    NOTICE OF PUBLIC RULES HEARING

    In accordance with Chapter 119 of the Revised Code (R.C.), the Interim Director (Director) of the Ohio Department of Health (ODH), or his designee, shall conduct a public rules hearing at the date, time, and place listed above to consider the following proposed rules:

     

    O.A.C. Chapter 3701:1-37 - Physical Protection of Category One and Category Two Quantities of Radioactive Material

     

    By authority of R.C. 3748.04, the Director proposes to adopt new O.A.C. rules 3701:1- 37-01 to 3701:1-37-31. The purpose of the rule package is to provide requirements for a physical protection program when a licensee possesses category one or category two quantities of radioactive material. Ohio is an Agreement State with the U.S. Nuclear Regulatory Commission (NRC) and assumes regulatory control of the possession and use of radioactive material in the state. As an Agreement State, Ohio must maintain regulations compatible with applicable federal regulations for the use of radioactive materials. The new rules in this package were drafted to codify existing security orders from the Director of Health and to remain in compliance with the conditions of the agreement with the NRC.

     

    O.A.C. rule 3701:1-40 - Radiation Protection Requirements

     

    By authority of R.C. 3748.02 and 3748.04, the Director proposes to amend O.A.C. rule 3701:1-40-07 - Carriers. This rule specifies what carriers are exempt from regulations set forth in a number of Radiation Control chapters. The rule is amended to add Chapter 3701:1-37 to the list.

    Also on the agenda will be proposed new rules 3701-45-01 to -04, pertaining to the new Hearing Aid Assistance Program.  These rules were announced in a separate public notice.

     

    Hearing and Comment Procedure:

    At the hearing, people affected by the proposed actions may appear and be heard in person, by an attorney or both;  may present their positions, arguments, or contentions

    orally or in writing; may offer witnesses; and may present evidence tending to show that the proposed rules, if adopted or effectuated, will be unreasonable or unlawful.
