    OHIO DEPARTMENT OF JOB AND FAMILY SERVICES

    Pursuant to sections 5101.80 and 5107.05 and Chapter 119. of the Revised Code and section 5 of Amended Substitute Senate Bill 238 of the 126th General Assembly, the director of the Ohio Department of Job and Family Services gives notice of the department's intent to consider the amendment of the rules as identified below and of a public hearing thereon.

     

    Rule 5101:1-1-01, entitled: Temporary assistance for needy families (TANF) definitions, is being proposed for amendment to implement changes required due to the Deficit Reduction Act of 2005. This rule contains the definitions used in the TANF program and is being amended to add the definition of work eligible individual.

     

    Rule 5101:1-3-01 entitled: OWF: definitions of assistance group composition for work  participation rates, is being proposed for rescission and is being replaced by new rule 5101:1-3-01.

     

    Rule 5101:1-3-01 entitled: Ohio works first (OWF): Federal work participation rates, is being proposed for adoption in order to implement the TANF Reauthorization provision of the Deficit Reduction Act of 2005. This rule sets forth the requirements of all-family and two-parent assistance groups in order to meet the federal work participation rates. The federal work activities and the deeming provision are also contained within this rule.

     

    Rule 5101:1-3-12, entitled: OWF: work activity participation, is being proposed for rescission and is being replaced by new rule 5101:1-3-12.

     

    Rule 5101:1-3-12, entitled: Ohio works first (OWF): work activities, is being proposed for adoption in order to implement the new federal TANF regulations due to the Deficit Reduction Act of 2005. This rule defines work eligible individuals and sets forth the requirements of the self sufficiency contracts, hours of participation, good cause for non- cooperation and participation, supervision of work activities, verification of hours of participation and deeming of hours.

     

    Rule 5101:1-3-12.1, entitled Unsubsidized employment, is being proposed for adoption in order to implement the new federal TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of unsubsidized employment as a work activity for OWF.

     

    Rule 5101:1-3-12.2, entitled Subsidized public and private employment, is being proposed for adoption to implement the new federal TANF regulations due to the Deficit

     

     

     

     

     

    Reduction Act of 2005. This rule sets forth the definitions and requirements of subsidized employment as a work activity for OWF.

    Rule 5101:1-3-12.3, entitled Work experience program (WEP), is being proposed for adoption to implement the new federal TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of WEP as a work activity for OWF.

    Rule 5101:1-3-12.4, entitled On-the-job training (OJT), is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of OJT as a work activity for OWF.

    Rule 5101:1-3-12.5, entitled Job search and job readiness, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of job search and job readiness as a work activity for OWF.

    Rule 5101:1-3-12.6, entitled Community service, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of community service as a work activity for OWF.

    Rule 5101:1-3-12.7, entitled Vocational education, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of vocational education as a work activity for OWF.

    Rule 5101:1-3-12.8, entitled Providing child care services to an individual who is participating in a community service program, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of providing child care services to an individual who is participating in a community service program as a work activity for OWF.

    Rule 5101:1-3-12.9, entitled Job skills training directly related to employment, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definition and requirements of job skills training directly related to employment as a work activity for OWF.

    Rule 5101:1-3-12.10, entitled Education directly related to employment in the case of a recipient who has not received a high school diploma or a certificate of high school equivalency, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definition and requirements of education directly related to employment in the case of a recipient who has not received a high school diploma or certificate of high school equivalency as a work activity for OWF.

    Rule 5101:1-3-12.11, entitled Secondary school or program leading to a certificate of  general equivalence for an individual who has not completed secondary school or  received a certificate, is being proposed for adoption to implement the new TANF regulations due to the Deficit Reduction Act of 2005. This rule sets forth the definitions and requirements of secondary school or program leading to a certificate of general equivalence for an individual who has not completed secondary school or received a certificate as a work activity for OWF.

    Rule 5101:1-3-12.12, entitled Alternative activities, is being proposed for adoption to implement alternative activities for work participation purposes. This rule sets forth the definition and requirements of alternative activities as a work activity for OWF.

    Rule 5101:1-3-14, entitled Ohio works first (OWF): penalties, is being proposed for adoption to implement changes required due to the Deficit Reduction Act of 2005 .This rule contains policy to address penalty situations in the OWF program.

    Rule 5101:1-3-15, entitled Ohio works first (OWF): penalties and three-tier sanctions, is being proposed for rescission. This rule is being by replaced new rules 5101:1-3-14 and 5101:1-3-15.

    Rule 5101:1-3-15, entitled Ohio works first (OWF): three tier sanction, is being proposed for adoption to implement changes required due to the Deficit Reduction Act of 2005. This rule contains the three tier sanction process in the OWF program

    Rule 5101:1-3-15.1, entitled Transition of Ohio works first (OWF) assistance groups  under sanction and penalties, is being proposed for adoption to implement changes required due to the Deficit Reduction Act of 2005. This rule contains the policy for the treatment of assistance groups and individuals who are under a penalty or sanction prior to October 1, 2006.

    Rule 5101:1-3-16, entitled The subsidized employment program and PRC employer  subsidy program, is being proposed for rescission and is being replaced by new rule 5101:1-3-16.

    Rule 5101:1-3-16, entitled The prevention, retention and contingency (PRC) employer  subsidy, is being proposed for adoption. This rule contains the policy addressing the PRC employer subsidy.

    Rule 5101:1-23-10, entitled Ohio works first (OWF): standard filing unit, is being proposed for amendment to implement changes required due to the Deficit Reduction Act of 2005. The changes to this rule involve the removal of language allowing individuals to receive OWF after the imposition of a sanction and some penalties.

Either written or oral testimony will be taken at the public hearing. Additionally, written comments submitted  or postmarked no later than the date of the public hearing will be treated as testimony.
