    To allow STRS Ohio to provide secondary coverage to any health care plan enrollee who is employed in a public or private position and is eligible for health care coverage through his or her employer.

    The rule specifies conditions of eligibility for participation in the health care plans offered by STRS Ohio. The rule is being revised to state that as of January 1, 2009

    only secondary coverage will be available through STRS Ohio to any plan enrollee not eligible for Medicare who is employed and eligible for employer and medical prescription coverage at the same cost as full-time employees with the employer.

    Paragraph (D) has been modified and paragraph (E) has been added so that all service retirees are given the same eligibility standards for participation in STRS Ohio's voluntary health care program. (Paragraph designations have changed with the addition of new paragraph (E) in the refiled version of this rule.)

    With the passage of the Fair Minimum Wage Act of 2007, the federal minimum wage will increase on July 24, 2007. Paragraph (I)(3)(a) is being modified to ensure earnings test comply with federal thresholds.

    JCARR recommended a correction to a citation in paragraph (K) of the previously filed version of this rule. The language "The Social Security Amendments of 1965," 79 Stat. 301, 42 U.S.C.A. 1395j, as amended is being substituted with the words "medicare part B" in paragraph (L) of the refiled version.
