PUBLIC HEARING NOTICE

Pursuant to Ohio Revised Code Section 119.03, notice is hereby given that the Department of Administrative Services intends to conduct a public hearing for the purpose of amending Ohio Administrative Code Sections 123:1-17-03, 123:1-17-04, 123:1-17-05, 123:1-17-09, 123:1-17-

11, 123:1-17-17, the rescission of Ohio Administrative Code Section 123:1-17-01 and 123:1-17-02, and the adoption of new Ohio Administrative Code Sections 123:1-17-01 and 123:1-17-02.

 

The proposed to be amended rules deal with the following subject matter:

 

123:1-17-03 Limitation  on  Certifications  -  Practices  and procedures associated with how many times a person can be certified for employment from an eligible list.

 

123:1-17-04 Notice of Certification - Procedures regarding notification to an eligible that they have been certified and are being considered for a position.

 

123:1-17-05 Reply by Eligible - Procedures on communication between eligible and appointing authority after being certified to a position.

 

123:1-17-09 Removal from Eligible List Following Certification - Procedures associated with removing eligible from the eligible list.

 

123:1-17-11 Cancellation of Certification - Procedures regarding cancellation of a certification because an  eligible waives certification.

 

123:1-17-17 Restoration after Probationary Removal - Procedures regarding restoring a person to a certification list if removed from employment during a probationary period.

 

 

 

 

 

 

 

 

The proposed to be rescinded rules deals with the following subject matter:

123:1-17-01 Requisition - Procedures and protocols for the administration of vacant classified positions.

123:1-17-02 Certification Eligible List - Procedures associated with selection of a candidate from a certification eligible list to fill a vacancy.

The proposed to be adopted rules deal with the following subject matter:

123:1-17-01 Classified  Selections  -  Procedures  and  protocols  for the administration of vacant classified positions.

123:1-17-02 Eligible List - Procedures associated with selection of a candidate from an eligible list to fill a vacancy.

The Department of Administrative Services shall hold a public hearing on the proposed rule amendment on Monday, October 17, 2011, at 9:00 a.m. in Room 2793, on the 27th floor of the James A. Rhodes State Office Tower located at 30 East Broad Street, Columbus, Ohio. At this hearing, any person affected by the rules may appear and be heard in person, by the person's attorney, or both, may present the person's position, arguments, or contentions orally or in writing, offer and examine witnesses, and present evidence that tends to show that the rules, if adopted or effectuated, will be unreasonable or unlawful.

Any such written statements actually received by 5:00 p.m. on Friday, October 14, 2011, will be considered by the Department of Administrative Services.
