    3770:1-9-344               Game rule number three hundred forty-four.

     

     

     

    (A)Title and term. Ohio lottery commission game rule number three hundred forty-four, "NBA Instant Game," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number three hundred forty-four.

     

    (B)General design.

     

    (1)Game rule number three hundred forty-four is an instant lottery game within which are contained two separate games. To win a prize award(s), the player is required to scratch off the covering and do one or more of the following: beat the "Visitor's Score" in "Game 1;" and match three like prize values in "Game 2." A player may win up to nine times on one ticket.

     

    (a) "Game 1," - The player will remove the covering of the entire play area to reveal one "Visitor's Score," eight "Your Scores" and eight corresponding prize values. If any one or more of "Your Scores" is higher than the "Visitor's Score," the player wins the prize value shown below the winning "Your Score(s)." There are eight chances to win on each ticket, and a player may win up to eight times on one ticket.

     

    (b) "Game 2" - The player will remove the covering over the play area to reveal six prize values. If three of the six prize values revealed match, the player wins the matched prize value.

     

    (2)As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, four dollars, eight dollars, twenty dollars, fifty dollars, one hundred dollars, one thousand dollars and twenty-five thousand dollars. Each ticket in game rule number three hundred forty-four shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)Price of tickets. The price of a ticket issued by the commission in game rule number three hundred forty-four shall be two dollars.

     

    (D)Structure, nature and value of prize awards.

     

    (1)There shall be one type of prize in game rule number three hundred forty-four called a "regular prize award."

     

    (2)The only "prize values" which shall appear on a ticket in game rule number three hundred forty-four are those listed as follows:

     

    (a)"Game 1," - one dollar, two dollars, four dollars, eight dollars, twenty

     

     

    dollars, fifty dollars, one hundred dollars, one thousand dollars and twenty-five thousand dollars; and

    (b) "Game 2," - two dollars, four dollars, eight dollars, twenty dollars, fifty dollars, one hundred dollars, one thousand dollars and twenty-five thousand dollars.

    (3) Numbers and prize values appearing on any ticket in game rule number three hundred forty-four shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers and prize values.

    (a) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for two dollars once in "Game 1" shall win a regular prize award of two dollars;

    (b) Holder of a valid winning ticket on which two of "Your Scores" are higher than the "Visitor's Score" for one dollar two times in "Game 1" shall win a regular prize award of two dollars;

    (c) Holder of a valid winning ticket on which three of the prize  values revealed are two dollars in "Game 2" shall win a regular prize award of two dollars;

    (d)Holder of a valid winning ticket on which four of "Your Scores" are higher the "Visitor's Score" for one dollar four times in "Game 1" shall win a regular prize award of four dollars;

    (e) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for two dollars once in "Game 1;" and on which three of the prize values revealed are two dollars in "Game 2" shall win a regular prize award of four dollars;

    (f)Holder of a valid winning ticket on which three of the prize  values revealed are four dollars in "Game 2" shall win a regular prize award of four dollars;

    (g) Holder of a valid winning ticket on which two of "Your Scores" are higher than the "Visitor's Score" for one dollar two times in "Game 1;" and on which three of the prize values revealed are two dollars in "Game 2" shall win a regular prize award of four dollars;

    (h) Holder of a valid winning ticket on which three of the prize values revealed are eight dollars in "Game 2" shall win a regular prize award of eight dollars;

    (i) Holder of a valid winning ticket on which all eight of "Your Scores" are

    higher than the "Visitor's Score" for one dollar eight times in "Game 1" shall win a regular prize award of eight dollars;

    (j) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for four dollars once in "Game 1;" and on which three of the prize values revealed are four dollars in "Game 2" shall win a regular prize award of eight dollars;

    (k) Holder of a valid winning ticket on which three of "Your Scores" are higher than the "Visitor's Score" for two dollars three times in "Game 1;" and on which three of the prize values revealed are two dollars in "Game 2" shall win a regular prize award of eight dollars;

    (l) Holder of a valid winning ticket on which four of "Your Scores" are higher than the "Visitor's Score" for one dollar four times in "Game 1;" and on which three of the prize values revealed are four dollars in "Game 2" shall win a regular prize award of eight dollars;

    (m) Holder of a valid winning ticket on which all eight of "Your Scores" are higher than the "Visitor's Score" for two dollars eight times in "Game 1;" and on which three of the prize values revealed are four dollars in "Game 2" shall win a regular prize award of twenty dollars;

    (n) Holder of a valid winning ticket on which three of the prize values revealed twenty dollars in "Game 2" shall win a regular prize award of twenty dollars;

    (o) Holder of a valid winning ticket on which five of "Your Scores" are higher than the "Visitor's Score" for four dollars five times in "Game 1" shall win a regular prize award of twenty dollars;

    (p) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for twenty dollars once in "Game 1" shall win a regular prize award of twenty dollars;

    (q) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for fifty dollars once in "Game 1" shall win a regular prize award of fifty dollars;

    (r) Holder of a valid winning ticket on which all eight of "Your Scores" are higher than the "Visitor's Score" for two dollars three times and eight dollars five times in "Game 1;" and on which three of the prize values revealed are four dollars in "Game 2" shall win a regular prize award of fifty dollars;

    (s) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for fifty dollars once in "Game 1" shall win a

    regular prize award of fifty dollars;

    (t)Holder of a valid winning ticket on which three of the prize  values revealed are fifty dollars in "Game 2" shall win a regular prize award of fifty dollars;

    (u) Holder of a valid winning ticket on which five of "Your Scores" are higher than the "Visitor's Score" for twenty dollars five times in "Game 1" shall win a regular prize award of one hundred dollars;

    (v) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for one hundred dollars once in "Game 1" shall win a regular prize award of one hundred dollars;

    (w)Holder of a valid winning ticket on which all eight of "Your Scores" are higher than the "Visitor's Score" for one dollar two times and eight dollars six times in "Game 1;" and on which three of the prize values revealed are fifty dollars in "Game 2" shall win a regular prize award of one hundred dollars;

    (x) Holder of a valid winning ticket on which three of the prize values revealed are one hundred dollars in "Game 2" shall win a regular prize award of one hundred dollars;

    (y) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for one thousand dollars once in "Game 1" shall win a regular prize award of one thousand dollars;

    (z) Holder of a valid winning ticket on which three of the prize  values revealed are one thousand dollars in "Game 2" shall win a regular prize award of one thousand dollars;

    (aa) Holder of a valid winning ticket on which one of "Your Scores" is higher than the "Visitor's Score" for twenty-five thousand dollars once in "Game 1" shall win a regular prize award of twenty-five thousand dollars; and

    (bb) Holder of a valid winning ticket on which three of the prize values revealed are twenty-five thousand dollars in "Game 2" shall win a regular prize award of twenty-five thousand dollars.

    (E) Number of prize awards. The number of prize awards in any sales cycle of game rule number three hundred forty-four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold should be as follows:

    (a) Six tickets winning twenty-five thousand dollars in "Game 2" to win twenty-five thousand dollars; and

    (b) Six tickets winning twenty-five thousand dollars once in "Game 1" to win twenty-five thousand dollars.

    (3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a) Two  tickets  winning  one  thousand  dollars  in  "Game  2"  to  win  one thousand dollars;

    (b) One ticket winning one thousand dollars once in "Game 1" to win one thousand dollars;

    (c) Thirty-seven tickets winning one hundred dollars in "Game 2" to win one hundred dollars;

    (d)Thirty-seven tickets winning one dollar two times and eight dollars six times in "Game 1;" and fifty dollars in "Game 2" to win one hundred dollars;

    (e) Thirty-eight tickets winning one hundred dollars once in "Game 1" to win one hundred dollars;

    (f)Thirty-eight tickets winning twenty dollars five times in "Game 1" to win one hundred dollars;

    (g) One hundred ninety-five tickets winning fifty dollars in "Game 2" to win fifty dollars;

    (h) One hundred ninety-five tickets winning fifty dollars once in "Game 1" to win fifty dollars;

    (i) One hundred ninety-five tickets winning two dollars three times and eight dollars five times in "Game 1;" and four dollars in "Game 2" to win fifty dollars;

    (j) One hundred ninety-five tickets winning fifty dollars once in "Game 1" to

    win fifty dollars;

    (k) Five hundred tickets winning twenty dollars once in "Game 1" to win twenty dollars;

    (l) Five hundred tickets winning four dollars five times in "Game 1" to win twenty dollars;

    (m) Five hundred tickets winning twenty dollars in "Game 2" to win twenty dollars;

    (n) Five hundred tickets winning two dollars eight times in "Game 1;" and four dollars in "Game 2" to win twenty dollars;

    (o) Five hundred tickets winning one dollar four times in "Game 1;" and four dollars in "Game 2" to win eight dollars;

    (p) Five hundred tickets winning two dollars three times in "Game 1;" and two dollars in "Game 2" to win eight dollars;

    (q) One thousand tickets winning four dollars once in "Game 1;" and four dollars in "Game 2" to win eight dollars;

    (r) One thousand tickets winning one dollar eight times in "Game 1" to win eight dollars;

    (s) One thousand tickets winning eight dollars in "Game 2" to win eight dollars;

    (t)Four thousand five hundred tickets winning one dollar two times in "Game 1;" and two dollars in "Game 2" to win four dollars;

    (u) Four thousand tickets winning four dollars in "Game 2" to win four dollars;

    (v) Four thousand tickets winning two dollars once in "Game 1;" and two dollars in "Game 2" to win four dollars;

    (w)Four thousand five hundred tickets winning one dollar four times in "Game 1" to win four dollars;

    (x) Six thousand tickets winning two dollars in "Game 2" to win two dollars;

    (y) Six thousand tickets winning one dollar two times in "Game 1" to win two dollars; and

    (z) Eight thousand tickets winning two dollars once in "Game 1" to win two

    dollars.

    (F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.

    (G)Frequency of prize drawings.

    (1) Random imprinting of prize awards on all tickets issued in game rule number three hundred forty-four shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2) When a ticket issued in game rule number three hundred forty-four is sold or deemed sold in accordance with this rule and the covering material over any of the numbers and prize values has been removed, the holder shall be deemed to have drawn the numbers and prize values on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number three hundred forty-four in which the ticket was sold.

    (H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by agents of tickets winning prize awards which are to be paid by agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.

    (I)Validity of tickets.

    (1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number three hundred forty-four void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or

    issuance of a replacement ticket of comparable price.

    (J) Director's conduct of game rule number three hundred forty-four.

    (1) The director shall conduct game rule number three hundred forty-four in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number three hundred forty-four. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2) Names and definitions of elements of game rule number three hundred forty-four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number three hundred forty-four and these elements may be given names or titles chosen by the commission.
