3770:1-9-193. Game rule number one hundred ninety-three
-
(A) Title and term. Ohio lottery commission game rule number one hundred ninety-three, "Triple Black 777," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number one hundred ninety-three.
(B) General design.
(1) Game rule number one hundred ninety-three is a reveal a symbol game with a "multiplier" feature, and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire play area to reveal fifteen games. Each game will consist of one number and a corresponding prize award. If a player reveals a "Black 7" symbol within a game, the player wins the corresponding prize award shown for that game. If a player reveals a "Triple 777" symbol within a game, the player wins triple the corresponding prize award shown for that game. If a player reveals a "TB7" symbol within a game, the player wins all fifteen prizes shown for that game. If a "Black 7" symbol is revealed within a game and the corresponding prize value revealed is a "TPD" symbol, the player wins five thousand five hundred dollars automatically, and, upon the filing of a valid claim at an Ohio lottery commission office, shall also automatically be entered in the Top Prize Drawing ("TPD") for a chance to win seventy-seven thousand seven hundred seventy-seven dollars. The Top Prize Drawing shall be conducted in accordance with Ohio lottery rules and procedures established and approved by the director.
(3) The only "prize values" which shall appear on a ticket in game rule number one hundred ninety-three are: one dollar, two dollars, three dollars, four dollars, five dollars, six dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, the "TPD" symbol corresponding to a prize value of five thousand five hundred dollars, ten thousand dollars, and seventy-seven thousand seven hundred seventy-seven dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number one hundred ninety-three shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number one hundred ninety-three shall be five dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be two types of prizes in game rule one hundred thirty nine, a "regular prize award" and a "TPD" prize award.
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: five dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars, five thousand five hundred dollars, ten thousand dollars, and seventy-seven thousand seven hundred seventy-seven dollars. Each ticket in game rule number one hundred ninety-three shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in five games for one dollar shall win a regular prize award of five dollars;
(b) Holder of a valid winning ticket on which a "Triple 777" symbol is revealed one game for one dollar tripled and a "Black 7" symbol is revealed in one game for two dollars shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for five dollars shall win a regular prize award of five dollars;
(d) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in two games for five dollars shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in five games for two dollars shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for one dollar shall win a regular prize award of ten dollars;
(g) Holder of a valid winning ticket on which a "Triple 777" symbol is revealed in one game for two dollars tripled and a "Black 7" symbol is revealed in two games for two dollars shall win a regular prize award of ten dollars;
(h) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for one dollar, a "Black 7" symbol is revealed in two games for two dollars, and a "Black 7" symbol is revealed in one game for five dollars shall win a regular prize award of ten dollars;
(i) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for ten dollars shall win a regular prize award of ten dollars;
(j) Holder of a valid winning ticket on which a "Triple 777" symbol is revealed in one game for five dollars tripled shall win a regular prize award of fifteen dollars;
(k) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for five dollars and a "Black 7" symbol is revealed in one game for ten dollars shall win a regular prize award of fifteen dollars;
(l) Holder of a valid winning ticket on which a "TB7" symbol is revealed in one game for one dollars fifteen times shall win a regular prize award of fifteen dollars;
(m) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in fifteen games for one dollar shall win a regular prize award of fifteen dollars;
(n) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for fifteen dollars shall win a regular prize award of fifteen dollars;
(o) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in four games for five dollars shall win a regular prize award of twenty dollars;
(p) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for one dollar, a "Black 7" symbol is revealed in two games for two dollars, and a "Triple 777" symbol for five dollars tripled shall win a regular prize award of twenty dollars;
(q) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for one dollar and a "Black 7" symbol is revealed in five games for two dollars shall win a regular prize award of twenty dollars;
(r) Holder of a valid winning ticket on which a "TB7" symbol is revealed in one game for one dollar ten times and two dollars five times shall win a regular prize award of twenty dollars;
(s) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for twenty dollars shall win a regular prize award of twenty dollars;
(t) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for four dollars and a "Black 7" symbol is revealed in two games for five dollars shall win a regular prize award of fifty dollars;
(u) Holder of a valid winning ticket on which a "TB7" symbol is revealed in one game for two dollars ten times and six dollars five times shall win a regular prize award of fifty dollars;
(v) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for five dollars shall win a regular prize award of fifty dollars;
(w) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in six games for five dollars and a "Black 7" symbol is revealed in two games for ten dollars shall win a regular prize award of fifty dollars;
(x) Holder of a valid winning ticket on which a "Triple 777" symbol is revealed in one game for ten dollars tripled and a "Black 7" symbol is revealed in one game for twenty dollars shall win a regular prize award of fifty dollars;
(y) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for twenty dollars and a "Black 7" symbol is revealed in ten games for three dollars shall win a regular prize award of fifty dollars;
(z) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in six games for five dollars, a "Black 7" symbol is revealed in eight games for two dollars, and a "Black 7" symbol is revealed in one game for four dollars shall win a regular prize award of fifty dollars;
(aa) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for fifty dollars shall win a regular prize award of fifty dollars;
(bb) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for ten dollars shall win a regular prize award of one hundred dollars;
(cc) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for one hundred dollars shall win a regular prize award of one hundred dollars;
(dd) Holder of a valid winning ticket on which a "Triple 777" symbol is revealed in one game for twenty dollars tripled and a "Black 7" symbol is revealed in four games for ten dollars shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in four games for five dollars, a "Black 7" symbol is revealed in one game for ten dollars, a "Black 7" symbol is revealed in one game for twenty dollars, and a "Black 7" symbol is revealed in one game for fifty dollars shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which a "TB7" symbol is revealed in one game for two dollars ten times, five dollars two times, ten dollars two times, and fifty dollars once shall win a regular prize award of one hundred dollars;
(gg) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for fifty dollars shall win a regular prize award of five hundred dollars;
(hh) Holder of a valid winning ticket on which a "TB7" symbol is revealed in one game for fifty dollars four times and one hundred dollars once shall win a regular prize award of five hundred dollars;
(ii) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for five hundred dollars shall win a regular prize award of five hundred dollars;
(jj) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in five games for one hundred dollars shall win a regular prize award of five hundred dollars;
(kk) Holder of a valid winning ticket on which a "TB7" symbol is revealed in one game for twenty dollars ten times, fifty dollars four times, and one hundred dollars once shall win a regular prize award of five hundred dollars;
(ll) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for one thousand dollars shall win a regular prize award of one thousand dollars;
(mm) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for one hundred dollars shall win a regular prize award of one thousand dollars;
(nn) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in two games for five hundred dollars shall win a regular prize award of one thousand dollars;
(oo) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for five hundred dollars shall win a regular prize award of five thousand dollars;
(pp) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one games for five thousand dollars shall win a regular prize award of five thousand dollars;
(qq) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game and a "TPD" prize symbol is revealed for five thousand five hundred dollars shall win a regular prize award of five thousand five hundred dollars, and upon the filing of a valid claim at an Ohio lottery commission office, shall automatically be entered into the Top Prize Drawing ("TPD") for a chance to win a top prize of seventy-seven thousand seven hundred seventy-seven dollars;
(rr) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in ten games for one thousand dollars shall win a regular prize award of ten thousand dollars;
(ss) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in two games for five thousand dollars shall win a regular prize award of ten thousand dollars;
(tt) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for ten thousand dollars shall win a regular prize award of ten thousand dollars; and
(uu) Holder of a valid winning ticket on which a "Black 7" symbol is revealed in one game for seventy-seven thousand seven hundred seventy-seven dollars shall win a regular prize award of seventy-seven thousand seven hundred seventy-seven dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number one hundred ninety-three will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using techniques in order that the following occur:
(1) Combinations winning each prize award are distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that the number of winning tickets per six million tickets sold in the following prize categories should be as follows:
(a) Six tickets with the winning prize combination as set forth in paragraph (D)(2)(uu) of this rule to win seventy-seven thousand seven hundred seventy-seven dollars;
(b) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(tt) of this rule to win ten thousand dollars;
(c) Two tickets with the winning prize combination as set forth in paragraph (D)(2)(ss) of this rule to win ten thousand dollars;
(d) Four tickets with the winning prize combination as set forth in paragraph (D)(2)(rr) of this rule to win ten thousand dollars;
(e) Thirty tickets with the winning prize combination as set forth in paragraph (D)(2)(qq) of this rule to win five thousand five hundred dollars and upon the filing of a valid claim at an Ohio lottery commission office, being automatically entered into the Top Prize Drawing for a chance to win a top prize of seventy-seven thousand seven hundred seventy-seven dollars;
(f) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(pp) of this rule to win five thousand dollars;
(g) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(oo) of this rule to win five thousand dollars;
(h) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(nn) of this rule to win one thousand dollars;
(i) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(mm) of this rule to win one thousand dollars;
(j) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ll) of this rule to win one thousand dollars;
(k) Two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(kk) of this rule to win five hundred dollars;
(l) One hundred twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(jj) of this rule to win five hundred dollars;
(m) Fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(ii) of this rule to win five hundred dollars:
(n) Two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(hh) of this rule to win five hundred dollars;
(o) One hundred twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(gg) of this rule to win five hundred dollars;
(p) Six thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(ff) of this rule to win one hundred dollars;
(q) One thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ee) of this rule to win one hundred dollars;
(r) Three thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(dd) of this rule to win one hundred dollars;
(s) One thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(cc) of this rule to win one hundred dollars;
(t) Three thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(bb) of this rule to win one hundred dollars;
(u) One thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(aa) of this rule to win fifty dollars;
(v) Three thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(z) of this rule to win fifty dollars;
(w) Four thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(y) of this rule to win fifty dollars;
(x) Nine thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(x) of this rule to win fifty dollars;
(y) Three thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(w) of this rule to win fifty dollars;
(z) Six thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(v) of this rule to win fifty dollars;
(aa) Nine thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(u) of this rule to win fifty dollars;
(bb) Four thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(t) of this rule to win fifty dollars;
(cc) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(s) of this rule to win twenty dollars;
(dd) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(r) of this rule to win twenty dollars;
(ee) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(q) of this rule to win twenty dollars;
(ff) Ninety thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(p) of this rule to win twenty dollars;
(gg) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(o) of this rule to win twenty dollars;
(hh) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(n) of this rule to win fifteen dollars;
(ii) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(m) of this rule to win fifteen dollars;
(jj) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win fifteen dollars;
(kk) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win fifteen dollars;
(ll) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win fifteen dollars;
(mm) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win ten dollars;
(nn) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win ten dollars;
(oo) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win ten dollars;
(pp) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win ten dollars;
(qq) Sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win ten dollars;
(rr) Thirty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win ten dollars;
(ss) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win five dollars;
(tt) Three hundred sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win five dollars; and
(uu) Two hundred forty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win five dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Imprinting of prize awards on all tickets issued in game rule number one hundred ninety-three shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number one hundred ninety-three is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number one hundred ninety-three in which the ticket was sold.
(3) The Top Prize Drawing to award one top prize of one hundred fifty thousand dollars shall take place in accordance with rules and procedures established and approved by the director, and specifically, rule 3770:1-6-05 of the Administrative Code governing "Prize drawings" and rule 3770:1-6-06 of the Administrative Code governing "Special lottery drawings." Such drawings shall be held on dates determined and announced by the director, however, the earliest Top Prize Drawing date shall be one hundred eighty-one days from the game close date or when all tickets winning a prize value corresponding with a "TPD" symbol have been claimed, whichever is earlier.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number one hundred ninety-three void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number one hundred ninety-three.
(1) The director shall conduct game rule number one hundred ninety-three in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number one hundred ninety-three. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number one hundred ninety-three used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number one hundred ninety-three and these elements may be given names or titles chosen by the commission.
