    NOTICE OF PUBLIC HEARING

    Notice is hereby given that the Board of Building Standards will convene for a public hearing in accordance with Chapter 119 of the Revised Code, at 10:00 A.M., Friday, November 1, 2002, in Hearing Room #1, at 6606 Tussing Road, Reynoldsburg, Ohio. The purpose of the hearing is to consider rules of the Administrative Code identified as Amendments Group LXIII, proposed pursuant to Chapters 119, 3781, and 3791 of the Revised Code.

    Synopsis of the proposed rules:

    PART A

    Consider amending rule 4101:2-98-01 of the Administrative Code, Authorization of Industrialized Unit Manufacturers: to add or delete approved industrialized unit manufacturers authorized to manufacture approved units for placement in Ohio, and to reflect corrective changes to the listing.

    PART B

    re-insert model code language and maintain the exception for IU's; 4101:1-18-04.2 to correct the table; 4101:1-29-02.1 to correct the table; 4101:1-34-02 to add a definition of change of occupancy; 4101:1-34-06.1 to clarify the requirements for change of occupancy; 4101:1-34-08.1 to clarify the requirements for moved structures; 4101:1-34-09.1 to correct the code reference.

    Consider the following new, amended and rescinded rules of the Plumbing Code: 4101:3-4-03.1 to correct the table; 4101:3-13-02 to update the referenced standards and to make reference to the 2001 Supplement to the ICC codes.

    PART F

    Consider the following new, amended and rescinded rules of the Administrative Code contained in the Ohio Boiler Code: 4101:4-1-01 to change the definition of Unfired Pressure Vessel; 4101:4-1-02 to correct the address of ASME; 4101:4-3-02 to rescind the rule in accordance with HB 428; 4101:4-3-02 to add a new rule to clarify the assessment fee; 4101:4-3-03 to rescind the rule in accordance with HB 428; 4101:4-3-04 to rescind the rule in accordance with HB 428; 4101:4-3-06 to rescind the rule in accordance with HB 428; 4101:4-3-07 to rescind the rule in accordance with HB 428; 4101:4-3-12 to rescind the rule in accordance with HB 428; 4101:4-3-12 to enact a new rule which prescribes the examination requirements; 4101:4-3-13 to rescind the rule in accordance with HB 428; 4101:4-3-14 to rescind the rule in accordance with HB 428; 4101:4-3-15 to rescind the rule in accordance with HB 428; 4101:4-3-16 to rescind the rule in accordance with HB 428; 4101:4-3-19 to rescind the rule in accordance with HB 428; 4101:4-3-20 to rescind the rule in accordance with HB 428; 4101:4-3-25 to rescind the rule in accordance with HB 428; 4101:4-3-26 to rescind the rule in accordance with HB 428; 4101:4-5-02 to clarify that the boiler rules cannot be retroactively applied; 4101:4-7-03 to clarify what is needed to conduct an Ohio Special boiler review; 4101:4-7-04 to correct a deleted reference; 4101:4-11-02 to correct a deleted reference; 4101:4-15-05 to clarify what is needed to conduct an Ohio Special vessel review.

    PART G

    Consider the following new, amended and rescinded rules of the Elevator Code: 4101:5-1-02 to modify the definition of elevator in accordance with HB 428; 4101:5-1-06 to rescind the rule in accordance with HB 428; 4101:5-1-06 to enact a new rule which prescribes the exam for elevator inspectors; 4101:5-1-07 to rescind the rule in accordance with HB 428; 4101:5-1-07 to enact a new rule that addresses only the board assessment fee; 4101:5-3-01 to correct a spelling error; 4101:5-3-02 to clarify that the elevator rules cannot be retroactively applied.

    PART H

    Consider the following new, amended and rescinded rules of the Ohio Pressure Piping Systems Code: 4101:8-3-01 to update the referenced standards; 4101:8-3-03 to correct the OMC reference; 4101:8-3-05 to correct the OMC reference; 4101:8-3-09 to correct the reference to the Ohio Building Code; 4101:8-11-02 to correct a spelling error; 4101:8-13-01 to clarify the intent

    PART I

    Consider the following new, amended and rescinded rules of the Miscellaneous Rules: 4101:2-87-02 to correct the certification title; 4101:2-87-04 to correct the certification title; 4101:2-93-02 to correct the reference tot the Ohio Building Code.

    Information and copies of the public hearing draft may be obtained from the Board of Building Standards at 6606 Tussing Rd., Reynoldsburg, Ohio 43068. Copies of the draft will be mailed upon request to the Board.  Requested copies will be mailed when a pre-addressed, stamped envelope is furnished to the Board's office. Envelopes shall be 9 x 12 with first class postage of $2.21 each.

    The full text of the proposed rules are filed electronically with the Secretary of State, the Legislative Service Commission, the Joint Committee on Agency Rule Review, the Department of Aging, the Small and Developing Business Division as required in sections 119.03 and 121.24 of the Revised Code. Additionally, the Clerks of the 88 County Commissioners are notified of the filings as required by statute.
