    NOTICE OF PUBLIC HEARING OHIO DEPARTMENT OF PUBLIC SAFETY

    The Ohio Motor Vehicle Dealers Licensing Board, will conduct a public hearing pursuant to section

    119.03 of the Revised Code (R.C.) to solicit comment on actions to Chapter 4501:1-3, "Motor Vehicle Dealers and Salespersons," of the Ohio Administrative Code proposed pursuant to a completed R.C.

    119.032 five-year rule review.

     

    The following rules are proposed for rescission and simultaneously proposed for adoption under the same rule numbers due to the Legislative Service Commission's rule formatting guidelines. It is estimated that changes to the rules affect more than fifty percent of the content:

     

    4501:1-3-08 (Place of business required for used motor vehicle dealers) sets forth the requirements to establish a used motor vehicle dealer's place of business. Changes to the new rule reorganize content for clarity, remove the requirement for dealers to maintain a landline, and provide that at the discretion of the Dealers Licensing Board, a used motor vehicle dealer's license may be granted to a new motor vehicle dealer who has surrendered his license in accordance with provisions set forth in the rule.

     

    4501:1-3-11 (Dealer required to maintain net worth) requires a dealer to maintain a net worth (assets minus liabilities) in the amount of $75,000 dollars. Changes to the new rule add language that defines assets and liabilities.

     

    Any persons affected by the proposed actions may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed rules will be unreasonable or unlawful if enacted.
