    NOTICE OF PUBLIC RULES HEARINGS

     

    DATE: September 23, 2010

    TIME: 10:00 A.M.

    PLACE: 8TH FLOOR LARGE CONFERENCE ROOM OHIO DEPARTMENT OF HEALTH (ODH) 246 N. HIGH STREET

    COLUMBUS, OHIO 43215

     

    In accordance with Chapter 119 of the Revised Code (R.C.) the Public Health Council (PHC) will conduct four public rules hearings at its September 23, 2010 meeting. The PHC meeting will begin at 10:00 a.m. in the 8th Floor Large Conference Room of the Ohio Department of Health, 246 N. High Street, Columbus 43215; the rules hearings will commence soon thereafter. The hearings are as follows:

     

    HEARING #1: By authority of R.C. 3705.24, the PHC proposes to amend O.A.C. rule 3701- 5-03, pertaining to fees for certified copies of vital records and certification of birth issued by the office of vital statistics. ODH has conducted the five year review of this rule, and proposes to amend it to ensure consistency with statutory language changes made to R.C.

    3705.24 by the General Assembly in H.B. 1 of the 128th General Assembly. The amendment to O.A.C. rule 3701-05-03 will update the language pertaining to the portion of the birth certificate fee collected by the local Vital Statistics Registrars that is required to be sent to the Office of Vital Statistics from seven dollars to the current statutory amount of twelve dollars.

     

    HEARINGS #2 By authority of R.C. 3748.04, the PHC proposes to amend O.A.C. rules 3701:1-44-05 and -15. These rules pertain to the licensing of radiation source material and they are being proposed to meet five-year review requirements. Minor contact updates and clarifying edits are proposed to these rules.

     

    HEARING #3: By authority of R.C. 3748.04, the PHC proposes to amend O.A.C. rules 3701:1-54-01, -07, -09, -10, and -12. These rules pertain to low-level radioactive waste, and they are being considered as a culmination of five-year review. The proposed amendments clarify federal and state rule citations, and make minor editorial changes.

     

    HEARING #4: By authority of R.C. 3748.04, the PHC proposes to adopt new O.A.C. Chapter 3701:1-67, comprising rules 3701:1-67-01 to -09, and -12. These rules pertain to radiation- generating equipment therapy. At the same hearing, the PHC will consider rescinding rules 3701:1-66-14 and -15, the text of which will be moved to the new chapter. The new rules were modeled upon the latest (March 2009) Suggested State Regulations (Conference of Radiation Control Program Directors) in a collaborative effort between the Bureau of Radiation Protection (BRP), the Radiation-generating Equipment Committee (REC) and the Radiation Advisory Council (RAC).

     

    At the hearings, people affected by the proposed actions may appear and be heard in  person, by an attorney, or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
