    4906-5-03                    Letter  of  notification  and  construction  notice  requirements: form, content, and processing.

     

     

     

    (A)   A letter of notification shall be submitted for those projects listed under "notification required" in appendix A or B of rule 4906-1-01 of the Administrative Code, or where otherwise directed by the board or its representatives.

     

    (1)   The letter of notification shall be filed not less than ninety days before planned commencement of construction. For good cause shown, such ninety-day time period may be waived by the board or its representatives.

     

    (2)    The information contained within the letter of notification shall contain the information requested by rule 4906-15-08 of the Administrative Code.

     

    (3)    The chief executive officer of the board or his appointed representative shall respond to each letter of notification within forty-five days from the date upon which the letter of notification was filed with the board.

     

    (4)     Applicants who file letters of notification with the board may commence construction of projects reported in such letters upon the filing of a letter of approval of the notification by the chief executive officer of the board or his appointed representative.

     

    (B)    A construction notice shall be submitted to the board for any project listed under "construction notice" in appendix A of rule 4906-1-01 of the Administrative Code, or where otherwise directed by the board or its representatives.

     

    (1)    A construction notice shall be filed not less than sixty days before planned commencement of construction. For good cause shown, such sixty-day time period may be waived by the board or its representatives.

     

    (2)     If the chief executive officer of the board or his appointed representative determines that the project does not qualify for processing as a construction notice project, the applicant shall be notified of that determination within thirty days, or within fifteen days if the sixty-day time requirement for filing has been waived. The notification shall include a date, time, and place for a meeting, prior to the planned commencement of construction, to discuss filing of application requirements for the project.

     

    (3)   An applicant who files a construction notice for a project with the board may begin construction of the project on the planned date of commencement of construction provided in the construction notice, unless notified by the chief

     

     

    executive officer of the board or his appointed representative that the project does not qualify as a construction notice project.
