This rule is being proposed to fulfill the five year rule review requirements of section 119.032 of the Revised Code.

3745-7-09,3745-81-01, and 3745-82-01 of the Administrative Code. Pursuant to section 121.76 of the Revised Code these references are exempt from the requirements of sections 121.71 to 121.74.

The proposed new rule creates additional work activities for Agency staff as compared to the current rule proposed for rescission. The Agency does not anticipate this will result in a change in agency revenues or expenditures, but rather a reallocation of resources as other amendments contained in this rule package will result in a reduction in work activities.

The cost of compliance with this rule is tied to the cost of compliance of rule 3745-7-02. Rule 3745-7-02 requires that public water systems have an operator in
responsible charge onsite in accordance with staffing times in this rule. The Agency estimates that the total statewide cost of compliance with these two rules for public water systems is approximately $15,301,728.04 per year. Please see Attachment C for details. The salary data used by the Agency in preparing this estimate was obtained from a 1999 water operator wage survey (normalized to 2006 dollars using the Bureau of Labor Statistics Inflation Calculator), posted water operator positions and discussions with contract operators working throughout the state. An indirect cost of 50% has been added to each standard operator wage for benefits, etc. Please note that the estimate does not take into account the rule's several provisions allowing for reductions in the amount of time the operator in responsible charge is required to be onsite. Should those provisions be taken advantage of, the overall cost of compliance could be much less.

The Agency is unable to estimate the cost of compliance with the proposed new rule for school districts, counties, townships, and municipal corporations. Due to data collection and/or retrieval limitations the Agency is unable to separate out which public water systems are owned or operated by school districts, counties, townships, or municipal corporations and thereby estimate the cost of compliance for each entity.
3. If the proposed rule is the result of a federal requirement, does the proposed rule exceed the scope and intent of the federal requirement? No

Requirements for ensuring public water systems are manned by an appropriately certified operator in responsible charge are already in effect in other rules. Through the proposed package the Agency proposes to relocate them to this rule. The Agency's and local government's ability to pay have already been demonstrated.

7. Please provide a statement on the proposed rule's impact on economic development.
As indicated above, the requirement for an operator in responsible charge is not new and for many public water systems the amount of time the operator will be required to be onsite will be reduced as compared to the requirements found in the current rule. As such, the agency has estimated a lower cost of compliance as compared to the current requirements and hopes the proposed rule will have a positive impact on economic development.

Environmental Rule Adoption/Amendment Form
Pursuant to Am. Sub. H.B. 106 of the 121st General Assembly, prior to adopting a rule or an amendment to a rule dealing with environmental protection, or containing a component dealing with environmental protection, a state agency shall:

In addition, Ohio EPA initiated an early involvement review process and formed a stakeholder group prior to interested party review in order to allow more direct stakeholder input early in the rule making process. The stakeholder group consists of representatives of the major cities, water and wastewater organizations, contract operators, and select individuals. The stakeholder group began meeting in January 2005 and held seven meetings before coming to common ground on most of the main issues.

Is the proposed rule or rule amendment more stringent than its federal counterpart ? Yes
What is the rationale for not incorporating the federal counterpart?
U.S. EPA has not promulgated rules for an operator certification program, but rather has issued guidelines for the certification of public water system operators. Any state that does not implement an operator certification program at least as stringent as the guidelines is subject to lose 20% of the state's Drinking Water State Revolving Fund capitalization grant. This would amount to approximately $5 million dollars for Ohio. The federal guidelines also prohibit states from backsliding existing program requirements to make them less stringent even if they would meet the federal guidelines. While there are not equivalent guidelines for treatment works and sewerage systems, Ohio maintains an operator certification program to maintain consistency with other states and to comply with the
anti-backsliding provisions of the federal guidelines. Ohio's rules may be perceived as more stringent because we are more detailed than the federal guidelines.
Establishing this additional level of detail is not only necessary to implement the program, but is also the expectation of U.S. EPA as indicated in the guidelines. In this rule, detail has been established as necessary to implement the program and as directed by U.S. EPA. In particular, U.S. EPA gave the states the responsibility to define the categories of systems and to develop specific operator certification requirements for each level of classification.
(D) If this is a rule amendment that is being adopted under a state statute that establishes standards with which the amendment is to comply, is the proposed rule amendment more stringent than the rule that it is proposing to amend? Yes
Please explain why?
The proposed rule includes codifying the classification of public water systems and adding minimum staffing requirements to ensure that a highly trained and competent individual is responsible for the daily operation of the public water system. Codifying system classification will provide clarity and objectiveness for

the process, and while it is expected that a few systems will increase in classification under the proposed rule, the majority of systems are expected to stay the same or decrease in classification. The proposed minimum staffing times are replacing requirements for facilities to hire a "full-time" operator and provide for reduced minimum staffing times at larger facilities based on staffing levels, degree of automation, compliance history and the ability of a responsible charge operator to respond within one hour. A provision of the proposed rule that may be considered to be more stringent than the rule it is replacing is the requirement for an operator in responsible charge or backup operator in responsible charge to be available during all periods of public water system operation. The agency believes that it is essential that every facility have an operator in responsible charge with a certificate of the appropriate classification available to respond in the event of an emergency.
