1301:11-3-03 Education requirements for applicants for licensing and certification.

    NOTICE OF PUBLIC HEARING

    On October 2, 2014, the Ohio Department of Commerce, Division of Real Estate and Professional Licensing will hold a public hearing on proposed changes to 1301:11-1-03, 1301:11- 3-03, 1301:11-3-04, 1301:11-4-02, 1301:11-7-01, 1301:11-7-02 & 1301:11-7-03 of the Ohio

    Administrative Code. The hearing will be held at 9:00 a.m., at 77 South High Street, 22nd Floor, Columbus, Ohio 43215.

     

    PROPOSED RULE CHANGES

     

    1301:11-1-03 - Amended

     

    Fees - Division staff recommends that this rule be amended.

     

    Paragraph (A) - The intent of this regulation is to disclose the amount and the source of appraiser application fees. The amount of the examination fee referenced in the existing rule is incorrect. The examination fee is established through the State's request for proposal process.

     

    Paragraphs (E), (F), (G), (I), (K) and (L) - Deletion of the statutory reference was proposed because the statutory authority found in the existing rule is also found in the rule's history. As a result, the statutory reference is duplicative and unnecessary. There are also proposed grammatical changes.

     

    1301:11-3-03 - Amended

     

    Education requirements for applicants for licensing and certification - Division staff recommends that this rule be amended.

     

    Paragraphs (A) through (J) - The intent of this regulation is to ensure appraiser applicants are sufficiently educated and competent to complete real estate appraisals. The proposed amendments include a provision that an applicant with a degree in real estate from a properly accredited institution may also use that degree to satisfy some the qualifying education requirements found elsewhere in the rule. The proposed amendments are being made in order to make the rule consistent with the requirements of the Appraiser Qualifications Board (hereinafter referred to as the "AQB"). Pursuant to federal law, the AQB establishes the minimum requirements for certified real property appraisers, licensed appraisers and trainee appraisers. States are required to follow AQB requirements.

     

    1301:11-3-04 - Amended

     

    Experience requirement - Division staff recommends that this rule be amended.

     

    Paragraphs (A) through (M) - The intent of this regulation is to ensure appraiser applicants are adequately trained and competent to complete real estate appraisals. The proposed amendments are being made in order to make the rule consistent with the AQB's requirements.

     

    1301:11-4-02 - Amended

     

    Education requirements for registration as a state-registered real estate appraiser assistant

    - Division staff recommends that this rule be amended.

     

     

     

     

     

    Paragraphs (A) through (F) - The intent of this regulation is to ensure appraiser registrants (trainees) are sufficiently educated in order to begin their training process with a supervisory appraiser. The proposed amendments are being made in order to make the rule consistent with the AQB's requirements.

    1301:11-7-01 - Amended

    Continuing education requirement - Division staff recommends that this rule be amended.

    Paragraphs (G), (H) and (J) - The overall intent of this rule is to ensure appraisers participate in a program that maintains and increases an appraiser's skill, knowledge and competency in real property appraising. The proposed amendments provide an appraiser credential holder an extension to complete his/her continuing education requirements, provided the appraiser is impacted by a state or federally declared disaster within 90 days of his/her renewal date. The proposed amendments are also being made in order to make the rule consistent with the AQB's requirements.

    1301:11-7-02 - Amended

    Continuing education course approvals - Division staff recommends that this rule be amended.

    Paragraphs (B)(7), (C) & (K) - The intent of this regulation is to ensure course providers, who are offering continuing education to current appraiser credential holders, provide offerings that increase an appraiser's skill, knowledge and competency in real property appraising.  The proposed amendments will increase the types of activities an appraiser may participate in that will qualify for continuing education credit. The proposed amendments also describe the expected course content for a course designed specifically for supervisory appraisers and registrants. The proposed amendments are also being made in order to make the rule consistent with the AQB's requirements.

    1301:11-7-03 - Amended

    Distance education - Division staff recommends that this rule be amended.

    Continuing Education Requirement - Division staff recommends that this rule be amended.

    Paragraph (G) - The intent of this regulation is to ensure course providers, who are offering distance education to current appraiser credential holders, provide offerings that increase an appraiser's skill, knowledge and competency in real property appraising. The proposed amendments will increase the types of activities an appraiser may participate in a distance education setting that will qualify for continuing education credit. The proposed amendments are also being made in order to make the rule consistent with the AQB's requirements.

    contentions, orally or in writing, offer and examine witnesses, and present evidence tending to show that the proposed rule or amendments, if adopted or effectuated, will be unreasonable or unlawful.

    Any person who wishes to present his or her position, arguments or contentions in writing may do so by mailing his or her written comments to the Ohio Department of Commerce, Division of Real Estate & Professional Licensing, 77 S. High Street, 20th Floor, Columbus, OH 43215. Written comments may also be submitted at the hearing. All written comments must be submitted to the Department no later than 5:00 pm. on October 1, 2014.
