    Acting under the authority of the Ohio Revised Code Sections 119.03 to 119.13, 3715.69, 3719.28, and 4729.26, the State Board of Pharmacy hereby announces a public hearing will be held on Monday, September 10, 2007, at 11:00 a.m. in Room South A, 31st Floor, Vern Riffe Center for Government and the Arts, 77 South High Street, Columbus, Ohio.

     

    This is a statement of the agency's intention to consider adopting proposed new and amended rules as follows:

     

    4729-1-02 (Notice of meetings.)  To add language that a person may obtain information regarding board meetings by e-mail.

     

    4729-5-01 (Definitions.) To add language that direct supervision has the same meaning as personal supervision, and to clarify where the supervision can occur.

     

    4729-5-08 (Pharmacy intern professional functions.) To create a new rule that references all the professional functions an intern may perform under the direct supervision of a pharmacist.

     

    4729-5-10 (Prescription pick-up station.) To add language to allow for health care professionals licensed pursuant to Chapters 4715., 4730., and 4741. of the Revised Code to participate as a pick-up station.

     

    4729-5-13 (Prescription format.) To add language to clarify that an identification number issued by a hospital or institution is to be used for a prescription for a controlled substance.

     

    4729-5-15 (Prescriber.)  To add language that identifies a physician assistant as a prescriber.

     

    4729-5-27 (Record keeping.) To change language so that it is standardized with other areas of the Administrative Code regarding the procedure for maintaining the off-site storage of records; to add language to clarify the computerized record keeping system requirements; and to add new language regarding immunizations pursuant to the passage of Senate Bill 58.

     

    4729-5-30 (Manner of issuance of a prescription.) To add language that defines the process necessary for a prescriber to indicate "dispense as written" or DAW.

     

                              (Course requirements in the administration of adult immunizations.) To remove all language that references "adult" when referring to immunizations pursuant to the passage of Senate Bill 58.

     

                              (Protocols for the administration of adult immunizations.)   To remove all language that references "adult" when referring to immunizations. Also, to change the notification and location requirements, and to add language for the areas in the protocol that could involve a pharmacy intern under the direct supervision of a pharmacist. All changes were made pursuant to the passage of Senate Bill 58.

     

    4729-9-11 (Security and control of dangerous drugs.) To add language regarding the proper storage of drugs and devices.

    4729-9-14 (Records of controlled substances.)  To add language to clarify that records may be kept electronically if approved by the board, and to standardize language with other areas of the Administrative Code regarding the procedure for maintaining the off-site storage of records.

    4729-9-22 (Records of dangerous drugs.)     To add language to clarify that records may be kept electronically if approved by the board, and to standardize language with other areas of the Administrative Code regarding the procedure for maintaining the off-site storage of records.

                  (Definitions.) To add language to define licensed health professional authorized to prescribe drugs or prescriber and to remove the individual definitions for dentist, optometrist, physician, and veterinarian that are no longer required.

                  (Licensure.) To remove all language that refers to a dentist, an optometrist, a physician, or a veterinarian and replaces them with the term prescriber.

          (Compliance.) To remove language that is duplicated in the rule.

    4729-36-04 (Sample drug distribution to a charitable pharmacy.) To add language that a sample drug may be distributed to a charitable pharmacy by a manufacturer's representative, and removes language that required a copy of the original manufacturer's record to be transferred with the sample.

                 (Entities required to submit information.)   To add language to clarify what entities are required to submit information to the board, and to clarify what type of information is to be submitted.

          (Information required for submission.)                To make technical changes to correct paragraph references due to proposed rule changes.

                 (Electronic format for the transmission of wholesale drugs.) To add language to clarify the format methods that wholesale data can be submitted to the board.

                 (Frequency requirements for submitting drug database information.) To add language to change the frequency submission to the board of wholesale drug information from twice a month to monthly.

    The full text of the proposed rules are available at the office of the State Board of Pharmacy in printed form without charge to any person affected by such proposals. The proposed rules are also on the Board's website at www.pharmacy.ohio.gov and on the Register of Ohio website at www.registerofohio.state.oh.us.

    On the date and at the time and place designated in this notice, any person affected by the proposed actions of the State Board of Pharmacy may appear and be heard in person, by his/her attorney, or both; may present his/her position, arguments, or contentions orally or in writing; offer witnesses; and, present evidence tending to show that any proposal, if adopted or effectuated, will be unreasonable or unlawful.
