145-2-44                      Selection of payment plan.

 

 

For effective benefit dates, or applications for benefits received, on or after September 16, 1998, a contributor who at the time of retirement under section 145.32, 145.33, 145.331, 145.34, 145.38, 145.384, or 145.46 of the Revised Code, is married  shall receive a retirement benefit under payment plan A unless:

 

(A)   The spouse consents on a form provided by the public employees retirement system that the spouse is aware that the contributor has selected a payment plan other than plan A or plan A and a partial lump sum option payment under division (B)(3) of section 145.46 of the Revised Code; or

 

(B)   The public employees retirement board waives the requirement of a spousal consent in accordance with rule 145-1-70 of the Administrative Code.
