    NOTICE OF PUBLIC HEARING

     

     

     

    Pursuant to Chapter 119. of the Revised Code and 42 CFR 447.205, the Ohio Department of Developmental Disabilities (DODD) hereby gives notice of its intent to rescind the following rules under Chapters 5123:2-8 and 5123:2-13 of the Administrative Code and adopt the following rules under Chapter 5123:2-9 of the Administrative Code on a permanent basis on or about November 10, 2011, and to conduct a public hearing thereon. DODD is bringing forth new rules so that the rules are renumbered to Chapter 5123:2-9; it is DODD's intent that eventually all DODD rules related to Home and Community-Based Services waivers shall reside in Chapter 5123:2-9 of the Administrative Code.

     

     

    Rule 5123:2-8-03 entitled "Level One Waiver - Informal Respite" is proposed for rescission and replacement by new rule 5123:2-9-21 (described below).  The purpose of the rule is to define Informal Respite and set forth certification standards for providers of the service.

     

    Rule 5123:2-8-04 entitled "Level One Waiver - Institutional Respite" is proposed for rescission and replacement by new rule 5123:2-9-22 (described below).  The purpose of the rule is to define Institutional Respite and set forth certification standards for providers of the service.

     

    Rule 5123:2-8-06 entitled "Level One Waiver - Environmental Accessibility Adaptations" is proposed for rescission and replacement by new rule 5123:2-9-23 (described below).  The purpose of the rule is to define Environmental Accessibility Adaptations and set forth certification standards for providers of the service.

    Rule 5123:2-8-07 entitled "Level One Waiver - Transportation" is proposed for rescission and replacement by new rule 5123:2-9-24 (described below). The purpose of the rule is to define Transportation and set forth certification standards for providers of the service.

    Rule 5123:2-8-08 entitled "Level One Waiver - Specialized Medical Equipment and Supplies" is proposed for rescission and replacement by new rule 5123:2-9-25 (described below).  The purpose of the rule is to define Specialized Medical Equipment and Supplies and set forth certification standards for providers of the service.

    Rule 5123:2-8-09 entitled "Level One Waiver - Personal Emergency Response Systems" is proposed for rescission and replacement by new rule 5123:2-9-26 (described below).  The purpose of the rule is to define Personal Emergency Response Systems and set forth certification standards for providers of the service.

    Rule 5123:2-8-11 entitled "Level One Waiver - Emergency Assistance" is proposed for rescission and replacement by new rule 5123:2-9-27 (described below).  The purpose of the rule is to set forth coverage and eligibility for Emergency Assistance.

    Rule 5123:2-13-05 entitled "Individual Options Waiver - Transportation Mileage" is proposed for rescission and replacement by new rule 5123:2-9-24 (described below).  The purpose of the rule is to define Transportation Mileage and set forth certification standards for providers of the service.

    Rule 5123:2-9-21 entitled "Home and Community-Based Services Waivers - Informal Respite Under the Level One Waiver" is a new rule proposed to replace rule 5123:2-8-03.  The purpose of the rule is to define Informal Respite and set forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service.

    Waivers - Institutional Respite Under the Level One Waiver" is a new rule proposed to replace rule 5123:2-8-04.  The purpose of the rule is to define Institutional Respite and set forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service.

    Rule 5123:2-9-23 entitled "Home and Community-Based Services Waivers - Environmental Accessibility Adaptations Under the Individual Options and Level One Waivers" is a new rule proposed to replace rule 5123:2-8-06.  (DODD has not had a rule for this existing service under the Individual Options Waiver.)  The purpose of the rule is to define Environmental Accessibility Adaptations and set forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service.

    09. The purpose of the rule is to define Personal Emergency Response Systems and set forth provider qualifications, requirements for service delivery and documentation of services, and payment standards for the service.

    Waivers - Emergency Assistance Under the Level One Waiver" is a new rule proposed to replace rule 5123:2-8-11. The purpose of the rule is to set forth coverage and eligibility for Emergency Assistance.

    A public hearing on the proposed rule actions will be held on September 30, 2011, beginning at 10:00 a.m., and continuing until all persons in attendance have had an opportunity to testify.  The hearing will be held in the Lobby Hearing Room of the Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio 43215. At this hearing, DODD will accept verbal and/or written testimony on the proposed rule actions under consideration.

    Persons unable to attend the public hearing may submit written comments on the proposed rule actions.  Any written comments received on or before the public hearing date will be treated as testimony and made available for public review.  Submittal of written comments may be made to Becky Phillips, Administrative Rules Coordinator, by e-mail to  becky.phillips@dodd.ohio.gov; by fax to 614/644-5013; or by U.S. mail to 30 East Broad Street, 12th Floor, Columbus, Ohio 43215-3414.
