3770:1-9-221. Game rule number two hundred twenty-one
-
(A) Title and term. Ohio lottery commission game rule number two hundred twenty-one, "Frosty Fun" shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number two hundred twenty-one.
(B) General design.
(1) Game rule number two hundred twenty-one is a key number match game and is generally known as an "instant lottery."
(2) Holders of valid tickets will remove the covering off the entire play area to reveal two "Winning Numbers," ten "Your Numbers" and ten corresponding prize values. If any one or both of "Your Numbers" matches the "Winning Numbers," the player wins the corresponding prize. If the player reveals a "Star" symbol in any of the "Your Numbers" play spots, the player wins the corresponding prize automatically. If the player reveals a "Snowman" symbol in any of the "Your Numbers" play spots, the player wins five times the prize shown automatically. There are ten chances to win on each ticket, and a player may win up to ten times on one ticket.
(3) The only "prize values" which shall appear on a ticket in game rule number two hundred twenty-one are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, two thousand five hundred dollars and twenty-five thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number two hundred twenty-one shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number two hundred twenty-one shall be two dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number two hundred twenty-one called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, fifty dollars, one hundred dollars, two thousand five hundred dollars and twenty-five thousand dollars. Each ticket in game rule number two hundred twenty-one shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for one dollar two times shall win a regular prize award of two dollars;
(b) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for two dollars once shall win a regular prize award of two dollars;
(c) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" or a "Star" symbol is revealed in three of the "Your Numbers" play spots, or any combination thereof, for one dollar three times shall win a regular prize award of three dollars;
(d) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for two dollars once and one dollar once shall win a regular prize award of three dollars;
(e) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for three dollars once shall win a regular prize award of three dollars;
(f) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by four of "Your Numbers" or a "Star" symbol is revealed in four of the "Your Numbers" play spots, or any combination thereof, for one dollar four times shall win a regular prize award of four dollars;
(g) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for four dollars once shall win a regular prize award of four dollars;
(h) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for two dollars two times shall win a regular prize award of four dollars;
(i) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for one dollar once and three dollars once shall win a regular prize award of four dollars;
(j) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for one dollar once and four dollars once shall win a regular prize award of five dollars;
(k) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for one dollar five times shall win a regular prize award of five dollars;
(l) Holder of a valid winning ticket on which a "Snowman" symbol is revealed in one of the "Your Numbers" play spots for one dollar times five shall win a regular prize award of five dollars;
(m) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for two dollars once and three dollars once shall win a regular prize award of five dollars;
(n) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for five dollars once shall win a regular prize award of five dollars;
(o) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by three of "Your Numbers" or a "Star" symbol is revealed in three of the "Your Numbers" play spots, or any combination thereof, for two dollars once and four dollars two times shall win a regular prize award of ten dollars;
(p) Holder of a valid winning ticket on which a "Snowman" symbol is revealed in one of the "Your Numbers" play spots for two dollars times five shall win a regular prize award of ten dollars;
(q) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for five dollars two times shall win a regular prize award of ten dollars;
(r) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for one dollar ten times shall win a regular prize award of ten dollars;
(s) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by five of "Your Numbers" or a "Star" symbol is revealed in five of the "Your Numbers" play spots, or any combination thereof, for two dollars five times shall win a regular prize award of ten dollars;
(t) Holder of a valid winning ticket on which one of the "Winning Numbers" are matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for ten dollars once shall win a regular prize award of ten dollars;
(u) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by six of "Your Numbers" or a "Star" symbol is revealed in six of the "Your Numbers" play spots, or any combination thereof, for two dollars five times and ten dollars once shall win a regular prize award of twenty dollars;
(v) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for two dollars ten times shall win a regular prize award of twenty dollars;
(w) Holder of a valid winning ticket on which a "Snowman" symbol is revealed in one of the "Your Numbers" play spots for four dollars times five shall win a regular prize award of twenty dollars;
(x) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars once shall win a regular prize award of twenty dollars;
(y) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for five dollars ten times shall win a regular prize award of fifty dollars;
(z) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by eight of "Your Numbers" or a "Star" symbol is revealed in eight of the "Your Numbers" play spots, or any combination thereof, for ten dollars three times and four dollars five times shall win a regular prize award of fifty dollars;
(aa) Holder of a valid winning ticket on which a "Snowman" symbol is revealed in one of the "Your Numbers" play spots for ten dollars times five shall win a regular prize award of fifty dollars;
(bb) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for two dollars five times, twenty dollars once, and five dollars four times shall win a regular prize award of fifty dollars;
(cc) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for fifty dollars once shall win a regular prize award of fifty dollars;
(dd) Holder of a valid winning ticket on which a "Snowman" symbol is revealed in one of the "Your Numbers" play spots for twenty dollars times five shall win a regular prize award of one hundred dollars;
(ee) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by eight of "Your Numbers" or a "Star" symbol is revealed in eight of the "Your Numbers" play spots, or any combination thereof, for twenty dollars two times and ten dollars six times shall win a regular prize award of one hundred dollars;
(ff) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for ten dollars ten times shall win a regular prize award of one hundred dollars;
(gg) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by two of "Your Numbers" or a "Star" symbol is revealed in two of the "Your Numbers" play spots, or any combination thereof, for fifty dollars two times shall win a regular prize award of one hundred dollars;
(hh) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by seven of "Your Numbers" or a "Star" symbol is revealed in seven of the "Your Numbers" play spots, or any combination thereof, for fifty dollars once, twenty dollars once, ten dollars two times, five dollars once, four dollars once and one dollar once shall win a regular prize award of one hundred dollars;
(ii) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for one hundred dollars once shall win a regular prize award of one hundred dollars;
(jj) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for two thousand five hundred dollars once shall win a regular prize award of two thousand five hundred dollars;
(kk) Holder of a valid winning ticket on which one or both of the "Winning Numbers" are matched by ten of "Your Numbers" or a "Star" symbol is revealed in ten of the "Your Numbers" play spots, or any combination thereof, for two thousand five hundred dollars ten times shall win a regular prize award of twenty-five thousand dollars; and
(ll) Holder of a valid winning ticket on which one of the "Winning Numbers" is matched by one of "Your Numbers" or a "Star" symbol is revealed in one of the "Your Numbers" play spots for twenty-five thousand dollars once shall win a regular prize award of twenty-five thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number two hundred twenty-one will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per five million tickets sold should be as follows:
(a) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(ll) of this rule to win twenty-five thousand dollars;
(b) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(kk) of this rule to win twenty-five thousand dollars;
(c) Twenty tickets with the winning prize combination as set forth in paragraph (D)(2)(jj) of this rule to win two thousand five hundred dollars;
(d) Two hundred fifty tickets with the winning prize combination as set forth in paragraph (D)(2)(ii) of this rule to win one hundred dollars;
(e) Five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(hh) of this rule to win one hundred dollars;
(f) Five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(gg) of this rule to win one hundred dollars;
(g) Five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(ff) of this rule to win one hundred dollars;
(h) One thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(ee) of this rule to win one hundred dollars;
(i) Two thousand three hundred seventy-five tickets with the winning prize combination as set forth in paragraph (D)(2)(dd) of this rule to win one hundred dollars;
(j) Six hundred twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(cc) of this rule to win fifty dollars;
(k) Two thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(bb) of this rule to win fifty dollars;
(l) Five thousand six hundred twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(aa) of this rule to win fifty dollars;
(m) Two thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(z) of this rule to win fifty dollars;
(n) Two thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(y) of this rule to win fifty dollars;
(o) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(x) of this rule to win twenty dollars;
(p) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(w) of this rule to win twenty dollars;
(q) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(v) of this rule to win twenty dollars;
(r) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(u) of this rule to win twenty dollars;
(s) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(t) of this rule to win ten dollars;
(t) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(s) of this rule to win ten dollars;
(u) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(r) of this rule to win ten dollars;
(v) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(q) of this rule to win ten dollars;
(w) Thirty-seven thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(p) of this rule to win ten dollars;
(x) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(o) of this rule to win ten dollars;
(y) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(n) of this rule to win five dollars;
(z) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(m) of this rule to win five dollars;
(aa) Fifty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win five dollars;
(bb) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win five dollars;
(cc) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win five dollars;
(dd) Twenty-five thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win four dollars;
(ee) Twenty-five thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win four dollars;
(ff) Twelve thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win four dollars;
(gg) Thirty-seven thousand five hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win four dollars;
(hh) Fifty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win three dollars;
(ii) One hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win three dollars;
(jj) One hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win three dollars;
(kk) Two hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win two dollars; and
(ll) Four hundred thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win two dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number two hundred twenty-one shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number two hundred twenty-one is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number two hundred twenty-one in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number two hundred twenty-one void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number two hundred twenty-one.
(1) The director shall conduct game rule number two hundred twenty-one and any promotions associated therewith in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game and any promotions associated therewith. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number two hundred twenty-one. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number two hundred twenty-one used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number two hundred twenty-one and these elements may be given names or titles chosen by the commission.
