3770:1-9-253. Game rule number two hundred fifty-three
-
(A) Title and term. Ohio lottery commission game rule number two hundred fifty-three, "Lucky 8's Doubler," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number two hundred fifty-three.
(B) General design.
(1) Game rule number two hundred fifty-three is a "Tic-Tac-Toe" type lottery game with a "Bonus" feature, and is generally known as an "instant lottery."
(2) The player is required to scratch off the covering to reveal nine symbols. If the player reveals three "8" symbols in the same vertical, horizontal or diagonal straight line, the player wins the prize value revealed in the "Prize" box. The player then scratches off the covering over the "Bonus" box play area to determine whether the prize won will be a "Single" or "Double" prize. If the player reveals a "Single" symbol in the "Bonus" box play area, the player wins the prize value revealed in the "Prize" box. If the player reveals a "Double" symbol in the "Bonus" box play area, the player wins double the prize value revealed in the "Prize" box.
(3) The only "prize values" which shall appear on a ticket in game rule number two hundred fifty-three are: one dollar, two dollars, four dollars, eight dollars, ten dollars, twenty dollars, forty dollars, eighty dollars, one hundred dollars, two hundred dollars, four hundred dollars and eight hundred dollars. Prize values, play symbols and prize levels appearing on any ticket in game rule number two hundred fifty-three shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying prize values, play symbols and prize levels.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number two hundred fifty-three shall be one dollar.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number two hundred fifty-three called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, four dollars, eight dollars, ten dollars, twenty dollars, forty dollars, eighty dollars, one hundred dollars, two hundred dollars, four hundred dollars and eight hundred dollars. Each ticket in game rule number two hundred fifty-three shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for one dollar and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of one dollar;
(b) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for one dollar and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two dollars;
(c) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for two dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two dollars;
(d) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for two dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four dollars;
(e) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for four dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four dollars;
(f) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for four dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of eight dollars;
(g) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for eight dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of eight dollars;
(h) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for ten dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of ten dollars;
(i) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for ten dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of twenty dollars;
(j) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for twenty dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of twenty dollars;
(k) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for twenty dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of forty dollars;
(l) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for forty dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of forty dollars;
(m) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for forty dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of eighty dollars;
(n) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for eighty dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of eighty dollars;
(o) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for one hundred dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of one hundred dollars;
(p) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for one hundred dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two hundred dollars;
(q) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for two hundred dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of two hundred dollars;
(r) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for two hundred dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four hundred dollars;
(s) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for four hundred dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of four hundred dollars;
(t) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for four hundred dollars and a "Double" symbol is revealed in the "Bonus" box play area shall win a regular prize award of eight hundred dollars; and
(u) Holder of a valid winning ticket on which three "8" symbols are revealed in a vertical, horizontal or diagonal straight line for eight hundred dollars and a "Single" symbol is revealed in the "Bonus" box play area shall win a regular prize award of eight hundred dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number two hundred fifty-three will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that the following occur:
(1) Combinations winning each prize award are distributed throughout all tickets printed in any given ticket issuance; and
(2) Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per eight million tickets sold should be as follows:
(a) Fifteen tickets with the winning prize combination as set forth in paragraph (D)(2)(u) of this rule to win eight hundred dollars;
(b) Fifteen tickets with the winning prize combination as set forth in paragraph (D)(2)(t) of this rule to win eight hundred dollars;
(c) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(s) of this rule to win four hundred dollars;
(d) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(r) of this rule to win four hundred dollars;
(e) Forty tickets with the winning prize combination as set forth in paragraph (D)(2)(q) of this rule to win two hundred dollars;
(f) Forty tickets with the winning prize combination as set forth in paragraph (D)(2)(p) of this rule to win two hundred dollars;
(g) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(o) of this rule to win one hundred dollars;
(h) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(n) of this rule to win eighty dollars;
(i) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(m) of this rule to win eighty dollars;
(j) Two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win forty dollars;
(k) Four hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win forty dollars;
(l) Twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win twenty dollars;
(m) Twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win twenty dollars;
(n) Forty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win ten dollars;
(o) Forty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win eight dollars;
(p) Forty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win eight dollars;
(q) Eighty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win four dollars;
(r) One hundred sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win four dollars;
(s) Three hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win two dollars;
(t) Three hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win two dollars; and
(u) Six hundred eighty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win one dollar.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Random imprinting of prize awards on all tickets issued in game rule number two hundred fifty-three shall be accomplished in a manner, which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number two hundred fifty-three is sold or deemed sold in accordance with this rule and the covering material over any of the prize values, play symbols and prize levels has been removed, the holder shall be deemed to have drawn the prize values, play symbols and prize levels on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number two hundred fifty-three in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within one hundred eighty days from the announced closing date of game rule number two hundred fifty-three.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number two hundred fifty-three void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number two hundred fifty-three.
(1) The director shall conduct game rule number two hundred fifty-three in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number two hundred fifty-three. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number two hundred fifty-three used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number two hundred fifty-three and these elements may be given names or titles chosen by the commission.
