lucky Spots" area, the player wins five dollars automatically.

     

    (3)As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: four dollars, five dollars, six dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars and ten thousand dollars. Each ticket in game rule number five hundred eighty-five shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)Price of tickets. The price of a ticket issued by the commission in game rule number five hundred eighty-five shall be two dollars.

     

    (D)Structure, nature and value of prize awards.

     

    (1)There shall be one type of prize in game rule number five hundred eighty-five called a "regular prize award."

     

    (2)The only "prize values" which shall appear on a ticket in game rule number five hundred eighty-five are: four dollars, five dollars, six dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars and ten thousand dollars. Play symbols appearing on any ticket in game rule number five hundred eighty-five shall be concealed by an opaque

     

     

    covering which may be scratched off by the holder of the ticket to reveal the underlying play symbols.

    (a) Holder of a valid winning ticket on which three "Ornament" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for four dollars shall win a regular prize award of four dollars;

    (b) Holder of a valid winning ticket on which one "Snowflake" play symbol is completely revealed in the "Gift Grid" space that corresponds to the symbol revealed in the "Your Lucky Spots" area for five dollars once shall win a regular prize award of five dollars;

    (c) Holder of a valid winning ticket on which three "Candy Cane" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for six dollars shall win a regular prize award of six dollars;

    (d)Holder of a valid winning ticket on which three "Ornament" play symbols and three "Candy Cane" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for four dollars and six dollars, respectively, shall win a regular prize award of ten dollars;

    (e) Holder of a valid winning ticket on which three "Gingerbread Man" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for ten dollars shall win a regular prize award of ten dollars;

    (f)Holder of a valid winning ticket on which two "Snowflake" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars two times shall win a regular prize award of ten dollars;

    (g) Holder of a valid winning ticket on which one "Snowflake" play symbol and three "Gingerbread Man" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars once and ten dollars, respectively, shall win a regular prize award of fifteen dollars;

    (h) Holder of a valid winning ticket on which three "Ornament" play symbols, one "Snowflake" play symbol and three "Candy Cane" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for four dollars, five dollars once and six dollars, respectively, shall win a regular prize award of fifteen dollars;

    (i) Holder of a valid winning ticket on which three "Snowflake" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars three times shall win a regular prize award of fifteen dollars;

    (j) Holder of a valid winning ticket on which three "Snowman" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for fifteen dollars shall win a regular prize award of fifteen dollars;

    (k) Holder of a valid winning ticket on which two "Snowflake" play symbols and three "Gingerbread Man" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars two times and ten dollars, respectively, shall win a regular prize award of twenty dollars;

    (l) Holder of a valid winning ticket on which three "Ornament" play symbols, three "Candy Cane" play symbols and three "Gingerbread Man" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for four dollars, six dollars and ten dollars, respectively, shall win a regular prize award of twenty dollars;

    (m) Holder of a valid winning ticket on which four "Snowflake" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars four times shall win a regular prize award of twenty dollars;

    (n) Holder of a valid winning ticket on which three "Hat" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for twenty dollars shall win a regular prize award of twenty dollars;

    (o) Holder of a valid winning ticket on which three "Ornament" play symbols, four "Snowflake" play symbols, three "Candy Cane" play symbols and three "Hat" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for four dollars, five dollars four times, six dollars and twenty dollars, respectively, shall win a regular prize award of fifty dollars;

    (p) Holder of a valid winning ticket on which one "Snowflake" play symbol, three "Gingerbread Man" play symbols, three "Snowman" play symbols and three "Hat" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars once, ten dollars, fifteen dollars and twenty

    dollars, respectively, shall win a regular prize award of fifty dollars;

    (q) Holder of a valid winning ticket on which three "Scarf" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for fifty dollars shall win a regular prize award of fifty dollars;

    (r) Holder of a valid winning ticket on which one "Snowflake" play symbol, three "Gingerbread Man" play symbols, three "Snowman" play symbols, three "Hat" play symbols and three "Scarf" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five dollars once, ten dollars, fifteen dollars, twenty dollars and fifty dollars, respectively, shall win a regular prize award of one hundred dollars;

    (s) Holder of a valid winning ticket on which three "Holly" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for one hundred dollars shall win a regular prize award of one hundred dollars;

    (t)Holder of a valid winning ticket on which three "Stocking" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for five hundred dollars shall win a regular prize award of five hundred dollars; and

    (u) Holder of a valid winning ticket on which three "Tree" play symbols are completely revealed in the "Gift Grid" spaces that correspond to the symbols revealed in the "Your Lucky Spots" area for ten thousand dollars shall win a regular prize award of ten thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number five hundred eighty-five will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per eight million tickets sold in the following prize categories should be as follows

    (a) Forty tickets winning ten thousand dollars to win ten thousand dollars; and

    (b) Forty tickets winning five hundred dollars to win five hundred dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a) Forty tickets winning one hundred dollars to win one hundred dollars;

    (b) Forty tickets winning five dollars once, ten dollars, fifteen dollars, twenty dollars and fifty dollars to win one hundred dollars;

    (c) Fifty tickets winning fifty dollars to win fifty dollars;

    (d)Fifty tickets winning five dollars once, ten dollars, fifteen dollars and twenty dollars to win fifty dollars;

    (e) Fifty tickets winning four dollars, five dollars four times, six dollars and twenty dollars to win fifty dollars;

    (f)Five hundred tickets winning twenty dollars to win twenty dollars;

    (g) Five hundred tickets winning five dollars four times to win twenty dollars;

    (h) Five hundred tickets winning four dollars, six dollars and ten dollars to win twenty dollars;

    (i) Five hundred tickets winning five dollars two times and ten dollars to win twenty dollars;

    (j) Five hundred tickets winning fifteen dollars to win fifteen dollars;

    (k) Five  hundred  tickets  winning  five  dollars  three  times  to  win  fifteen dollars;

    (l) Five hundred tickets winning four dollars, five dollars once and six dollars to win fifteen dollars;

    (m) Five hundred tickets winning five dollars once and ten dollars to win fifteen dollars;

    (n) One thousand tickets winning five dollars two times to win ten dollars;

    (o) One thousand tickets winning ten dollars to win ten dollars;

    (p) One thousand tickets winning four dollars and six dollars to win ten dollars;

    (q) Two thousand tickets winning six dollars to win six dollars;

    (r) Ten thousand tickets winning five dollars once to win five dollars; and

    (s) Twenty-four thousand tickets winning four dollars to win four dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number five hundred eighty-five shall be accomplished in a manner, which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number five hundred eighty-five is sold or deemed sold in accordance with this rule and the covering material over any of the play symbols and prize symbols has been removed, the holder shall be deemed to have drawn the play symbols and prize symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number five hundred eighty-five in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number five hundred eighty-five void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission

    rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number five hundred eighty-five.

    (1) The director shall conduct game rule number five hundred eighty-five in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number five hundred eighty-five. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number five hundred eighty-five used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number five hundred eighty-five and these elements may be given names or titles chosen by the commission.
