5101:1-3-03 Ohio works first: residence and living arrangement requirement.

    DEPARTMENT OF JOB AND FAMILY SERVICES

    PURSUANT TO SECTIONS 5107.02, 5107.05, 5107.10 AND CHAPTER 119. OF THE OHIO REVISED CODE, THE DIRECTOR OF THE DEPARTMENT OF JOB AND FAMILY SERVICES GIVES NOTICE OF THE DEPARTMENT'S INTENT TO AMEND THE FOLLOWING RULES PERTAINING TO ELIGIBILITY FOR CERTAIN OHIO WORKS FIRST COMPONENTS ON A PERMANENT BASIS AND OF A PUBLIC HEARING THEREON.

    Rule 5101:1-3-02, entitled "Ohio Works First (OWF) School Attendance" is being proposed for amendment pursuant to the five-year rule review process.

    Rule 5101:1-3-03 entitled "Ohio Works First (OWF): residence and living arrangement requirements" sets forth the policy regarding appropriate residence and living arrangements for the OWF program. This rule is being amended to change CDHS to CDJFS.

    Rule 5101:1-3-04, entitled "Ohio Works First (OWF) Temporary Absence" is being proposed for amendment pursuant to the five year rule review process.

    Rule 5101:1-3-04.1, entitled "Ohio Works First (OWF):Shared Parenting (joint custody)" is being proposed for amendment pursuant to the five year rule review process.

    Rule 5101:1-3-07 entitled "Ohio Works First (OWF): evidence of age, citizenship and identity"sets forth the policy regarding verifications that are acceptable for the OWF program. This rule is being amended to update the verifications that are acceptable as proof of eligible alien status.

    Rule 5101:1-3-09 entitled "OWF and RCA: social security number requirement" sets forth the policy regarding the requirement of OWF and RCA assistance groups to provide a social security number. This rule is being amended to broaden the ways in which a social security number can be verified.

    Rule 5101:1-3-15 entitled "Ohio Works First (OWF): penalties and three-tier sanctions" sets forth the policy regarding penalties and sanctions that can be applied to OWF assistance groups who fail a requirement of the program. This rule is being amended to add language from rescinded rule 5101:1-3-29.

    Rule 5101:1-3-29 entitled "Ohio Works First/Medicaid/ADC-related Medicaid: denial of assistance to individuals convicted of fraudulently misrepresenting residence" sets forth the policy regarding the ineligibility of individuals who has misrepresented their residence in more than one state. This rule is being rescinded and language added to rules 5101:1-3-15 and 5101:1-37-02.

    Rule 5101:1-23-10 entitled "OWF: standard filing unit" sets forth the policy regarding what individuals are included when determining eligibility for the OWF program. This rule is being amended to add language in paragraph (A) regarding minor parent(s) residing with parent(s).

    Rule 5101:1-25-011 entitled "OWF: Payments" is being rescinded as all of the language is contained

    in rule 5101:1-23-40.

The rules are available on the internet at http://www.state.oh.us/odjfs/legal.htm A public hearing on the proposed rules will be held on October 23, 2002 at 10:30 A.M. until all testimony is heard in Room 1865 of the Rhodes Office Tower, 30 E. Broad Street, Columbus, Ohio. Either written or verbal testimony on these rules will be taken at the public hearing. Additionally, written comments submitted or postmarked no later than October 23, 2002 will be treated as testimony.
