    3770:1-9-450               Game rule number four hundred fifty.

     

     

     

    (A)   Title and term. Ohio lottery commission game rule number four hundred fifty, "Wild Cherry," shall be conducted at such times and for such periods as the commission may determine. For the purpose of this rule, "sales cycle" shall mean any such period, including reprints, beginning on the date when ticket sales are commenced and continuing through the date established by the director as the date on which sales agents are to make their final settlement with respect to tickets allocated to them during the period in game rule number four hundred fifty.

     

    (B)  General design.

     

    (1)   Game rule number four hundred fifty contains four separate chances to match three like symbols with an additional instant win feature, and is generally known as an instant lottery.

     

    (2)   The player shall reveal three play symbols in "Game 1" through "Game 4." The player must match three like play symbols in any one "Game" across to win the corresponding prize value shown in the "Prize" area for that "Game." Play symbols shall include: "Orange," "Melon," "Banana," "Lemon," "Pineapple," "Grapes," "Apple," "Bar," "Seven," "Crown," "Bell," "Horseshoe," "Clover" and "Diamond." If the player reveals a "Wild Cherry" symbol in any one "Game" across, the player wins the corresponding prize value shown in the "Prize" area for that "Game" automatically. There are four chances to win on each ticket, and a player may win up to four times on one ticket.

     

    (3)   As used in this rule, "prize award" shall mean one of the following monetary figures which is the total of all winning prize values appearing on the ticket: one dollar, two dollars, four dollars, ten dollars, twenty-five dollars, fifty dollars, one hundred dollars and one thousand dollars. Each ticket in game rule number four hundred fifty shall be imprinted in such a way that prize awards from the set listed above may be won.

     

    (C)   Price of tickets. The price of a ticket issued by the commission in game rule number four hundred fifty shall be one dollar.

     

    (D)  Structure, nature and value of prize awards.

     

    (1)   There shall be one type of prize in game rule number four hundred fifty called a "regular prize award."

     

    (2)   The only "prize values" which shall appear on a ticket in game rule number four

     

     

    hundred fifty are: one dollar, two dollars, three dollars, four dollars, five dollars, ten dollars, twenty dollars, twenty-five dollars, fifty dollars, one hundred dollars and one thousand dollars. Play symbols and prize symbols appearing on any ticket in game rule number four hundred fifty shall be concealed by an opaque covering which may be scratched off by the holder of the ticket to reveal the underlying play symbols and prize symbols.

    (a)   Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for one dollar once shall win a regular prize award of a one dollar;

    (b)   Holder of a valid winning ticket matching three like play symbols in two "Games" across; a "Wild Cherry" symbol is revealed in two "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in two "Games" across for one dollar two times shall win a regular prize award of two dollars;

    (c)   Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for two dollars once shall win a regular prize award of two dollars;

    (d)   Holder of a valid winning ticket matching three like play symbols in all four "Games" across; a "Wild Cherry" symbol is revealed in all four "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in four "Games" across for one dollar four times shall win a regular prize award of four dollars;

    (e)   Holder of a valid winning ticket matching three like play symbols in three "Games" across; a "Wild Cherry" symbol is revealed in three "Games" across;  or  any  combination  of  matching  three  like  play  symbols  or revealing "Wild Cherry"  symbols  in  three  "Games"  across  for  one dollar two times and two dollars once shall win a regular prize award of four dollars;

    (f)   Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for four dollars once shall win a regular prize award of four dollars;

    (g)    Holder of a valid winning ticket matching three like play symbol in all four "Games" across; a "Wild Cherry" symbol is revealed in all four

    "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in four "Games" across for one dollar once and three dollars three times shall win a regular prize award of ten dollars;

    (h)   Holder of a valid winning ticket matching three like play symbols in two "Games" across; a "Wild Cherry" symbol is revealed in two "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in two "Games" across for five dollars two times shall win a regular prize award of ten dollars;

    (i)    Holder of a valid winning ticket matching three like play symbols in all four "Games" across; a "Wild Cherry" symbol is revealed in all four "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in four "Games" across for one dollar once, two dollars two times and five dollars once shall win a regular prize award of ten dollars;

    (j)    Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for ten dollars once shall win a regular prize award of ten dollars;

    (k)   Holder of a valid winning ticket matching three like play symbols in three "Games" across; a "Wild Cherry" symbol is revealed in three "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in three "Games" across for five dollars once and ten dollars two times shall win a regular prize award of twenty-five dollars;

    (l)    Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for twenty-five dollars once shall win a regular prize award of twenty-five dollars;

    (m)    Holder of a valid winning ticket matching three like play symbols in three "Games" across; a "Wild Cherry" symbol is revealed in three "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in three "Games" across for ten dollars once and twenty dollars two times shall win a regular prize award of fifty dollars;

    (n)   Holder of a valid winning ticket matching three like play symbols in two "Games" across; a "Wild Cherry" symbol is revealed in two "Games"

    across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in two "Games" across for twenty-five dollars two times shall win a regular prize award of fifty dollars;

    (o)   Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for fifty dollars once shall win a regular prize award of fifty dollars;

    (p)   Holder of a valid winning ticket matching three like play symbols in all four "Games" across; a "Wild Cherry" symbol is revealed in all four "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in four "Games" across for twenty-five dollars four times shall win a regular prize award of one hundred dollars;

    (q)   Holder of a valid winning ticket matching three like play symbols in two "Games" across; a "Wild Cherry" symbol is revealed in two "Games" across; or any combination of matching three like play symbols or revealing "Wild Cherry" symbols in two "Games" across for fifty dollars two times shall win a regular prize award of one hundred dollars;

    (r)   Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for one hundred dollars once shall win a regular prize award of one hundred dollars; and

    (s)   Holder of a valid winning ticket matching three like play symbols in one "Game" across or a "Wild Cherry" symbol is revealed in one "Game" across for one thousand dollars once shall win a regular prize award of one thousand dollars.

    (E)   Number of prize awards. The number of prize awards in any sales cycle of game rule number four hundred fifty will depend upon the number of tickets sold during that cycle. However, distribution and availability for public purchase may be affected by, but not limited to, circumstances such as stolen, defective, missing, damaged, promotional, returned or reordered tickets. Tickets shall be printed in accordance with this rule using random techniques in order that:

    (1)   Combinations winning each prize award are randomly distributed throughout all tickets printed in any given ticket issuance; and

    (2)   Mathematical reasoning indicates that over a sufficiently large number of tickets sold, the average number of winning tickets per two hundred thousand tickets sold should be as follows:

    (a)    Three tickets winning one thousand dollars in one "Game" to win one thousand dollars;

    (b)     Two tickets winning one hundred dollars in one "Game" to win one hundred dollars;

    (c)    Two tickets winning fifty dollars in two "Games" to win one hundred dollars;

    (d)    Two tickets winning twenty-five dollars in four "Games" to win one hundred dollars;

    (e)   Eight tickets winning fifty dollars in one "Game" to win fifty dollars;

    (f)    Twenty-five tickets winning twenty-five dollars in two "Games" to win fifty dollars;

    (g)   Seventy-five tickets winning ten dollars in one "Game" and twenty dollars in two "Games" to win fifty dollars;

    (h)    Five hundred tickets winning twenty-five dollars in one "Game" to win twenty-five dollars;

    (i)   Five hundred tickets winning five dollars in one "Game" and ten dollars in two "Games" to win twenty-five dollars;

    (j)    Two hundred fifty tickets winning ten dollars in one "Game" to win ten dollars;

    (k)   Two hundred fifty tickets winning one dollar in one "Game", two dollars in two "Games" and five dollars in one "Game" to win ten dollars;

    (l)     Five hundred tickets winning five dollars in two "Games" to win ten dollars;

    (m)   Five hundred tickets winning one dollar in one "Game" and three dollars

    in three "Games" to win ten dollars;

    (n)    One thousand tickets winning four dollars in one "Game" to win four dollars;

    (o)   Two thousand tickets winning one dollar in two "Games" and two dollars in one "Game" to win four dollars;

    (p)    Four thousand tickets winning one dollar in four "Games" to win four dollars;

    (q)     Six thousand tickets winning two dollars in one "Game" to win two dollars;

    (r)    Eight thousand tickets winning one dollar in two "Games" to win two dollars; and

    (s)   Seventeen thousand tickets winning one dollar in one "Game" to win one dollar.

    (F)   Tickets sold. Chances of winning and the number of wining tickets are established at the time of printing and will change as prizes are won.

    (G)  Frequency of prize drawings.

    (1)    Random imprinting of prize awards on all tickets issued in game rule number four hundred fifty shall be accomplished in a manner which complies with the commission's rules and procedures.

    (2)   When a ticket issued in game rule number four hundred fifty is sold or deemed sold in accordance with this rule and the covering material over any of play symbols and prize symbols has been removed, the holder shall be deemed to have drawn the play symbols and prize symbols on that ticket which determine whether the holder is entitled to a regular prize award. All regular prize awards shall be deemed announced no later than the last day of the sales cycle of game rule number four hundred fifty in which the ticket was sold.

    (H)    Special claim, entry, receipt and validation procedures. The director shall establish special claim, entry, receipt and validation procedures, including procedures for validation by sales agents of tickets winning prize awards which are to be paid by sales agents in accordance with commission rules. Prize awards shall be claimed

    within the time limits set forth by commission rules.

    (I)  Validity of tickets.

    (1)   A mechanical error in printing prize awards, symbols, words or other numbers on a ticket shall not automatically invalidate that ticket. To the extent feasible, the director shall establish procedures by which the holder of any ticket on which information is incorrectly printed due to mechanical malfunction may be advised of correct information for the ticket. If it is not technically feasible to recover the information from a mechanically misprinted ticket, the director may declare the ticket void and the holder shall be entitled to a return of the ticket price or a replacement ticket of comparable price.

    (2)   In addition to, but not in limitation of, all other power and authority conferred on the director by the commission's rules, the director may declare a ticket in game rule number four hundred fifty void if it is stolen, unissued, deactivated, not sold or deemed not sold in accordance with commission rules; if it is illegible, mutilated, altered, counterfeit, misregistered, reconstituted, miscut, defective, printed or produced in error or incomplete; or if the ticket fails any of the validation tests or procedures established by the director. The commission's liability and responsibility for a ticket declared void, if any, is limited to refund of the retail sales price of the ticket or issuance of a replacement ticket of comparable price.

    (J)   Director's conduct of game rule number four hundred fifty.

    (1)    The director shall conduct game rule number four hundred fifty in a manner consistent with the Lottery Act, the rules of the commission, including without limitation, this rule and the regulations of the director. As deemed necessary or advisable, the director shall adopt management regulations, orders or directives to implement and operate this lottery game. The director shall inform the public of the provisions of this rule and the procedures established pursuant hereto which affect the play of game rule number four hundred fifty. The director reserves the right to declare any instant game as unavailable for sale at any time to maintain game integrity and accountability.

    (2)   Names and definitions of elements of game rule number four hundred fifty used in this rule are to be considered generic terms used solely for purposes of this rule. In actual operation, game rule number four hundred fifty and these elements may be given names or titles chosen by the commission.
