3770:1-9-254. Game rule number two hundred fifty-four

(A) Title and term. Ohio lottery commission game rule number two hundred fifty-four, "Frogger®," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number two hundred fifty-four.
(B) General design.
(1) Game rule number two hundred fifty-four is an extended play game and is generally known as an "instant lottery."
(2) The player will remove the covering over "Frog 1," "Frog 2," and "Frog 3." The player will then scratch the square in the direction indicated by the arrow. If the path revealed by the arrows ends in the "Finish" play area, the player wins the prize revealed. If the path revealed by following the arrows contains an "X" symbol, the path ends and the game is over for the corresponding "Frog." If the path reveals a "Frog" symbol, the player will continue onto the path as directed by the symbol within the same box. If the player reveals three "Frog" symbols within the three frog paths, the player wins fifty dollars automatically. If the path reveals a "Coin" symbol, the player will continue onto the path as directed by the symbol within the same box. If the player reveals three "Coin" symbols within the three frog paths, the player wins one hundred dollars automatically. There are four chances to win on each ticket and player may win up to five times.
(3) The only "prize values" which shall appear on a ticket in game rule number two hundred fifty-four are: two dollars, three dollars, five dollars, ten dollars, fifteen dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, ten thousand dollars and sixty thousand dollars. Numbers, prize values and play symbols appearing on any ticket in game rule number two hundred fifty-four shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying numbers, prize values and play symbols.
(C) Price of tickets. The price of a ticket issued by the commission in game rule number two hundred fifty-four shall be three dollars.
(D) Structure, nature and value of prize awards.
(1) There shall be one type of prize in game rule number two hundred fifty-four called a "regular prize award."
(2) As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: three dollars, five dollars, ten dollars, fifteen dollars, twenty dollars, fifty dollars, one hundred dollars, two hundred dollars, five hundred dollars, one thousand dollars, ten thousand dollars and sixty thousand dollars. Each ticket in game rule number two hundred fifty-four shall be imprinted in such a way that prize awards from the set listed above may be won.
(a) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for three dollars once shall win a regular prize award of three dollars;
(b) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for two dollars once and three dollars once shall win a regular prize award of five dollars;
(c) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for five dollars once shall win a regular prize award of five dollars;
(d) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for ten dollars once shall win a regular prize award of ten dollars;
(e) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for five dollars two times shall win a regular prize award of ten dollars;
(f) Holder of a valid winning ticket on which three of the revealed paths reach the "Finish" play areas for five dollars once, two dollars once and three dollars once shall win a regular prize award of ten dollars;
(g) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for fifteen dollars once shall win a regular prize award of fifteen dollars;
(h) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for five dollars and ten dollars once shall win a regular prize award of fifteen dollars;
(i) Holder of a valid winning ticket on which three of the revealed paths reach the "Finish" play areas for five dollars three times shall win a regular prize award of fifteen dollars;
(j) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for twenty dollars once shall win a regular prize award of twenty dollars;
(k) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for ten dollars two times shall win a regular prize award of twenty dollars;
(l) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for fifteen dollars once and five dollars once shall win a regular prize award of twenty dollars;
(m) Holder of a valid winning ticket on which three of the revealed paths reach the "Finish" play areas for five dollars two times and ten dollars once shall win a regular prize award of twenty dollars;
(n) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for fifty dollars once shall win a regular prize award of fifty dollars;
(o) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for twenty-five dollars two times shall win a regular prize award of fifty dollars;
(p) Holder of a valid winning ticket on which three "Frog" symbols are revealed across the three revealed frog paths for fifty dollars once shall win a regular prize award of fifty dollars;
(q) Holder of a valid winning ticket on which three of the revealed paths reach the "Finish" play areas for twenty-five dollars once, fifteen dollars once and ten dollars once shall win a regular prize award of fifty dollars;
(r) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for one hundred dollars once shall win a regular prize award of one hundred dollars;
(s) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for fifty dollars two times shall win a regular prize award of one hundred dollars;
(t) Holder of a valid winning ticket on which three "Coin" symbols are revealed across the three revealed frog paths for one hundred dollars once shall win a regular prize award of one hundred dollars;
(u) Holder of a valid winning ticket on which three "Frog" symbols are revealed across the three revealed frog paths for fifty dollars once and on which one of the revealed paths reaches the "Finish" play area for fifty dollars once shall win a regular prize award of one hundred dollars;
(v) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for two hundred dollars once shall win a regular prize award of two hundred dollars;
(w) Holder of a valid winning ticket on which three "Coin" symbols are revealed across the three revealed frog paths for one hundred dollars once, on which three "Frog" symbols are revealed across the three revealed frog paths for fifty dollars once and on which one of the revealed paths reaches the "Finish" play area for fifty dollars once shall win a regular prize award of two hundred dollars;
(x) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for one hundred dollars two times shall win a regular prize award of two hundred dollars;
(y) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for one hundred dollars once and on which three "Coin" symbols are revealed across the three revealed frog paths for one hundred dollars once shall win a regular prize award of two hundred dollars;
(z) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for five hundred dollars once shall win a regular prize award of five hundred dollars;
(aa) Holder of a valid winning ticket on which three "Frog" symbols are revealed across the three revealed frog paths for fifty dollars once and on which three of the revealed paths reach the "Finish" play areas for two hundred dollars two times and fifty dollars once shall win a regular prize award of five hundred dollars;
(bb) Holder of a valid winning ticket on which three "Coin" symbols are revealed across the three revealed frog paths for one hundred dollars once and on which two of the revealed paths reach the "Finish" play areas for two hundred dollars two times shall win a regular prize award of five hundred dollars;
(cc) Holder of a valid winning ticket on which three of the revealed paths reach the "Finish" play areas for two hundred dollars two times and one hundred dollars once shall win a regular prize award of five hundred dollars;
(dd) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for one thousand dollars once shall win a regular prize award of one thousand dollars;
(ee) Holder of a valid winning ticket on which two of the revealed paths reach the "Finish" play areas for five hundred dollars two times shall win a regular prize award of one thousand dollars;
(ff) Holder of a valid winning ticket on which three of the revealed paths reach the "Finish" play areas for five hundred dollars once and two hundred dollars two times and on which three "Coin" symbols are revealed across the three revealed frog paths for one hundred dollars once shall win a regular prize award of one thousand dollars;
(gg) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for ten thousand dollars once shall win a regular prize award of ten thousand dollars; and
(hh) Holder of a valid winning ticket on which one of the revealed paths reaches the "Finish" play area for sixty thousand dollars once shall win a regular prize award of sixty thousand dollars.
(E) Number of prize awards. The number of prize awards in any sales cycle of game rule number two hundred fifty-four will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using techniques in order that the following occur:
(1) Combinations winning each prize award are distributed throughout all tickets printed in any given ticket issuance;
(2) Mathematical reasoning indicates that the number of winning tickets per four million tickets sold in the following prize categories should be as follows:
(a) Eight tickets with the winning prize combination as set forth in paragraph (D)(2)(hh) of this rule to win sixty thousand dollars;
(b) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(gg) of this rule to win ten thousand dollars;
(c) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(ff) of this rule to win one thousand dollars;
(d) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(ee) of this rule to win one thousand dollars;
(e) Ten tickets with the winning prize combination as set forth in paragraph (D)(2)(dd) of this rule to win one thousand dollars;
(f) Twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(cc) of this rule to win five hundred dollars;
(g) Twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(bb) of this rule to win five hundred dollars;
(h) Twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(aa) of this rule to win five hundred dollars;
(i) Twenty-five tickets with the winning prize combination as set forth in paragraph (D)(2)(z) of this rule to win five hundred dollars;
(j) Seven hundred twenty tickets with the winning prize combination as set forth in paragraph (D)(2)(y) of this rule to win two hundred dollars;
(k) Four hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(x) of this rule to win two hundred dollars;
(l) Seven hundred twenty tickets with the winning prize combination as set forth in paragraph (D)(2)(w) of this rule to win two hundred dollars;
(m) Four hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(v) of this rule to win two hundred dollars;
(n) Two thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(u) of this rule to win one hundred dollars;
(o) Two thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(t) of this rule to win one hundred dollars;
(p) Eight hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(s) of this rule to win one hundred dollars;
(q) Eight hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(r) of this rule to win one hundred dollars;
(r) One thousand six hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(q) of this rule to win fifty dollars;
(s) Three thousand two hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(p) of this rule to win fifty dollars;
(t) Two thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(o) of this rule to win fifty dollars;
(u) One thousand six hundred tickets with the winning prize combination as set forth in paragraph (D)(2)(n) of this rule to win fifty dollars;
(v) Eight thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(m) of this rule to win twenty dollars;
(w) Sixteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(l) of this rule to win twenty dollars;
(x) Eight thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(k) of this rule to win twenty dollars;
(y) Eight thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(j) of this rule to win twenty dollars;
(z) Sixteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(i) of this rule to win fifteen dollars;
(aa) Sixteen thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(h) of this rule to win fifteen dollars;
(bb) Eight thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(g) of this rule to win fifteen dollars;
(cc) Fifty-six thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(f) of this rule to win ten dollars;
(dd) Fifty-six thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(e) of this rule to win ten dollars;
(ee) Forty-eight thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(d) of this rule to win ten dollars;
(ff) One hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(c) of this rule to win five dollars;
(gg) One hundred sixty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(b) of this rule to win five dollars; and
(hh) Five hundred twenty thousand tickets with the winning prize combination as set forth in paragraph (D)(2)(a) of this rule to win three dollars.
(F) Tickets sold. Chances of winning and the number of winning tickets are established at the time of printing and will change as prizes are won.
(G) Frequency of prize drawings.
(1) Imprinting of prize awards on all tickets issued in game rule number two hundred fifty-four shall be accomplished in a manner which complies with the commission's rules and procedures.
(2) When a ticket issued in game rule number two hundred fifty-four is sold or deemed sold in accordance with this rule and the covering material over any of the numbers, prize values and play symbols has been removed, the holder shall be deemed to have drawn the numbers, prize values and play symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number two hundred fifty-four in which the ticket was sold.
(H) Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed within one hundred eighty days from the announced closing date of game rule number two hundred fifty-four.
(I) Validity of tickets.
(1) A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.
(2) In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number two hundred fifty-four void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.
(J) Director's conduct of game rule number two hundred fifty-four.
(1) The director shall conduct game rule number two hundred fifty-four in a manner consistent with the Lottery Act and the rules of the commission including, without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number two hundred fifty-four. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.
(2) Names and definitions of elements of game rule number two hundred fifty-four used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number two hundred fifty-four and these elements may be given names or titles chosen by the commission.
