    NOTICE OF PUBLIC HEARING

     

     

    The Board of Examiners of Nursing Home Administrators (BENHA) will conduct a public hearing beginning at 11:00 a.m. on Thursday, September 6, 2007, in the 8th Floor Conference Room of the Ohio Department of Health, 246 N. High Street, Columbus, Ohio, 43215. The purpose of this hearing is to consider rescinding current rule/adopting new rule 4751-1-01 of the Ohio Administrative Code (OAC). Authorized by Revised Code (RC) 4751.04, this rule pertains to public notices concerning adoption, amendment, or rescission of rules. BENHA has reviewed OAC 4751-1-01 pursuant to RC 119.032 (five-year-rule review).

     

    The current rule is being proposed for rescission and new language proposed in a new rule to incorporate the current accepted electronic method for posting hearing notices. In addition, the new rule updates procedures for notifying interested or affected persons or entities about proposed rule changes to include electronic methods.

     

    At the hearing, persons affected by the proposed action may appear and be heard in person, by an attorney, or both; may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rule, if adopted or effectuated, will be unreasonable or unlawful. Persons intending to testify are encouraged to preregister by writing to Lyndell Mills, BENHA, Ohio Department of Health, 246 N. High Street, Columbus, Ohio 43215, by telephoning (614) 466-5114, or by e-mailing  Lmills@odh.ohio.gov. Copies of the rules proposed for rescission/adoption may be requested from Mr. Mills by the methods stated in this paragraph, or on the Register of Ohio website:  www.registerofohio.state.oh.us/jsps/PublicDisplayRules/searchrulenumber.jsp. Any written comments may be submitted to Mr. Mills via mail, e-mail or faxed to (614) 0271 on or before September 6, 2007.
