NOTICE OF PUBLIC HEARING

 

 

 

In acco?dance with Chapte? 119 of the Revised Code, the Public Health Council will conduct public hea?ings on Thursday, Octobe? 12, 2006 beginning at 10:00 a.m. to consider the following two proposals:

 

to rescind rule 3701-47-03 of the Ohio Administrative Code (O.A.C.) pertaining to  abo?tion reporting forms.  Am. Sub. H.B. 530 of the 126th General Assembly repealed paragraph (A)(2) of Section 3701.341 of the Revised Code, which requi?ed the Public Health Council to adopt a ?ule relating to abortion reporting forms. Because Am. Sub. H.B. 530 incorporated the language f?om rule 3701- 47-03 of the O.A.C. into new Section 3701.79 of the Revised Code, the PHC is no longer charged with adopting such a rule; and

 

to rescind rule 3701:1-50-08 of the O.A.C.  This rule pertains to labeling and packaging requirements for radioactive mate?ials, previously approved by the United States Nuclea? Regulato?y Commission (N.R.C.). ODH proposes to rescind this rule because of a change in federal law (10 C.F.R. 71.13). The

C.F.R. section is no longe? applicable to the state's program and applies only to

the U.S. N.R.C.

At the hea?ings, persons affected by the p?oposed actions may appear and be heard in person, by their attorney or both; may p?esent their positions, a?guments, or contentions o?ally or in W?iting; may offe? witnesses; and may p?ese?t evidence tending to show that the proposed rescissions, if effectuated, will be unreasonable or unlawful.
