    NOTICE OF PUBLIC HEARING

    Notice is hereby given that the Board of Building Standards will convene for a public hearing in accordance with Chapter 119. of the Revised Code, at 10:00 A.M., Friday, November 2, 2007 in Hearing Room #1, at 6606 Tussing Road, Reynoldsburg, Ohio. The purpose of the hearing is to consider rules of the Administrative Code, identified as Amendments Group LXXIX of the Ohio Building Codes, proposed pursuant to Chapters 119., 3781., 3791., and 4104. of the Revised Code.

    Synopsis of the proposed rules:

    PART A

    Consider the following new rules of the Administrative Code certifying building departments to enforce the Residential Code of Ohio: 4101:2:81-37 village of Ostrander.

    PART B

    Consider the following amended and new rules of the Administrative Code certifying building departments to enforce the Ohio Building, Mechanical, and Plumbing Codes and the Residential Code of Ohio: 4101:2-70-19 city of Campbell; 4101:2-72-17 village of Chippewa Lake; 4101:2-72-48 village of Lodi; 4101:2-72-69 village of Newtown; 4101:2-72-75 village of Ontario; 4101:2-72-87 village of Seville; 4101:2-72-94 village of Spencer; 4101:2-73-04 village of Waynesville; 4101:2-73-08 city of Willowick; 4101:2-73-14 village of Haskins; 4101:2-73-21 village of Cygnet; 4101:2-74-11 Medina county; 4101:2-75-14 village of Plymouth; 4101:2-75-44 village of Yankee Lake; 4101:2-75-68 village of Ashville; 4101:2-76-29 village of Gloria Glens Park; 4101:2-76-39 city of Greenfield; 4101:2-77-29 village of New Holland; 4101:2-77-30 village of Baltimore; 4101:2-81-18 village of Utica.

    PART C

    Consider the following amended rule of the Ohio Building Code:  4101:1-35-01 to update the edition of the NFPA standards 13, 13D, 13R, 14, 70, and 72.

    PART D

    Consider  the  following  amended  rule  of  the  Ohio  Mechanical  Code:  4101:2-15-01  to  correct typographical errors and to update the edition of the NFPA standards 70 and 72.

    PART E

    Consider the following amended rule of the Ohio Plumbing Code:  4101:3-13-01 to update the edition of the NFPA standard 70.

    PART F

    Consider the following new, amended and rescinded rules of the Ohio Elevator Code, created, amended and rescinded as a result of the five year rule review: 4101:5-1-02 to delete the definition of chief, to add the definitions of ASME, freight elevator, owner or user, and superintendent, and to amend the definitions of board, division, and special inspector; 4101:5-1-03 to indicate that the enforcement of the elevator rules lies with the superintendent of the division and to clarify that the enforcement of construction provisions and building service equipment within hoistways, machine rooms, and control rooms is to be enforced by the building official having jurisdiction; 4101:5-1-04 to make a reference to the division of industrial compliance rules; 4101:5-1-05 to indicate that the adjudication order is issued by the superintendent of the division; 4101:5-1-06 to fix a typographical error and to make a reference to the division of industrial compliance rule; 4101:5-1-07 to clarify that the owner or the user is responsible for paying the assessment fee; 4101:5-3-02 to specify the division of the Revised Code that is referenced in rule and to clarify the text; 4101:5-3-03 to remove the reference to the outdated edition of the ASME A17.1 standard.

Electronic copies of the draft on compact disc will be mailed upon written request to the Board.

    The full text of the proposed rules are filed electronically with the Secretary of State, the Legislative Service Commission, the Joint Committee on Agency Rule Review, the Department of Aging, and the Small and Developing Business Division as required in sections 119.03 and 121.24 of the Revised Code. The required rule filing can be viewed on the Register of Ohio (http://www.registerofohio.state.oh.us). Additionally, the Clerks of the 88 County Commissioners are notified of the filings as required by statute.
