    The technical amendments to this rule provide for the date of updated versions of the Combined and Member-Directed Plan Documents that will be dated Jan. 1, 2017.

    The new amendment date of Jan. 1, 2017 is amended into this rule for new plan document amendments that will be effective on the same date this rule becomes effective.

    121.71 to 121.74 of the Revised Code because the text or other material is generally available to persons who reasonably can be expected to be affected by the rule, provide an explanation of how the text or other material is generally available to those persons:

    This rule references sections of the Ohio Revised and/or Administrative Codes. The ORC and OAC are generally available in libraries and on the internet. This rule also contains references to the Combined and/or Member-Directed Plan Documents.

    This rule defines the most recent versions of the plan documents and provides that they are not incorporated into a rule that references them.

    Ohio Revised Code 121.76 exempts agencies from filing copies of the codes cited in the text of a rule. OAC 145-1-15(D) and 145-1-81 provide that referenced documents are not incorporated into Chapters 145-1 through 145-4 of the OAC. Complete and accurate copies of the current plan documents are available at www.opers.org/about/legal.
