    NOTIFICATION OF PUBLIC HEARING OHIO DEPARTMENT OF PUBLIC SAFETY

    Columbus, Ohio 43223

     

    Pursuant to section 119.03 of the Ohio Revised Code, the Ohio Department of Public

    Safety will conduct a public hearing for the purpose of soliciting comments on the following proposed changes to Chapter 4501-7, "Commercial Driver Training Schools," of the Ohio Administrative Code.  The purpose of the proposed changes is to implement an on-line internet based pilot program to determine the effectiveness of on-line instruction for driver training.

     

    Amendment

     

    New language is proposed for the following rules to establish the definitions, requirements, exemptions, and restrictions for providers participating in the on-line internet based pilot program: 4501-7-01 (Definitions); 4501-7-02 (Place of business for a class D license school and office); 4501-7-08 (Insurance and bonding for training the operation of class D motor vehicles); 4501-7-12 (Class D license school training agreements); 4501-7-13 (Class D license school records); and 4501-7-20 (Inspections and investigations of class D license schools).

     

    Rescission

     

    4501-7-10 (Training required for the operation of class D motor vehicles) - This rule is being proposed for rescission due to LSC formatting requirements. It is estimated that changes to the rule strike approximately half of the existing text while adding a comparable amount of new text. This rule is simultaneously being proposed as a new rule under the same rule number.

     

    Adoption

     

    4501-7-10 (Training required for the operation of class D motor vehicles) - Changes to this rule allow for reorganization of the rule to clarify which requirements apply to providers participating in the on-line internet based pilot program.

     

    Any persons affected by the proposed amendment and rescission of these rules may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed amendments, rescission, and/or adoption will be unreasonable or unlawful.
