To clarify requirements and implement changes governing acceptable documents to be presented when applying for driving and identification (ID) credentials, including Safe ID credentials pursuant to the REAL ID Act of 2005, 49 U.S.C. 30301, legacy credentials, and nonrenewable (temporary resident) credentials, the Ohio Department of Public Safety, Bureau of Motor Vehicles, will conduct a public hearing for the purpose of soliciting comment on the following proposed changes to Chapter 4501:1-1, "Driver Licenses," of the Ohio Administrative Code:
Rescind and Adopt as new:
4501:1-1-21 (Acceptable identification to be submitted along with an application for a temporary instruction permit identification card, driver's license, commercial driver's license, motorcycle operator's license, or identification card) - It is proposed that this rule be simultaneously rescinded and adopted as new as more than fifty percent of its language has been revised to amend and clarify the number and types of documents that will be accepted along with an application to establish a person's identity, legal name, date of birth, legal presence in the United States, Ohio residency, and social security number.
Adoption:
4501:1-1-41 (Application and document requirements for the issuance of a safe driver's license and other safe credentials) - This rule is proposed to establish the documentation required to be presented along with an application for a person to be issued a safe driver's license or other safe credential in the state of Ohio.
4501:1-1-42 (Application and document requirements for the issuance of a legacy driver's license and other legacy credentials) - This rule is proposed to establish the documentation required to be presented along with an application for a person to be issued a legacy driver's license or other legacy credential in the state of Ohio.
4501:1-1-43 (Acceptable documents for nonrenewable credential) - This rule is proposed to establish the documentation required to be presented along with an application for a person to be issued a nonrenewable credential in the state of Ohio.
4501:1-1-44 (Acceptable documents to prove Ohio resident street address) - This rule is proposed to establish the documentation required for a person to provide evidence of Ohio residency.
Any persons affected by the proposed rescission and/or adoption of these rules may appear at the hearing and be heard in person, or by an attorney, or both, or may present their position, argument, or contention in writing. Persons may offer and examine witnesses and present evidence to show that the proposed changes will be unreasonable or unlawful.
