PUBLIC HEARING NOTICE
OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

Pursuant to sections 5104.30, 5104.34, 5104.35, 5104.38, 5104.39 and Chapter 119. of the Ohio Revised Code, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon.
Rule 5101:2-16-01, entitled Definitions for Eligibility for Publicly Funded Child Care Benefits, is being proposed for amendment to revise and add definitions for eligibility for publicly funded child care. This rule provides definitions for eligibility for child care benefits. It is being amended to change the federal references for the definition of federal poverty level, to delete the definitions of full-time and part-time hours and to add a definition for school hours.
Rule 5101:2-16-07, entitled County Department of Job and Family Services Administrative Responsibilities for Determining Eligibility for Publicly Funded Child Care Benefits is being proposed for amendment to clarify eligibility requirements for publicly funded child care. This rule provides requirements for county department of job and family services for determining eligibility for publicly funded child care. It is being amended to change the date on the forms, add an appendix and clarify language.
Rule 5101:2-16-30, entitled Eligibility Requirements for Receipt of Publicly Funded Child Care Benefits is being proposed for amendment to implement cost saving provisions of Am. Sub. H.B. 1 of the 128th General Assembly and to clarify eligibility requirements for publicly funded child care. This rule provides eligibility requirements for child care benefits. It is being amended to remove the six month copayment review, add a restriction on the number of providers that can be used by a caretaker during a period of time, add food assistance and employment training program activities as qualified activities for child care eligibility and to update the appendix to reflect the income eligibility requirement of 150 percent of the federal poverty level.
Rule 5101:2-16-39, entitled Copayment for Publicly Funded Child Care This rule is being proposed for amendment to implement cost saving provisions of Am. Sub. H.B. 1 of the 128th General Assembly and to clarify copayment requirements for publicly funded child care. This rule provides copayment requirements for child care benefits. It is being amended to remove the six month copayment review and to update the appendices to reflect copayment amounts and a new calendar.
Rule 5101:2-16-41, entitled Reimbursement Rates for Providers of Publicly Funded Child Care is being proposed for amendment to implement cost savings provisions of
Am. Sub. H.B. 1 of the 128th General Assembly. This rule sets forth the reimbursement rates for providers of publicly funded child care. It is being amended to update the appendix due to an adjustment in the maximum provider reimbursement rates and to remove the list of accreditations in order for the department to develop standards for reviewing and approving those accreditations. Additional reimbursements for step up to quality has been added.
Rule 5101:2-16-44, entitled County Department of Job and Family Services Requirements for the Purchase of Child Care Services is being proposed for amendment to clarify policy. This rule provides requirements for the county department of job and family services for the provision for the purchase of publicly funded child care. It is being amended to change the date on the forms.
Rule 5101:2-16-55, entitled Use of the JFS 01140 'Certificate of Authorization for Payment of Publicly Funded Child Care Services (COAP)' is being proposed for amendment to clarify policy. This rule provides requirements for the Certificate of Authorization for Payment of Publicly Funded Child Care Services, COAP. It is being amended to change the date on the form.
