    Public Notice: Proposed Rulemaking Governing the Underground Injection Control Rules, Minor Amendments.

     

    Notice is hereby given that the Ohio Environmental Protection Agency, Division of Drinking and Ground Waters (DDAGW) proposed minor revisions to rules in Chapter 3745-34 of the Ohio Administrative Code (OAC). The proposed amendments are, in part, a result of the five-year rule review requirements of Section 106.03 of the Revised Code.

     

    OAC rules 3745-34-01, 3745-34-04, 3745-34-08, 3745-34-12, 3745-34-23, 3745-34-34 and

                                            are included in this package. The draft minor amendments include the following:

             Removed nonessential references and rule language.

             Revised Class II and Class III well language to be consistent with the governing Agency (Ohio Dept. of Natural Resources).

             Updated rule references.

             Revised permit fees.

             Added language to be consistent with the federal counterparts.

             Added language to reflect state statute.

             Clarified that wells with mechanical integrity are authorized to inject waste and hazardous wells must follow operating requirements in OAC rule 3745-34-56.

             Added language to point to performance standards.

             Added language requiring an owner/operator to follow the approved plan and allow for deviations from the approved plan during field work.

     

    A public hearing pursuant to §106.03 of the Ohio Revised Code will be conducted on Sept. 28, 2016, beginning at 10:30 a.m. in Conference Room A at the Ohio EPA, Lazarus Government Center, 50 West Town Street, Columbus, Ohio. All interested persons are entitled to attend or be represented and give their written or oral comments on this proposed rule-making. A presiding officer will be present until all interested persons have been heard.

     

    To facilitate scheduling of oral presentations, persons intending to give testimony at the hearing should ensure that Ohio EPA receives notice of such intent by Sept. 27, 2016, 5:00 p.m. Persons who provide Ohio EPA with prior notice will be heard ahead of persons who register at the hearing. All visitors to Ohio EPA must register at the Security desk in the lobby upon arrival. Please bring photo identification (such as a valid driver's license).
