    This rule is being filed to fulfill the requirements of Ohio Revised Code (ORC)

    119.032 for 5-year rule review. This rule also incorporates requirements to address portions of SB 265. SB265 requires only certain air contaminant sources to obtain a permit-to-install. This requirement is being incorporated into paragraph (I). New rule 3745-31-33 incorporates provisions of SB265 which address activities that do not constitute beginning actual construction. The current definition in paragraph (R) is being amended to support these changes and the new rule.

    7.  If the rule is an AMENDMENT, then summarize the changes and the content of the proposed rule; If the rule type is RESCISSION, NEW or NO CHANGE, then summarize the content of the rule:

    The existing rule contains the definitions for OAC Chapter 3745-31, permits to install new sources. The following changes are part of this proposed amendment:

    1.  It was necessary to update references and the "Incorporation by reference" section to address the requirements of ORC 121.72 for providing information regarding the availability and effective dates of materials referenced in Chapter 3745-31.

    2.  Minor changes to comply with Ohio EPA and/or Legislative Service Commission's formatting and grammar.

    3.  Minor typographical corrections or incorrect cross-references.

    4.  Corrections to references of "unit" to comport with the defined term, "emissions unit".

    5.  Corrections to references of "temporary clean coal technology project" to comport with the defined term, "temporary clean coal technology demonstration project."

    6.  Remove the reference to OAC 3745-27-01, Solid & Infectious Waste Regulations, under paragraph (A). The reason for removing the reference is that during a 2001 amendment of Chapter 3745-31, the Division of Solid and Infectious Waste Management moved their permit-to-install rules from Chapter 3745-31 into a separate chapter; however, the reference to the definitions of OAC 3745-27-01 were inadvertently retained.

    7.  Paragraph (J): Correct the definition of "air contaminant source project." This definition was added in 2003 in preparation for an emissions threshold exemption that was drafted in OAC 3745-31-03. The agency did not propose the exemption rule at that time and we are now suggesting changes to the definition because portions of it are inapplicable.

    8.  Paragraph (R): incorporate changes to address "begin actual construction" requirements in Amended Substitute Senate Bill 256 of the 126th General Assembly (SB 265). (See OAC 3745-31-33 also)

    9.  Paragraph (KKK)(1): amend a reference to "any regulated NSR pollutant" to state "the given regulated NSR pollutant." This makes it clear that for non attainment NSR, a facility is considered major on a pollutant by pollutant basis only. This means that being major for one non attainment pollutant does not automatically make you major for another non attainment pollutant. This is

    consistent with the historical interpretation.

    10.  Paragraph (OOO)(1)(a)(iv): amend the language in reference to reflect Section 112 of the Clean Air Act. The current language may imply that modification is defined in Section 112. Section 112 does not refer to changes at a source as a modification but rather, changes at a facility subject to Section 112 result in "a new source or a reconstruction."

    11.  Paragraph (MMM): In several Chapter 3745-31 rules, we are suggesting draft language to clarify any confusion resulting from use of the term "registration status." Under Chapter 3745-35 sources may qualify to be placed on registration status in lieu of being issued a permit-to-operate. Chapter 31 has historically used the same terminology to refer to qualifying for "express permit-to-install" processing. However, under Chapter 3745-31, a permit-to-install is still issued. We are updating the language to create clarity.

    12.  Paragraph (PPP)(1)(b): Incorporate the new term "air contaminant source project" into the definition of modification to create clarity in the existing definition. The purpose of this paragraph is to determine if a project, rather than an individual source, will result in the consuming of increment or cause a violation of the NAAQS. Because we have not had a definition for "air contaminant source project" in this chapter, this paragraph could be interpreted incorrectly. This suggested change provides needed clarity and follows historic practice.

    13.  Paragraph (JJJJJ) was revised to include reference to "significant air contaminant source project."

    14.  Revised the definition of "air contaminant source" in paragraph (I) to address SB265 requirements that a permit-to-install can only be required for these types of sources.

    15.  Update and correct the administrative portion of the rule.

    121.71 to 121.74 of the Revised Code because the text or other material is generally available to persons who reasonably can be expected to be affected by the rule, provide an explanation of how the text or other material is generally available to those persons:

    This rule contains references to the Ohio Administrative Code (OAC) and Ohio Revised Code (ORC). While copies of these rules and statutes are generally available to the public through libraries and on-line sources, including the Ohio EPA website, ORC 121.76 (A) exempts such references from the provisions of ORC 121.71 through 121.75.

    This rule also contains references to the Code of Federal Regulations (CFR). These rules are generally available through libraries, Ohio EPA and U.S. EPA websites. CFR references have also been dated to reference the specific version of the rules. ORC 121.75 (D) exempts such references from the requirements of ORC 121.71 through 121.74.

    This rule also contains references to the United States Code (USC). These rules are generally available through libraries, Ohio EPA and Government Printing Office's websites.     This rule also contains references to the Clean Air Act (CAA), Resource Conservation and Recovery (RCRA), Federal Power Act and Energy Supply and Environmental

    Coordination Act of 1974. These acts are generally available through libraries, Ohio EPA and Government Printing Office's websites. References to these acts have also been dated to reference the specific version of the act. ORC 121.75 (D) exempts such references from the requirements of ORC 121.71 through 121.74.

    The rule also contains references to organizations and their documents and/or other materials utilized by regulators and impacted parties to determine or achieve compliance with these rules. These organizations and materials are commonly known and utilized by sources subject to environmental regulations. Copies of these documents are available in libraries and the websites for AIRS, Control Technology Center, and SICM. References to these organization's documents have also been dated to reference the specific version of the document. ORC 121.75 (D) exempts such references from the requirements of ORC 121.71 through 121.74.

    Environmental Rule Adoption/Amendment Form

    Pursuant to Am. Sub. H.B. 106 of the 121st General Assembly, prior to adopting a rule or an amendment to a rule dealing with environmental protection, or containing a component dealing with environmental protection, a state agency shall:

    Subject:     Ohio EPA DAPC Rulemaking - OAC Chapter 3745-31 Five Year Review

    Notice is hereby given that in accordance with Ohio Revised Code ("ORC")

    119.032 (5-year rule review), the Ohio Environmental Protection Agency, Division of Air Pollution Control ("DAPC") has reviewed  rules 3745-31-01 to 3745-31-32 contained in the Ohio Administrative Code ("OAC").    These rules are related to requirements for new sources, including permits-to-install air contaminant sources. Our preliminary review indicates that these rules continue to be necessary and are in need of modification. DAPC is also proposing new rule 3745-31-33.

    DAPC is proposing changes in order to:

    1.  Create consistency between definitions and terminology used throughout the chapter.

    2.  Update references to incorporated materials to comply with the requirements of ORC 121.72 for incorporated materials.

    3.  Update the administrative section of the rules (i.e., prior effective dates, authorizing and amplifying statutes).

    4.  Comply with the Ohio EPA and Legislative Service Commission's formatting and grammar requirements.

    5.  Clarify the intent from previous rule making actions.

    6.  Clarify requirements for portable sources.

    7.  Add two new exemptions in OAC 3745-31-03 to address "installed" internal combustion engines that are used for "locomotion" and "dynamometer"

    operations for "fully assembled motor vehicles."

    8.  Update the Auto body refinishing facility permit-by-rule (PBR) to include recently promulgated requirements contained in OAC 3745-21-18.

    9.  Update the Printing facility PBR to address changes in OAC 3745-21-07 that will be promulgated prior to this rule.

    10.  Address requirements in Amended Substitute Senate Bill 265 of the 126th General Assembly regarding the definition of "begin actual construction."

    A more detailed description of changes can be found in the attached synopsis documents.

    As part of the rule-making process, DAPC is required by Section 121.39 of the Ohio Revised Code to consult with organizations that represent political subdivisions, environmental interests, business interests, and others affected by the rules.     The DAPC is offering your organization the opportunity to comment on these rules before the division formally proposes them.
