3770:1-9-590 Game rule number five hundred ninety.
(A)Title and term. Ohio lottery commission game rule number five hundred ninety, "Stocking Stuffer," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number five hundred ninety.
(B)General design.
(1)Game rule number five hundred ninety is a reveal the symbol game, and is generally known as an "instant lottery."
(2)Holders of valid tickets will remove the covering off the entire play area to reveal one or more of the following play symbols: "Candle," "Lights," "Angel," "Present," "Bells," "Snowflake," "Candy Cane," "Reindeer," "Ornament" and "Horn." If a "Horn" play symbol is revealed, the player wins the corresponding prize value shown below that play symbol. There are seven chances to win on each ticket, and a player may win up to seven times on one ticket.
(3)As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, three dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars and one thousand dollars. Each ticket in game rule number five hundred ninety shall be imprinted in such a way that prize awards from the set listed above may be won.
(C)Price of tickets. The price of a ticket issued by the commission in game rule number five hundred ninety shall be one dollar.
(D)Structure, nature and value of prize awards.
(1)There shall be one type of prize in game rule number five hundred ninety called a "regular prize award."
(2)The only "prize values" which shall appear on a ticket in game rule number five hundred ninety are: one dollar, two dollars, three dollars, five dollars, seven dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars and one thousand dollars. Play symbols and prize values appearing on any ticket in game rule number five hundred ninety shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying play symbols and prize values.
(a)Holder of a valid winning ticket on which one "Horn" symbol is revealed
for one dollar once shall win a regular prize award of one dollar;
(b) Holder of a valid winning ticket on which two "Horn" symbols are revealed for one dollar two times shall win a regular prize award of two dollars;
(c) Holder of a valid winning ticket on which one "Horn" symbol is revealed for two dollars once shall win a regular prize award of two dollars;
(d)Holder of a valid winning ticket on which one "Horn" symbol is revealed for three dollars once shall win a regular prize award of three dollars;
(e) Holder of a valid winning ticket on which three "Horn" symbols are revealed for one dollar three times shall win a regular prize award of three dollars;
(f)Holder of a valid winning ticket on which one "Horn" symbol is revealed for five dollars once shall win a regular prize award of five dollars;
(g) Holder of a valid winning ticket on which five "Horn" symbols are revealed for one dollar five times shall win a regular prize award of five dollars;
(h) Holder of a valid winning ticket on which two "Horn" symbols are revealed for two dollars once and three dollars once shall win a regular prize award of five dollars;
(i) Holder of a valid winning ticket on which one "Horn" symbol is revealed for ten dollars once shall win a regular prize award of ten dollars;
(j) Holder of a valid winning ticket on which five "Horn" symbols are revealed for two dollars five times shall win a regular prize award of ten dollars;
(k) Holder of a valid winning ticket on which seven "Horn" symbols are revealed for one dollar five times, two dollars once and three dollars once shall win a regular prize award of ten dollars;
(l) Holder of a valid winning ticket on which one "Horn" symbol is revealed for twenty dollars once shall win a regular prize award of twenty dollars;
(m) Holder of a valid winning ticket on which seven "Horn" symbols are revealed for two dollars five times, three dollars once and seven dollars once shall win a regular prize award of twenty dollars;
(n) Holder of a valid winning ticket on which one "Horn" symbol is revealed
for fifty dollars once shall win a regular prize award of fifty dollars;
(o) Holder of a valid winning ticket on which five "Horn" symbols are revealed for ten dollars five times shall win a regular prize award of fifty dollars;
(p) Holder of a valid winning ticket on which seven "Horn" symbols are revealed for five dollars four times and ten dollars three times shall win a regular prize award of fifty dollars;
(q) Holder of a valid winning ticket on which one "Horn" symbol is revealed for one hundred dollars once shall win a regular prize award of one hundred dollars;
(r) Holder of a valid winning ticket on which five "Horn" symbols are revealed for twenty dollars five times shall win a regular prize award of one hundred dollars;
(s) Holder of a valid winning ticket on which one "Horn" symbol is revealed for five hundred dollars once shall win a regular prize award of five hundred dollars;
(t)Holder of a valid winning ticket on which five "Horn" symbols are revealed for one hundred dollars five times shall win a regular prize award of five hundred dollars; and
(u) Holder of a valid winning ticket on which one "Horn" symbol is revealed for one thousand dollars once shall win a regular prize award of one thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number five hundred ninety will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per eight million tickets sold in the following prize categories should be as follows:
(a) Forty tickets winning one thousand dollars once to win one thousand dollars;
(b) Seventy tickets winning one hundred dollars five times to win five
hundred dollars; and
(c) Seventy tickets winning five hundred dollars once to win five hundred dollars.
(3) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:
(a) Twenty-five tickets winning twenty dollars five times to win one hundred dollars;
(b) Thirty tickets winning one hundred dollars once to win one hundred dollars;
(c) One hundred tickets winning five dollars four times and ten dollars three times to win fifty dollars;
(d)Fifty-five tickets winning ten dollars five times to win fifty dollars;
(e) One hundred tickets winning fifty dollars once to win fifty dollars;
(f)Five hundred tickets winning two dollars five times, three dollars once and seven dollars once to win twenty dollars;
(g) Five hundred tickets winning twenty dollars once to win twenty dollars;
(h) Five hundred tickets winning one dollar five times, two dollars once and three dollars once to win ten dollars;
(i) Two hundred fifty tickets winning two dollars five times to win ten dollars;
(j) Two hundred fifty tickets winning ten dollars once to win ten dollars;
(k) Five hundred tickets winning two dollars once and three dollars once to win five dollars;
(l) One thousand tickets winning one dollar five times to win five dollars;
(m) Five hundred tickets winning five dollars once to win five dollars;
(n) Two thousand tickets winning one dollar three times to win three dollars;
(o) Two thousand tickets winning three dollars once to win three dollars;
(p) Eight thousand tickets winning two dollars once to win two dollars;
(q) Eight thousand tickets winning one dollar two times to win two dollars; and
(r) Seventeen thousand tickets winning one dollar once to win one dollar.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G)Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number five hundred ninety shall be accomplished in a manner, which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number five hundred ninety is sold or deemed sold in accordance with this rule and the covering material over any of the play symbols and prize values has been removed, the holder shall be deemed to have drawn the play symbols and prize values on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number five hundred ninety in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I)Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number five hundred ninety void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or
if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number five hundred ninety.
(1) The director shall conduct game rule number five hundred ninety in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number five hundred ninety. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number five hundred ninety used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number five hundred ninety and these elements may be given names or titles chosen by the commission.
