    NOTICE OF PUBLIC RULES HEARING

    In accordance with Chapter 119. of the Revised Code (R.C.), the Director of the Department of Health is proposing changes to the following Ohio Administrative Code (O.A.C.) rules:

     

    O.A.C. Chapter 3701-63 - Appeal of Denial/Revocation of LTC Facility Certification

     

    By authority of R.C. 119.04 and to satisfy five-year review requirements, the Director proposes to amend O.A.C. rules 3701-63-01, which sets forth the process for Medicaid certification by a long-term care facility, and rule 3701-63-02, which sets forth the process for ODH to issue a plan of correction to a nursing facility, and the process by which a facility may seek informal review of those deficiencies. The rules are amended to update Revise Code cross references and to replace the term "facility for the mentally retarded" with "facility for individuals with intellectual disabilities."

     

    Previously Announced Rules on 10/17/2016 Agenda

     

    ODH previously announced that two other rules will be open for public comment on 10/17/2016: 3701:1-38-01 - "Definitions" from the Chapter on General Radiation Protection Standards for Sources of Radiation; and

    3701:1-40-17 - "Financial assurance and record keeping for decommissioning" from the Chapter on Radiation Protection Requirements.

     

    Hearing and Comment Procedure:

     

    At the hearing, people affected by the proposed actions may appear and be heard in person, by an attorney or both;  may present their positions, arguments, or contentions orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.  To aid in getting visitors through building security, both persons intending to testify at the  hearing and those simply intending to observe are encouraged to pre-register by writing to the Office of the General Counsel, Ohio Department of Health, 246 North High Street, Columbus, Ohio 43215, by phoning (614) 466-4882, or by sending an e-mail to  odhrules@odh.ohio.gov.  Copies of the proposed rules will be available on the Register of Ohio website:  http://www.registerofohio.state.oh.us/jsps/publicdisplayrules/searchRuleNumber.jsp approximately a half day after the rules are filed, or from the Office of the General Counsel, Ohio Department of Health (address listed above).
