    PUBLIC HEARING NOTICE

    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to section 5107.05 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the adoption, amendment, or rescission of the rule or rules as identified below and of a public hearing thereon.

     

    Rule 5101:1-2-35, entitled Sponsor-to-Alien Deeming Requirements: is being proposed for rescission and incorporated into new rule 5101:1-2-35 Sponsor to-Alien Deeming Requirements because new federal regulations have mandated a change in how deeming requirements will be applied to aliens who are sponsored in the United States.

     

    Rule 5101:1-2-30 entitled Citizenship: Ohio Works First and Disability Financial Assistance is being proposed for amendment to comply with the requirements pursuant to the five-year rule review as set forth in Section 119.03 of the Revised Code and to include language in which Indian tribes who have evidence of being born in Canada, have at least fifty percent Native American blood, and have established and maintained residence in the U.S. may be eligible for the Ohio works first or Disability Financial Assistance programs.

     

    Rule 5101:1-2-30.2 entitled Benefit Eligibility: Indefinite Detainees/Lifers is being proposed for amendment to comply with the requirements pursuant to the five- year rule review as set forth in Section 119.03 of the Revised Code and to provide language which states that non citizens who are released from indefinite detention may meet the definition of a Cuban/Haitian entrant and may have an immigration status which makes them eligible for the refugee cash assistance program.

     

    A copy of the proposed rule(s) is available, without charge, to any person affected by the rule(s) at the address listed below. The rule(s) is also available on the internet at  http://www.registerofohio.state.oh.us/. A public hearing on the proposed rule(s) will be held at the date, time, and location listed at the top of this notice. Either written or oral testimony will be taken at the pub lic hearing. Additionally, written comments submitted or postmarked no later than the date of the public hearing will be treated as testimony.
