3770:1-9-239. Game rule number two hundred thirty-nine
-
(A) Title and term. Ohio lottery commission game rule number two hundred thirty-nine, "$50,000 Winning Numbers," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number two hundred thirty-nine.
(B) General design.
(1) Game rule number two hundred thirty-nine is a key number match game and is generally known as an "instant lottery."
(2) The player will remove the covering over the entire play area to reveal twelve "Games." Each "Game" will contain three numbers and a corresponding prize. If the player matches two numbers in the same "Game," the player wins the corresponding prize in the "Game." If the player matches all three numbers in the same "Game," the player wins triple the corresponding prize in the "Game." If a "Money" symbol is revealed in a "Game," the player automatically wins five times the corresponding prize in the "Game." There are twelve chances to win on each ticket. The player may win up to twelve times.
(3) The only "prize values" which shall appear on a ticket in game rule number two hundred thirty-nine are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, thirty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars and fifty thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number two hundred thirty-nine shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number two hundred thirty-nine shall be three dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number two hundred thirty-nine called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: three dollars, five dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, five hundred dollars, one thousand dollars, five thousand dollars and fifty thousand dollars. Each ticket in game rule number two hundred thirty-nine shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for one dollar tripled shall win a regular prize award of three dollars
(b) Holder of a valid winning ticket on which two of the numbers are matched in three "Games" for one dollar once shall win a regular prize award of three dollars;
(c) Holder of a valid winning ticket on which two of the numbers are matched in two "Games" for two dollars once and one dollar once shall win a regular prize award of three dollars;
(d) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for three dollars once shall win a regular prize award of three dollars;
(e) Holder of a valid winning ticket on which two of the numbers are matched in five "Games" for one dollar five times shall win a regular prize award of five dollars;
(f) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for one dollar times five shall win a regular prize award of five dollars;
(g) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for one dollar tripled and on which two of the numbers are matched in one "Game" for two dollars shall win a regular prize award of five dollars;
(h) Holder of a valid winning ticket on which two of the numbers are matched in two "Games" for four dollars once and one dollar once shall win a regular prize award of five dollars;
(i) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for five dollars once shall win a regular prize award of five dollars;
(j) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for one dollar ten times shall win a regular prize award of ten dollars;
(k) Holder of a valid winning ticket on which two of the numbers are matched in two "Games" for five dollars two times shall win a regular prize award of ten dollars;
(l) Holder of a valid winning ticket on which two of the numbers are matched in five "Games" for two dollars five times shall win a regular prize award of ten dollars;
(m) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for two dollars times five shall win a regular prize award of ten dollars;
(n) Holder of a valid winning ticket on which two of the numbers are matched in seven "Games" for one dollar six times and four dollars once shall win a regular prize award of ten dollars;
(o) Holder of a valid winning ticket on which all three numbers are matched in three "Games" for one dollar tripled three times and on which two of the numbers are matched in one "Game" for one dollar once shall win a regular prize award of ten dollars;
(p) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for one dollar tripled and on which two of the numbers are matched in two "Games" for three dollars once and four dollars once shall win a regular prize award of ten dollars;
(q) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for ten dollars once shall win a regular prize award of ten dollars;
(r) Holder of a valid winning ticket on which two of the numbers are matched in twelve "Games" for one dollar ten times, two dollars once and three dollars once shall win a regular prize award of fifteen dollars;
(s) Holder of a valid winning ticket on which two of the numbers are matched in three "Games" for five dollars three times shall win a regular prize award of fifteen dollars;
(t) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for four dollars tripled and on which two of the numbers are matched in one "Game" for three dollars once shall win a regular prize award of fifteen dollars;
(u) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for five dollars tripled shall win a regular prize award of fifteen dollars
(v) Holder of a valid winning ticket on which all three numbers are matched in two "Games" for three dollars tripled and two dollars tripled shall win a regular prize award of fifteen dollars;
(w) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for one dollar times five and on which two of the numbers are matched in one "Game" for ten dollars once shall win a regular prize award of fifteen dollars;
(x) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for fifteen dollars once shall win a regular prize award of fifteen dollars;
(y) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for two dollars ten times shall win a regular prize award of twenty dollars;
(z) Holder of a valid winning ticket on which a "Money" symbol is revealed in two "Games" for two dollars times five two times shall win a regular prize award of twenty dollars;
(aa) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for five dollars tripled and on which two of the numbers are matched in two "Games" for three dollars once and two dollars once shall win a regular prize award of twenty dollars;
(bb) Holder of a valid winning ticket on which two of the numbers are matched in four "Games" for five dollars four times shall win a regular prize award of twenty dollars;
(cc) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for twenty dollars once shall win a regular prize award of twenty dollars;
(dd) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for fifty dollars once shall win a regular prize award of fifty dollars;
(ee) Holder of a valid winning ticket on which two of the numbers are matched in twelve "Games" for three dollars ten times and ten dollars two times shall win a regular prize award of fifty dollars;
(ff) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for ten dollars tripled and on which two of the numbers are matched in two "Games" for ten dollars two times shall win a regular prize award of fifty dollars;
(gg) Holder of a valid winning ticket on which two of the numbers are matched in seven "Games" for five dollars six times and twenty dollars once shall win a regular prize award of fifty dollars;
(hh) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for five dollars ten times shall win a regular prize award of fifty dollars;
(ii) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for ten dollars times five shall win a regular prize award of fifty dollars;
(jj) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for fifteen dollars tripled and on which two of the numbers are matched in two "Games" for three dollars once and two dollars once shall win a regular prize award of fifty dollars;
(kk) Holder of a valid winning ticket on which two of the numbers are matched in twelve "Games" for four dollars ten times and five dollars two times shall win a regular prize award of fifty dollars;
(ll) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for ten dollars ten times shall win a regular prize award of one hundred dollars;
(mm) Holder of a valid winning ticket on which a "Money" symbol is revealed in two "Games" for ten dollars times five two times shall win a regular prize award of one hundred dollars;
(nn) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for twenty dollars tripled and on which two of the numbers are matched in eight "Games" for five dollars eight times shall win a regular prize award of one hundred dollars;
(oo) Holder of a valid winning ticket on which two of the numbers are matched in twelve "Games" for five dollars ten times and twenty-five dollars two times shall win a regular prize award of one hundred dollars;
(pp) Holder of a valid winning ticket on which all three numbers are matched in three "Games" for ten dollars tripled three times and on which two of the numbers are matched in two "Games" for five dollars two times shall win a regular prize award of one hundred dollars;
(qq) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for ten dollars times five and on which two of the numbers are matched in two "Games" for twenty-five dollars two times shall win a regular prize award of one hundred dollars;
(rr) Holder of a valid winning ticket on which two of the numbers are matched in three "Games" for twenty-five dollars two times and fifty dollars once shall win a regular prize award of one hundred dollars;
(ss) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for one hundred dollars once shall win a regular prize award of one hundred dollars;
(tt) Holder of a valid winning ticket on which two of the numbers are matched in twelve "Games" for twenty dollars two times, thirty dollars two times and fifty dollars eight times shall win a regular prize award of five hundred dollars;
(uu) Holder of a valid winning ticket on which two of the numbers are matched in four "Games" for fifty dollars four times and on which three numbers are matched in one "Game" for one hundred dollars tripled shall win a regular prize award of five hundred dollars;
(vv) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for one hundred dollars times five shall win a regular prize award of five hundred dollars;
(ww) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for fifty dollars ten times shall win a regular prize award of five hundred dollars;
(xx) Holder of a valid winning ticket on which two of the numbers are matched in eight "Games" for fifty dollars six times and one hundred dollars two times shall win a regular prize award of five hundred dollars;
(yy) Holder of a valid winning ticket on which all three numbers are matched in one "Game" for fifty dollars tripled and on which two of the numbers are matched in four "Games" for one hundred dollars three times and fifty dollars once shall win a regular prize award of five hundred dollars;
(zz) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for five hundred dollars once shall win a regular prize award of five hundred dollars;
(aaa) Holder of a valid winning ticket on which two of the numbers are matched in twelve "Games" for fifty dollars four times and one hundred dollars eight times shall win a regular prize award of one thousand dollars;
(bbb) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for one hundred dollars ten times shall win a regular prize award of one thousand dollars;
(ccc) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for one hundred dollars once and on which all three numbers are matched in three "Games" for one hundred dollars tripled three times shall win a regular prize award of one thousand dollars;
(ddd) Holder of a valid winning ticket on which two of the numbers are matched in two "Games" for five hundred dollars two times shall win a regular prize award of one thousand dollars;
(eee) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for one thousand dollars once shall win a regular prize award of one thousand dollars;
(fff) Holder of a valid winning ticket on which two of the numbers are matched in ten "Games" for fifty dollars ten times, on which three numbers are matched in one "Game" for five hundred dollars tripled and on which three numbers are matched in one "Game" for one thousand dollars tripled shall win a regular prize award of five thousand dollars;
(ggg) Holder of a valid winning ticket on which two of the numbers are matched in five "Games" for one thousand dollars five times shall win a regular prize award of five thousand dollars;
(hhh) Holder of a valid winning ticket on which a "Money" symbol is revealed in one "Game" for one thousand dollars times five shall win a regular prize award of five thousand dollars;
(iii) Holder of a valid winning ticket on which two of the numbers are matched in five "Games" for five hundred dollars five times and on which a "Money" symbol is revealed in one "Game" for five hundred dollars times five shall win a regular prize award of five thousand dollars;
(jjj) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for five thousand dollars once shall win a regular prize award of five thousand dollars;
(kkk) Holder of a valid winning ticket on which a "Money" symbol is revealed in two "Games" for five thousand dollars times five two times shall win a regular prize award of fifty thousand dollars;
(lll) Holder of a valid winning ticket on which three of the numbers are matched in one "Game" for five thousand dollars tripled, on which a "Money" symbol is revealed in one "Game" for five thousand dollars times five and on which two of the numbers are matched in ten "Games" for one thousand dollars times ten shall win a regular prize award of fifty thousand dollars; and
(mmm) Holder of a valid winning ticket on which two of the numbers are matched in one "Game" for fifty thousand dollars once shall win a regular prize award of fifty thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number two hundred thirty-nine will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using techniques in order that the following occur:
(1) Combinations winning each prize award are distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold in the following prize categories should be as follows:
(a) Two tickets with the wining prize combination as set forth in paragraph (D)(2)(mmm) of this rule to win fifty thousand dollars;
(b) Two tickets with the wining prize combination as set forth in paragraph (D)(2)(lll) of this rule to win fifty thousand dollars;
(c) Three tickets with the wining prize combination as set forth in paragraph (D)(2)(kkk) of this rule to win fifty thousand dollars;
(d) Five tickets with the wining prize combination as set forth in paragraph (D)(2)(jjj) of this rule to win five thousand dollars;
(e) Ten tickets with the wining prize combination as set forth in paragraph (D)(2)(iii) of this rule to win five thousand dollars;
(f) Ten tickets with the wining prize combination as set forth in paragraph (D)(2)(hhh) of this rule to win five thousand dollars;
(g) Five tickets with the wining prize combination as set forth in paragraph (D)(2)(ggg) of this rule to win five thousand dollars;
(h) Ten tickets with the wining prize combination as set forth in paragraph (D)(2)(fff) of this rule to win five thousand dollars;
(i) Ten tickets with the wining prize combination as set forth in paragraph (D)(2)(eee) of this rule to win one thousand dollars;
(j) Ten tickets with the wining prize combination as set forth in paragraph (D)(2)(ddd) of this rule to win one thousand dollars;

(jjj) Forty thousand tickets with the wining prize combination as set forth in paragraph (D)(2)(d) of this rule to win three dollars;
(kkk) One hundred twenty thousand tickets with the wining prize combination as set forth in paragraph (D)(2)(c) of this rule to win three dollars;
(lll) One hundred sixty thousand tickets with the wining prize combination as set forth in paragraph (D)(2)(b) of this rule to win three dollars; and
(mmm) One hundred sixty thousand tickets with the wining prize combination as set forth in paragraph (D)(2)(a) of this rule to win three dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Imprinting of prize awards on all tickets issued in game rule number two hundred thirty-nine shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number two hundred thirty-nine is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number two hundred thirty-nine in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within the time limits set forth by commission rules.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number two hundred thirty-nine void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number two hundred thirty-nine.
(1) The director shall conduct game rule number two hundred thirty-nine in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number two hundred thirty-nine. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number two hundred thirty-nine used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number two hundred thirty-nine and these elements may be given names or titles chosen by the commission.
